Pacific Financial Services of PA, Inc. against you.
NOTICB OF OWNBR'S RIGHTS
YOU MAY BE ABLE TO PREVENT THIS SHERIFF'S SALE
To prevent this Sheriff's Sale you must take immediate action:
1. The sale will be cancelled if you pay back to security
Pacific the amount of the judgment plus costs or the back payments,
late charges, costs, and reasonable attorneys fees due. To find
out how much you must pay, you may call: Martin and Kornfield at
717/762-3188.
2. You may be able to stop the sale by filing a petition
asking the Court to strike or open the judgment, if the judgment
was improperly entered. You may also ask the Court to postpone the
sale for good cause.
3. You may be able to stop the sale through other legal
proceedings.
You may need an attorney to assert your rights. The sooner
you contact one, the more chance you will have of stopping the
sale.
YOU MAY STILL BE ABLE TO SAVE YOUR PROPERTY AND YOU HAVE OTHER
RIGHTS EVEN IF THE SHERIFF'S SALE DOES TAKE PLACE.
1. If the Sheriff's Sale is not stopped, your property will
be sold to the highest bidder. You may find out the price bid by
calling Martin and Kornfield at 717/762-3188.

2. You may be able to petition the Court to set aside the
sale if the bid price was grossly inadequate compared to the value
of your property.
3. The sale will go through only if the buyer pays the
Sheriff the full amount due in the sale. To find out if this has
happened you may call Martin and Kornfield at 717/762-3188.
4. If the amount due from the buyer is not paid to the
Sheriff, you will remain the owner of the property as if the sale
never happened.
5. You have a right to remain in the property until the full
amount due is paid to the Sheriff and the Sheriff gives a deed to
the buyer.
At that time, the buyer may bring legal proceedings to
evict you.
6. You may be entitled to a share of the money which was
paid for your house. A schedule of distribution of the money bid
for your house will be filed by the Sheriff no later than October
7, 1994. This schedule will state who will be receiving the money.
The money will be paid out in accordance with this schedule unless
exceptions (reasons why the proposed distribution is wrong) are
filed with the Sheriff within ten (10) days after the date of
filing of said schedule.
7. You may also have other rights and defenses or ways of
getting your property back, if you act immediately after the sale.

to enforce the court judgment of $38,413.12 obtained by Security
Pacific Financial services of PA, Inc. against you.
NOTICE OF OWNER'S RIGHTS
YOU MAY BE ABLE TO PREVENT THIS SHERIFF'S SALE
To prevent this Sheriff's Sale you must take immediate action:
1. The sale will be cancelled if you pay back to Security
Pacific the amount of the judgment plus costs or the back payments,
late charges, costs, and reasonable attorneys fees due. To find
out how much you must pay, you may call: Martin and Kornfield at
717/762-3188.
2. You may be able to stop the sale by filing a petition
asking the Court to strike or open the judgment, if the judgment
was improperly entered. You may also ask the Court to postpone the
sale for good cause.
3. You may be able to stop the sale through other legal
proceedings.
You may need an attorney to assert your rights. The sooner
you contact one, the more chance you will have of stopping the
sale.
YOU MAY STILL BE ABLE TO SAVE YOUR PROPERTY AND YOU HAVE OTHER
RIGHTS EVEN IF THE SHERIFF'S SALE DOES TAKE PLACE.
1. If the Sheriff's Sale is not stopped, your property will
be sold to the highest bidder. You may find out the price bid by
calling Martin and Kornfield at 717/762-3188.

