finding that Pilar Anne Grubb is in immediate and present danger of abuse from the Defendant, the
Defendant, Todd A. Koch, is enjoined from physically abusing the Plaintiff, Pilar Anne Grubb, or
placing her in fear of abuse. The Defendant is Ordered to refrain from having any contact with the
Plaintiff, from harassing the Plaintiff, from coming to the Plaintiff's place of business or to her
residence at 783 Hamilton Court, Carlisle, PA 17013. This Order shall femain In effect until a Final
Order is entered In this case. A hearing shall be held on this matter on the H.p n day of

A. ABUSE
NOW COMES Pilar Anne Grubb, by and through her attorneys, Flower, Morgenthal, Flower
& Undsay and petitions this Honorable Court as follows:
1. Plaintiff is an adult individual residing at 783 Hamilton Court, Carlisle, Cumberland
County, Pennsylvania.
2. Defendant Todd A. Koch is an adult individual whose last known address was c/o
Kathy Kline, 1414 Bradley Drive, Carlisle, Cumberland County, Pennsylvania.
3. The parties are former sexual or intimate partners.
4. Since September 1993, the Defendant has attempted to cause, or has intentionally
knowingly or recklessly caused bodily injury to the Plaintiff and has placed, by physical menace, the
Plaintiff in fear of imminent serious bodily injuries. Said instances include, but are limited to, the
following:
A. On or about May 4, 1994 at approximately 6:00 o'clock P.M. at the
Sunnyside Restaurant in Carlisle, PA, Plaintiff told Defendant that he was no longer
permitted to come to her apartment, which statement made the Defendant angry and
he stated to the Plaintiff, "I'm going to kill you." The threat made the Plaintiff seriously
afraid so that she consulted with counsel early on the morning of May 5, 1994.

B. On Friday, April 22, 1994, at approximately 4:30 o'clock P.M. the parties
had a dispute over the Defendant's taking a license plate belonging to Plaintiff without
her permission and affixing it to his automobile, driving under these conditions and
incurring a parking ticket for which he refused to pay. While Defendant was In the
shower, Plaintiff removed her license plate from his vehicle. As she came into her
apartment to get her purse so that she could leave the residence, Defendant came
running down the steps. At the bottom of the steps, in an area between the living
room and dining room of Plaintiff's residence, he grabbed Plaintiff by the upper arms
and shoved her backwards through the dining room into the kitchen and against the
kitchen sink. During this physical assault, Plaintiff called for her daughter Stacey, age
15, to come to her aid. As Defendant pushed Plaintiff he gritted his teeth and,
speaking through clenched teeth said "You're not listening to me, I don't want to go
to jail." Upon Stacey's appearance in the kitchen. Defendant released Plaintiff's upper
arms, leaving behind a cut on her right forearm, the scar of which is visible on May
5, 1994 and bruises on her upper arms. Fearful of the Defendant, Plaintiff and her
daughter immediately fled her residence and sought shelter with a neighbor, Donna
Cunningham. From Ms. Cunningham's apartment, she called the Defendant and
requested that he leave his key to her apartment behind when left for work. The
Defendant refused and that night Petitioner and her daughter slept together in the
living room with a can of mace nearby. The next day, April 23, 1994, she arranged
to have the locks on the house changed.
C. On November 18, 1993, while intoxicated, Defendant threatened to kill
the Plaintiff after having been removed from her house by the police and having
returned shouting to be let back into the house. Defendant was able to gain entry and
the Police were once again called by Plaintiff's friend while Plaintiff and her daughter,
once again, fled to the apartment of Donna Cunningham. The police removed the
Defendant from the Plaintiff's home once again.
5. The Plaintiff believes and therefore avers that she will be in immediate and present
danger of abuse from the Defendant and that she is in need of protection from such abuse.
6. The Plaintiff desires the Defendant be ordered to refrain/rom any contact with her.
7. The Plaintiff desires the Defendant be ordered to refrain from any harassment of her.
8. The Plaintiff desires the Defendant be ordered to stay away from her apartment, which
is leased to her only, at 783 Hamilton Court, Carlisle, PA 17013.

B. ATTORNEY'S FEES AND COSTS
9. Plaintiff asks the Defendant be ordered to reimburse her for the filing fees and service
costs which she has incurred as a result of having to file this action.
10. The Plaintiff asks that the Defendant be ordered to pay reasonable attorney's fees
pursuant to the Protection from Abuse Act.
WHEREFORE, pursuant to the provisions of the Protection from Abuse Act, 23 Pa C.S.A.
Section 6101 et seq., as amended, the Plaintiff prays this Honorable Court to grant a Temporary
Order requiring the Defendant to refrain from abusing the Plaintiff or placing her in fear of abuse,
requiring him to refrain from having any contact with the Plaintiff, requiring him from harassing the
Plaintiff, coming to her place of business or coming to her apartment. The Plaintiff also requests
a hearing in accordance with the Protection From Abuse Act and, following such hearing, the entry
of an Order requiring the Defendant to refrain from abusing the Plaintiff, or placing her in fear of
abuse, requiring him to refrain from any contact with the Plaintiff, from harassing the Plaintiff, from
coming to the Plaintiff's place of business or to her apartment. The Plaintiff also requests that the
Defendant be ordered to pay the costs of filing the instant action, serving the Court's Order on the
Defendant and reasonable attorney's fees. The Plaintiff prays for such other relief as the Court may
deem just and proper.

Civil 1994 on the 5th day of ~ay 1994,by the Honorable Edgar B. Bayley,which order directed
the defendant not to have any contact with or harassing Pilar Anne Grubb the plantiff either
at her place of employment or the residence at 783 Hamilton Ct. Carlisle Pa. In that the
defendant did call the plantiff on the telephone as directed by the plantiff's attorney to
make the necessary arrangements to regain his property. The defendant did also while on the

On the 11th of May 1994 at approx 21:45 the defendant Todd A. Koch did ~lake a phone Call to
Pilar Anne Grubb in reference to making arrangements to regain possession of his belongings
that are in Grubbs residence. The defendant and the victim at one tiole did have a relationship
that has since ended. The victim did have a protection from abuse order served on the defendant
and as a result of this PFA and the phone call a violation of the PFA did occur. The defendant
did become hostile towards the victim and made threats of bodily harm towards her as well as
general harassment. These actions did violate the PFA
