The claim was filed on May 10, 1994 in the Court of Common Pleas of Cumberland County, to the docket number set forth above. A copy of the claim is attached. Attorney for subcontractor . The nature and kind of materials furnished were lumber and building supplics which are more specificallY described in Exhibit "A". 7. The amount claimed to be still due and chargeable against the property ill $2,330.76, being the agreed upon contract prico. The Claimant has no note or other collateral necurity for his claim. B. The firnt mnterialn were furnished by the Claimant on December 24, 1993, and the 1aBt materials were furnished on January 10, 1994, which latter date in less than four months before the filing of this claim. 9. Written notice of the intention to file this claim was duly seryed upon the owner on April B, 1994 by certified and regular mail, postage pre-paid and addressed to their residence at 212 Clark street, Lemoyne, Pennsylvania 17043. 10. HAFFEY and HENRIETTA M. HAFFEY, his wife, Owners. MECHANICS LIEN. PRELIMINARY OBJECTIONS OF OWNERS, PATRICK R. HAFFEY and HENRIETTA M. HAFFEY, his wife, TO THE FILING OF THE MECHANICS' LIEN CLAIM OF CLAHlANT, EARL LATSHA LUMBER COMPANY. AND NOW, comes Owners, Patrick R. Haffey and Henrietta M. Haffey, his wife, by their Attorney, Karl M. Ledebohm, Esquire, and makes their preliminary objection pursuant to 49 P.B. 1505 to strike off the Mechanics' Lien Claim of Claimant, Et'rl Latsha Lumber Company, and in support avers the followingl 1. Claimants Mechanics' Lien Claim, a copy of which is attached and incorporated by reference as Exhibit "A", was filed on May 11, 1994 against Owners' property situate at 212 Clark Street, Lemoyne, Cumberland County, Pennsylvania, 17043. 2. Claimant claims a lien in the amount of $2,330.76 for materials furnished in connection with the erection and construction of a detached three car garage on the said premises pursuant to an oral contract entered into on December 24, 1993 with Hearthstone Remodeling, the prime contractor with Owners. 3. The prime contract between Owner and Hearthstone Remodeling, a copy of which is attached hereto and incorporated by reference as Exhibit "B", was entered into on August 24, 1993, and provided for the construction of a three car garage and macadam driveway on the hereinbefore mentioned premises. 4. Claimant made final delivery to the said construction site on January 10, 1994, thereby completing its work under Claimants contract with Hearthstone Remodeling as set forth in paragraph 0 of Claimant's Mechanics' Lien Claim. 5. Claimants, by its own admission in paragraph 9 of Claimants Mechanics' Lien Claim a copy of which is attached as Exhibit "A", did not give Owners preliminary notice of its intention to file a Mechanics' Lien Claim until April 0, 1994, a copy of which is attached as Exhibit "C". 6. HAFFEY, his wife, OWners CLAIMANT'S BRIEF IN OPPOSITION TO OWNERS' PRELIMINARY OBJECTIONS I. FACTUAL AND PROCEDURAL HISTORY Claimant, Earl Latsha Lumber Company ("Latsha") entered into an oral contract with Hearthstone Remodeling to provide materials to be utilized on a construction site located at 212 Clark street, Lemoyne, pennsylvania 17043. The owners of the property at 212 Clark Street, Patrick R. Haffey and Henrietta M. Haffey ("Owners") had contl'acted with Hearthstone Remodeling for the construction of a twenty-four (24) feet by thirty-six (36) feet triple car garage, including second story storage, as well as the construction of a twenty-five (251 feet by thirty-six (361 feet driveway area. (See, Exhibit B attached to Owner's Preliminary Objectionsl. The construction was to take place in the area at the rear of the existing building. Latsha delivered a snbstantial amount of material to ~ the construction site on a nwnber of occasions, including December 24, 1993, January 5, 1994, and January 10, 1994. No claim has been made by the owners that the material, giving rise to Latsha's $2,330.76 claim, was not utilized in the construction project performed on their property. On April B, 1994, Latsha provided the owners with PRELIMINARY NOTICE OF INTENTION TO FILE A MECHANIC'S LIEN CLAIM AGAINST YOUR PROPERTY and NOTICE OF INTENTION TO FILE A MECHANIC'S LIEN CLAIM AGAINST YOUR PROPERTY. Copies of both doclments are in Owners' posession and are attached to their Preliminary Objections as Exhibits A and C. Latsha filed a Mechanic's Lien claim claiming $2,330.76 on May 11, 1994. The Owners filed Preliminary Objections to Latsha's Mechanic's Lien claim on Jllne 3, 1994. Latsha has filed an Answer to the Owners' Preliminary Objections and the present Brief in opposition to Owners' Preliminary Objections. II. ISSUE PRESENTED 1. WHETHER OWNERS' PRELIMINARY