COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW, comes the Plaintiff, PNC Bank, National Association,
a national banking association, by their counsel, Tucker Arensberg,
P.C. and Donna M. Donaher, Esquire, and files this Complaint In
Mortgage Foreclosure, alleging as follows:
1. Plaintiff, PNC Bank, National Association ("PNCB")
successor by merger to CCNB Bank, N .A., is a national banking
association organized under the laws of the United States and a
citizen of the Commonwealth of Pennsylvania, with its main office
located at Fifth Avenue and Wood street, Pittsburgh, Pennsylvania
15222.
2. Defendants are Sonya H. Wagner a/k/a Sonya H. Oliveri and
Dominic James Oliveri whose residence address is 235 Bobcat Road,
Carlisle, Pennsylvania 17013.
3. On or about October 29, 1992 as security for payment of a
Note and Security Agreement ("Note") dated October 29, 1992,
Defendant Sonya H. Wagner a/k/a Sonya H. Oliveri executed and
delivered to Plaintiff a Mortgage in the principal amount of
$40,946.28 for the premises known as 235 Bobcat Road, Lower
Frankford Township, Cumberland County, Pennsylvania. True and
correct copies of the Note and Mortgage are attached hereto,
incorporated herein and labeled Exhibit "A" and Exhibit "B",
respectively.
4. Although Dominic James Oliveri is a party to the Note, he
did not execute the mortgage as title to the real property remains
solely in the name of Sonya H. Oliveri. Dominic James Oliveri has
been named as a party to this action simply for the purpose of

providinq notification that whatever interest he may have in the
property as the spouse of Sonya H. Oliveri will be terminated by
this action.
5. The Mortqaqe, Exhibit "B" hereto, was recorded in the
Office of the Recorder of Deeds of Cumberland County, Pennsylvania
on November 10, 1992, in Mortqaqe Book 1100, paqe 244.
6. The real property which is subject to the Mortqaqe,
Exhibit "B" hereto, is:
All that certain lot or piece of qround situate in Lower
Frankford Township, Cumberland County , Pennsylvania, beinq
known as 235 Bobcat Road, Carlisle, Pennsylvania 17013.
BEING identified as Assessment Map #14-04-0383-062.
BEING more particularly bounded and described in Deed Book Z,
Volume 35, paqe 482 as recorded in the Recorder's Office of
Cumberland County, Pennsylvania.
7. Defendant Sonya H. Oliveri is record owner of the
described mortqaqed premises.
8. Defendants have defaulted under the terms and conditions
of the Note and Mortqaqe, Exhibits "A" and "B" hereto, by failinq
to make periodic payments of principal and interest as required by
the Note and Mortqaqe, said failure to make payments has rendered
the obliqation due for May 10, 1993.
9. As of April 4, 1994, due to aforesaid default, the amount
due and owinq to Plaintiff is computed as follows:

$9.18 per diem.
10. The Notices of Homeowner's Emergency Mortgage Assistance
Act ("Act 91") required by 35 P.S. !iU680.401c, et seq., and the
Notices of Intention to Foreclose Mortgage required by section 403
of Act No. 6 of 1974, 41 P.S. !i403, were mailed certified mail,
return receipt requested, to Defendants on September 17, 1993.
True and correct copies of the Notices with proof of certified
mailing are attached hereto, incorporated herein and marked as
Exhibits "C", "0" and "E".
11. The Mortgage described above and attached hereto and
marked as Exhibit "B" has not been satisfied, released or assigned.
12. Under the terms of the Mortgage and the Note, Defendants
are liable to PNCB for attorneys fees for collection: to date of
the filing of this Complaint attorney's fees in the sum of $150.00
have been incurred by PNCB, Plaintiff does not waive its rights to
collect additional attorney's fees for services rendered after the
filing of this Complaint not to exceed the amount agreed upon in
the Mortgage and Note or as allowed by law.
WHEREFORE, Plaintiff demands judgment of foreclosure and sale
of the mortgaged property in the amount of $43,551.82, together
with interest thereon at the rate of $9.18, per day plus attorneys'
fees, costs, and costs of suit.

If the default is not cured within THIRTY (30) DAYS, we intend
to exercise our right to accelerate the mortgage payments. This
means that whatever is owing on the original amount borrowed will
be considered due immediately and you may lose the chance to pay
off the original mortgage in monthly installments.
If full paymen~ 0: the amount of default is no~ made
within THIRTY (30) DAYS, we also intend to instruc~ our attorneys
to s~art a lawsuit to foreclose the mortgaged property. If the
mortgage is foreclosed, the mortgaged property will be sold by the