2. You may be able to petition the Court to set aside the
sale if the bid price was grossly inadequate compared to the value
of your property.
3. The sale will go through only if the buyer pays the
Sheriff the full amount due in the sale. To find out if this has
happened you may call Martin and Kornfield at 717/762-3188.
4. If the amount due from the buyer is not paid to the
Sheriff, you will remain the owner of the property as if the sale
never happened.
5. You have a right to remain in the property until the full
amount due is paid to the Sheriff and the Sheriff gives a deed to
the buyer.
At that time, the buyer may bring legal proceedings to
evict you.
6. You may be entitled to a share of the money which was
paid for your house. A schedule of distribution of the money bid
for your house will be filed by the sheriff no later than October
7, 1994. This schedule will state who will be receiving the money.
The money will be paid out in accordance with this schedule unless
exceptions (reasons why the proposed distribution is wrong) are
filed with the Sheriff within ten (10) days after the date of
filing of said schedule.
7. You may also have other rights and defenses or ways of
getting your property back, if you act immediately after the sale.

PROPERTY DESCRIPTION
ALL that certain tract of land, with buildings erected thereon,
situate in Upper Mifflin Township, Cumberland County, Pennsylvania,
having a property address of RD 2, Box 98, Newville, Pennsylvania,
bounded and described as follows:
BEGINNING at a post, now a four inch wild cherry tree at corner of
lands now or formerly of Herbert Barrick and Cornelius Kuntz;
thence along lands of said Kuntz, South 63 degrees West 2,277 feet
to the middle of a public road, Legislative Route No. 21040; thence
along said center line of said highway North 20 degrees 30 minutes
West 107.25 feet to a point; thence along the center line of said
highway North 29 degrees 30 minutes West 313.5 feet to a point;
thence South 59 degrees 15 minutes West 407.55 feet to a post at
line of lands now or formerly of Merle Rolar; thence along lands of
said Rolar North 27 degrees West 1,158 feet to an iron pin at lands
of Pennsylvania Turnpike Commission; thence along lands of said
Pennsylvania Turnpike Commission North 87 degrees East 2,990 feet
to a point at lands now or formerly of Herbert Barrick; thence
along lands of said Barrick South 22 degrees 30 minutes East 529
feet to the place of beginning. CONTAINING 61.04 acres.
BEING the same real estate which Jesse G. Gephart and Margaret
Gephart, his wife, conveyed to Robert Greene and Haydee Greene by
deed dated October 12, 1973, and recorded in Cumberland County Deed
Book Volume J25, Page 719. It is suggested that Robert Greene died
on December 10, 1973, vesting full title in Haydee Greene.

AMENDED COMPLAINT
1. The plaintiff, Security Pacific Financial Services of pa,
Inc. of 98 North Main street, Chambersburg, pennsylvania, brings
this action to foreclose a mortgage dated May 19, 1989, between
Haydee Greene, Mortgagor, and Security Pacific Financial Services
of Pa, Inc., Mortgagee, which is recorded in Cumberland County
Mortgage Book Volume 939, Page 815, a copy of said mortgage
executed by Defendant is attached hereto and made a part hereof as
Exhibit "A".
2. The land subject to the mortgage is situate in Upper
Mifflin Township, Cumberland County, Pennsylvania, conveyed to
Defendant by deed of Jesse G. Gephart and Margaret Gephart, dated
October 12, 1973, and recorded in Cumberland county Deed Book
Volume J25, Page 719, a copy of which deed is attached hereto and
made a part hereof as Exhibit "B".
3. The mortgage has not been assigned.
4. Defendant is the real owner of the land subject to the
mortgage and her address is:
RD 2, Box 98
Newville, PA 17241
5. The mortgage is in default because Defendant has failed
to make payments upon the Mortgage. Notice of default was
delivered to Defendant by first class mail with proof of mailing
and certified mail dated March 28, 1994, and receipted on March 29,
1994, in the form of an Act 91 and Act VI Notices, copies of which
are attached hereto, made a part hereof and marked Exhibit "C".
6. The following amounts are due on the mortgage:

WHEREFORE, Plaintiff prays the court to enter judgment in
mortgage foreclosure.