OBJECTIONS TO LATSHA'S MECHANIC'S LIEN CLAIM SHOULD BE DISMISSED SINCE OWNERS DO NOT STATE A SUFFICIEN~ BASIS FOR THIS COURT TO GRANT SAID PRELIMINARY OBJECTIONS TO THE PRESENT MECHANIC'S LIEN CLAIM? (Suggested answer in the affirmative). III. ARGUMENT 2. OWNERS' PRELIMINARY OBJECTIONS TO LATSHA' S MECHANIC'S LIEN CLAIM SHOULD BE DISMISSED SINCE OWNERS DO NOT STATE A SUFFICIENT BASIS FOR THIS COURT TO GRANT SAID PRELIMINARY OBJECTIONS TO THE PRESENT MECHANIC ' S LIEN CLAIM. In ruling on Owners' Preliminary Objections, it should be noted thatl It is also clear that when the sllstaining of preliminary objections will result in a denial of claim or a dismissal of suit, preliminary objections in a mechanic's lien proceeding should be sustained only in cases which are clear and free from doubt. Castle Pre-Cast v. Strauss-Hammer, 416 Pa. Super. 53, 610 A.2d 503, 504 (1992) (Citation omitted). - 2 - In the present case, the Owners' argument, as set forth in their Brief, is premised upon the fact that the triple car garage constitutes an "alteration and repair" and therefore, since a Preliminary Notice of Intention to File a Mechanic's Lien Claim was not provided on or before the last date that Latsha delivered material to the job site, the Mechanic's Lien claim is barred. However, since the construction of the triple car garage constitutes "construction and erection" within the meeting of the Mechanic's Lien Act, 49 Pa. C.S.A. Section 1201, Owners' Preliminary Objections must fail. In determining whether the new building constitutes cnstr\lction and erection, Latsha points to the contract documents attached by the Owners to their Preliminary Objections (as Exhibit B). The Owners do not dispute any of the information contained therein and in fact, utilize facts from said contract documents in their Brief in Support of preliminary Objections. The contract indicates that a 24 feet by 36 feet triple car garage was to be built on a new foundation along with a 25 feet by 36 feet driveway, in the area to the rear of the existing building. The garage was to be constructed with a side entrance door, four double hung windows, electrical service, ten lighting fixtures and nine electrical outlets. The building was also to be covered with white vinyl siding to match the existing building at 212 Clark Street with any exposed block to be painted white. In addition, the garage was to provide second story storage. 2!!, Exhibit B attached to Owners' Preliminary Objections. - 3 - Given the above facts, Latsha believes the Superior Court's decision in Anastasi v. Burnet, 171 Pa. Super. 464, 90 A.2d 636 (1952), is instructive in the present: matter. In Anastasi, the defendants Burnet and his wife contracted for the erection of a building adjoining a dwelling house. The plaintiffs were subcontractors who supplied cement block and brick work. The subcontractors completed their work on February 27, 1950 and on May 22, 1950 served defendants with Notice of Intention to File a Lien. As noted by the Superior Court in Anastasi, "the controlling question is whether the subject of the general contract was an alteration to the existing dwelling on the premises, or a new construction within the comtemplation of the Mechanic's Lien Law." ~, Anastasi at ___, 90 A.2d at 636. In holding that the new structure constituted "construction and erection", the Court pointed out that although the new structure was physically connected with the dwelling house with a doorway, the dwelling was a complete unit in and of itself and the new work WIIS in no sense a repair or alteration of the existing residence building. Id. The Court further found that the new structure was bl\il t to provide the defendant, Dr. Burnet with quarters for his practice as a dentist. !.!!. The Superior Court further found that: In the present case the old building did not absorb the new structure. On the contrary, the new wing was built on new ground and was a new structure which no one could possible mistake for a repair or 81 teration of the old. Anastasi at ---' 90 A.2d at 637. - 4 - As in Anastasi, the new building located at 212 Clark Street constitute~ a "new structure" which no one could possibly miytake for a repair or alteration of the old. In addition, the lIew building is in no sense a repair or al teration of the existing building. In support of its argllntent that the construction of the three car garage supports a finding of "alteration and repair", the Owners rely heavily upon Zavislak v. Golumbeski, 65 Luzerne Legal Register 87 (1974) . However, Zavislak is clearly distinguishable from the facts of the present case and does not alter the finding, based upon Anastasi, that the new building constitutes "erection and construction." In Zavislak, a one story extension was attached to an existing two story dwelling. Pursuant to the contract, the contractor was to lay a crawl space foundation, rough frame the addition, install a roof, as well as a number of windows and a door. The contractor was not obligated to finish the exterior or the interior of the addition, install any wiring or plumbing. Furthermore, the contractor was not obligated to install an}' insulation. In its Opinion, the Luzerne County Court found the addition to the home to constitute "al teration and repair". In doing so, the Court noted that the addition was an unfinished, one story shell room attached to a two story dwelling house with no "finishing", plumbing, electric or insulation. ~, Zavislak at 91. In the present case, the contract provided for the construction of a three story garage on a foundation with second story storage. In addition, the garage was sided to match the existing building at 212 Clark Street and was furnished with - 5 - electrical service. Accordingly, Latsha submits that the Luzsrne County Court's decision in Zavis1ak is not controlling in the present case. A one story unfinished addition to an existing home is not the equivalent of a three car garage and driveway erected to the rear of an existing building. Therefore, Latsha submits that the present construction qualifies as "erection and construction" within the meaning of the Mechanic's Lien Act, obviating the need to file a Preliminary Notice prior to the completion of a subcontractor's work. IV. CONCLUSION For the foregoing reasons, the Owner's Preliminary Objections to the Mechanic I s Lien claim filed by Earl Latsha Lumber Company should be dismissed. Since the construction of the three story garage constitutes "erection and construction" under the Mechanic's Lien Act, no Preliminary Notice prior to the completion of Latsha's work was required. II STATEMENT OF FACTS Owners, Patrick and Henrietta Haffey, on August 24, 1993, contracted with Hearthstone Remodeling for the addition of a 24 feet by 30 feet triple car garage to be built on the premiseB of their residence located at 212 Clark Street, Lemoyne, Pennsylvania, 17043. (Owners Preliminary Objection Paragraph 2). Claimant, Earl Latsha Lumber Company, delivered material to the construction Bite pursuant to an oral contract with Hearthstone Remodeling. (Claimants Mechanics Lien Claim Paragraph 4 I 5.). Pursuant to Claimant I s claim, final delivery of materials to the construction site occurred on January 10, 1994.(Claimants Mechanics Lien Claim Paragraph 8). Claimant failed to serve the Haffeys with preliminary notice of intention to file a Mechanic's Claim on or before January 10, 1994, the date of final completion of Claimant's work, but rather, only Berved Mr. and Mrs. Haffey with notice of intention to file a Mechanic's Lien Claim on April 0, 1994. (Claimants Mechanics Lien Claim Paragraph 9). III ISSUES 1. Whether the addition of a garage to Owner I B existing reBidence constitutes "erection and construction" or "alteration and repair" purBuant section 1201 (10) and (11) of the "Mechanics' Lien Law of 1963"and itB amendmentB. 2. IV ARGUMENT CLAIMANT' S MECHANICS I LIEN CLAIM IS MADE IN CONNECTION TO AN "ALTERATION AND REPAIR" AND MUST THEREFORE BE STRICKEN FOR CLAIMANT' S FAILURE TO SERVE OWNER WITH PRELIMINARY NOTICE OF INTENTION TO FILE SAID CLAIM ON OR BEFORE JANUARY 10. 1994. THE DATE OF THE COMPLETION OF CLAIMANT'S WORK. Section 1501 (a) and (b) of the "Mechanics' Lien Law of 1963" sets forth the notice requirements necessary to perfect a mechanics' lien claim. Where an addition falls within the meaning of "erection and construction" pursuant to 49 Pa. C.S.A. 1201 (10), the claimant for a mechanic's lien need only give the owner of the property two notices: "( 1) formal notice of intention to file a claim, and (2) written notice of having filed the claim within one month of filing same." Bernard Zavislak vs. Frank Golumbeski,65 Luz. L. Reg. 87,89-90 (1974), However, where an addition constitutes an "alteration and repair", 49 Pa. C.S,A. 1201 (11), the claimant must, in addition to the above, give to the owner preliminary notice of intention to file a claim for a mechanic's lien on or before the date of completion of his work in order to perfect his mechanic's lien claim. Zavislak vs. Golumbeski, supra., at 90. Where, as here, Claimant files a claim based upon an "alteration and repair" and fails to give preliminary notice of his intent to file the claim on or before the date of completion of his work, the mechanic's lien must be stricken. Id. Since, Claimant's claim is based upon a subcontract for the delivery of construction