WHEREAS, RANDOLPH S. BAILEY AND LAUREL P. BAILEY, HIS WIFE (OWNERS)
entered into a contract with YINGST HOMES, INC. (CONTRACTOR) to
provide materials and perform labor necessary for construction
of a residential dwelling house upon a lot of ground located
and being known as Lot No. 7 on the Final Subdivision Plan (Phase
I) for Robert E. Diehl, Plan Book 46, page 53, Silver Spring
Township, Cumberland County, Pennsylvania.

MORE FULLY DESCRIBED IN LEGAL DESCRIPTION ATTACHED
NOW THEREFORE, it is hereby stipulated and agreed by and between
the said parties, as part of the said contract and for the
consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or material man, nor any other
person furnishing labor or materials to the said contractor
under this contract shall file a lien, commonly called a
mechanic's liens, for work done or materials furnished to the
said building or any part thereof.
This stipulation is made and intended to filed with the County
Prothonotary within ten days after date, in accordance with the
requirements of Act of Assembly of Pennsylvania, in such case
provided.

ALL THAT CERTAIN tract of land situate in Silver Spring Township, Cumberland
County, Pennsylvania, bounded and described according to the Final Subdivision
Plan (Phase Il for Robert E. Diehl prepared by Ernest J. Walker, P.E., dated
June 14, 1984 and recorded in Cumberland County Plan 800k 46, Psge 53 as
followe, to wit:
8EGINNING at an iron pin set on the right of way line of Nancy Lane at the
southwestern corner of Lot No. 6 as shown on the above-mentioned Plan of Lotsl
thence along said Lot No.6, South 79 degrees 11 minutes 31 seconds East
427.84 feet to an iron pin set; thence along same, South 03 degrees 39 minutss
50 seconds East 450.00 feet to an iron pin setl thence along Tract "C" and "0"
of the Plan of Margaret A. Grubb, South B6 degrees 20 minutes 10 eeconde West
500.00 feet to an iron pin set; thence along Lot No. 1 as set forth in
Cumberland County Plan Book 41, Page.i19. North 00 degrees 50 minutes 38
seconds East (erroneously referred to as North 00 degrees 58 minutes 30
seconds East on sheet 2 of 2 of the Walker Plan above referred to) 539.52 feet
to an iron pin setl thence along said Nancy Lane as set forth in Cumberland
County Plan Book 46, Page 53, on a line curving to the left having a radius of
50.00 feet an an arc distance of 49.32 feet to an iron pin set, the point and
Place of BEGINNING.
BEING Lot No. 7 on the Final Subdivision Plan (Phase I) for Robert E. Diehl
and. containing 5.590 acres.
BEING THE SAME PREMISES which Robert E. Diehl and Nancy C. Diehl, husband and
wife, by their deed dated October 1, 1991 and recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania on October 10,
1991 in Deed Book 35-I. page 769, granted and conveyed unto Randolph S. 8ailey
and Laurel P. Bailey.