The mortgage held by Security Pacific Financial Services, Inc.
on your property located at RD 2, Box 98, Newville, Cumberland
County, Pennsylvania, is in serious default because you have not
made monthly payments of $324.01 for the months of February 1991
through February 1994. Interest has also accrued to this date in
the amount of $10,744.61, The total amount now required to cure
this default, or in other words, get caught up in your payments, as
of the date of this letter, is $11,986.39.
You may cure this default within 30 days of the date of this
letter by paying Security Pacific the above amount of $11,986,39,
plus any additional monthly payments and interest which may fall
due during this period, as set forth below. Such payment must be
made either by cash, cashier's check, certified check or money
order, and made at the office of Security Pacific Financial

COmIT I - MORTGAGB FORBCLOSURB
1. The Plaintiff, Security Pacific Financial services of pa,
Inc. of 98 North Main Street, Chambersburg, Pennsylvania, brings
this action to foreclose a mortgage dated May 19, 1989, between
Haydee Greene, Mortgagor, and Security Pacific Financial Services
of pa, Inc., Mortgagee, which is recorded in Cumberland County
Mortgage Book Volume 939, page 815, a copy of said mortgage
executed by Defendant is attached hereto and made a part hereof as
Exhibit "A".
2. The land subject to the mortgage is situate in Upper
Mifflin Township, Cumberland county, Pennsylvania, conveyed to
Defendant by deed of Jesse G. Gephart and Margaret Gephart, dated
October 12, 1973, and recorded in Cumberland county Deed Book
Volume J25, Page 719, a copy of which deed is attached hereto and
made a part hereof as Exhibit "B".
3. The mortgage has not been assigned.
4. Defendant is the real owner of the land subject to the
mortgage and her address is:
RD 2, Box 98
Newville, PA 17241
5. The mortgage is in default because Defendant has failed
to make payments upon the Mortgage. Notice of default was
delivered to Defendant by first class mail with proof of mailing
and certified mail dated March 28, 1994, and receipted on March 29,
1994, in the form of an Act 91 and Act VI Notices, copies of which
are attached hereto, made a part hereof and marked Exhibit "C".
6. The following amounts are due on the mortgage:
a. Principal and interest
b. Attorney's fees per contract
Total
$33,402.72
5,010.40
$38,413.12
WHEREFORE, Plaintiff prays the court to enter judgment in
mortgage foreclosure.
COUNT II - ACTION UPON NOTZ
7. On May 19, 1989, Defendant executed a note to plaintiff,
a copy of which is attached hereto and made a part hereof as
Exhibit "0".
8. Under the terms of said note, Defendant is in default by
virtue of her failure to make payments pursuant to the said note
from and after January 1991.
9. No judgment has been taken upon the said note.
10. As a result of the said default, Defendant is indebted to
Plaintiff in the amount of $33,402.72 and, in addition, by virtue
of the said note, Plaintiff may charge Defendant a reasonable
attorney's fee of $5,010.40.
WHEREFORE, Plaintiff demands judgment against Defendant in the
amount of $33,402.72, together with $5,010.40 attorney's fees for
a total of $38,413.12, together with costs of the action and
interest at the contract rate.
And it will ever pray, etc.

The mortgage held by Security Pacific Financial Services, Inc.
on your property located at RD 2, Box 98, Newville, cumberland
County, Pennsylvania, is in serious default because you have not
made monthly payments of $324.01 for the months of February 1991
through February 1994. Interest has also accrued to this date in
the amount of $10,744.61. The total amount now required to cure
this default, or in other words, get caught up in your payments, as
of the date of this letter, is $11,986.39.
You may cure this default within 30 days of the date of this
letter by paying Security Pacific the above amount of $11,986.39,
plus any additional monthly payments and interest which may fall
due during this period, as set forth below. Such payment must be
made either by cash, cashier's check, certified check or money
order, and made at the office of Security Pacific Financial
Services, Inc.
If you do not cure this default within 30 days of the date of
this letter by paying Security Pacific the above amount of
$11,986.39, your monthly payment due on March 30, 1994, of $324.01,
will be added to the amount due to cure your account, and each
monthly payment thereafter until cured.
If you do not cure the default within 30 days, Security
Pacific intends to exercise their right to accelerate the mortgage
payments. This means that whatever is owing on the original amount
borrowed will be considered due immediately and you may lose the
chance to payoff the original mortgage in monthly installments.
If full payment of the amount of default is not made within 30
days, a lawsui t to foreclose your mortgaged property may be
started. If the mortgage is foreclosed your mortgaged property
will be sold by the Sheriff to payoff the mortgage debt. If your

However, if legal proceedings are started against you, you will

AVISO DE ATRASO DE PAGO E INTENTO DE EJECUCION DE HIPOTECA
La hipoteca con Security Pacific Financial Services, Inc.
sobre su propiedad ubicada en RD 2, Box 98, Newville, Cumberland
County, Pennsylvania, tiene un atraso de pago grave porque usted no
ha pagado los plazos mensuales de $324.01 durante el periodo de
febrero de 1991 a febrero de 1994. El interes tambien se ha
acumulado hasta esta fecha alcanzado la cantidad de $10,744.61. La
cantidad total que se necesita ahora para solucionar esta falta de
pago, 0 en otras palabras, actualizar sus pagos, es de $11.986,39,
en la fecha de esta carta.
Usted puede solucionar este atraso de pago dentro de 30 dias
de la fecha de esta carta pagando a security Pacific la cantidad
mencionada de $11.986,39 mas los pagos adici'Jnales y el interes
pagadero durante este periodo, como se establece mas abajo. Este
pago debe efectuarse en efectivo, cheque librado contra un banco,

Financial Services, Inc.
Si usted no soluciona este atraso de pago dentro de 30 dias a
partir de la fecha de esta carta pagando a Security Pacific la
cantidad mencionada de $11.986,39, su pago mensual que vence el 30
de marzo de 1994 de $324,01 se anadira a la cantidad pendiente de
su cuenta y cada pago mensual futuro hasta que se solucione la
deuda.
Si usted no soluciona este atraso de pago dentro de 30 dias,
Security Pacific tiene la intencion de ejercer su derecho para
acelerar los pagos de la hipoteca. Esto significa que la cantidad
original del prestamo se considerara pagadera inmediatamente y
usted puede perder la oportunidad de pagar su hipoteca original en
plazos mensuales. Si dentro de 30 dias no se ha recibido el pago
completo de la cantidad atrasada, se podria iniciar 'm juicio
hipotecario para ejecutar la hipoteca de su propiedad. Si se
ejecuta la hipoteca, el Sheriff (aquacil de policia) vendera su

caso se remite a un abogado, pero usted soluciona el atraso antes
de iniciar el proceso juridico contra usted, tendra que pagar los
honorarios del abogado, incurridos realmente, hasta un maximo de
$50,00. No obstante, si se ha iniciado el proceso juridico contra
usted, tendra que pagar los honorarios razonables del ahogado
incluso si sobrepasan la cantidad de $1.000,00. Cualquier
honorario del abogado en que se haya incurrido se anadira a la
cantidad que usted debe a security Pacific, que podria incluir
tambien nuestros costes razonables. si usted soluciona el atraso

Ademas, Security Pacific podria ponerle un pleito a usted

si usted no soluciona el atraso dentro del periodo de 30 dias
y se inicia el proceso de ejecucion de la hipoteca, usted todavia
tiene el derecho de solucionar el atraso y evitar la venta en

ejecucion de la hipoteca por parte del Sheriff. Usted puede
hacerlo pagando la cantidad total de los pagos mensuales pendientes

solucionar el atraso de pago, la cantidad aumentara. Usted puede

8481. El pago debe efectuarse en efectivo, cheque librado contra

Chambersburg, PA 17201. Usted debe tener en cuenta que la venta
por parte del Sheriff terminara su poses ion de la propiedad
hipotecada y su derecho de permanecer en ella. si despues de la
venta por parte del Sheriff, usted continua viviendo en la
propiedad, se podria iniciar un pleito para desalojarle.
Usted tiene derechos adicionales para proteger su interes en