materials, Claimant's work was complete as of January 10, 1994, the date of final delivery. J.W. Dillard & CompanY, Inc. v, Pocono Airlines, Ind.. 64 Luzern Leg. R. 225, 227-228 (1974). In order to determine whether the instant addition qualifies as an "erection and construction" or an "alteration and repair," this honorable court must determine whether the addition is substantial enough in its own right to be considered new construction, and whether the addition creates a significant change in use or appearance of the existing structure. Zavislak vs. Golumbeski, supra. at 90-91. The overlapping basis of the above two tests centers upon whether the addition in question materially changed the use and appearance of the original structure and the 2 extent and size of the improvement comparative to the original structure. The Court in Zavislak, supra., in striking off claimant's mechanics' lien claim, rejected the contention that a 24' X 24',one story extension built from the foundation up onto an existing 30' X 60' , two story dwelling constituted an "erection and construction" within the meaning of the mechanics' lien statute. Although the addition before the court in Zavislak, supra., was an unfinished shell, without electric or plumbing, the Court specifically found that the addition did not create a new building use nor did it "so entirely change(s) the external appearance of the old building that it should be treated as new construction." rg. at 92. The Zavislak,supra., Court observed that, "In virtually all of the cases holding that new construction occurred, the addition was at least as large as the existing building." IQ... similarly, the addition in the instant case was contracted by Owners to be built from the foundation up. As was the case of Zavislak, supra., the addition of the 24' by 30' garage to Owners original residence in the instant case, cannot be found to significantly and materially change the appearance or the use of the original residence. A garage is incidental to any residence and the addition or absence of same from a residence cannot be said to alter the character of a structure as a residence. F olcts concerning the dimensions of the original residence as apposed to the addition of the garage in the instant case, are not before the Court as of the filing of this brief but may be ascertained through deposition or other additional discovery. The instant case is distinguished from that before the Court in Anastasi vs. Brunet, 171 Pa. superior Ct. 464 (1952), There the Court found that an addition to a residence which nearly tripled the size of the original structure constituted a "construction and erection" and not an "alteration and repair" for the purposes of determining the validity of a mechanics' lien. Not only did the Court in Anastasi, supra., emphasize the large size of the addition compared to the original residence, the Court highlighted that the addition was not intended to be used as part of the original residence or even as an extension of the original residential purpose, but was built and designed to function as a dentist office complete with an operating room, dark room, reception room, single car garage, and lavatory. xg, at 466. The material change in the use of the original structure from a family dwelling to a commercial dentist office was accentuated by the fact that the addition and the original residence fronted on two different streets and were serviced by two separate walkways and driveways. Id, at 466. Thus, due to the large extent of the addition and the fact that it's use was materially different from that of the original structure, the Court found that the construction of the addition went beyond an "alteration and repair" and qualified as an "erection and construction." The addition of the garage in the instant case does not change the use of the original structure as a residence, but to the contrary, merely augments its use as a residence by providing 3 additional storage space. Since the addition of the instant garage does not change the use of the original residence owned by Mr, and Mrs Haffey, but merely augments the original structure's use as a residence, the addition does not rise to the level of an "erection and construction" but, rather, falls squarely within the definition of al. "alteration and repair" pursuant to the Mechanic's lien law of 1963 and its amendments. As such, Claimant was required to serve Owner's with preliminary notice of its int~ntion to file a mechanics lien claim pursuant to 49 Pa. C.S.A. section 1501 (a) on or before the date of complet ion of Claimant's work. Since Claimant failed to provide Mr. and Mrs. Haffey with the said preliminary notice on or before January 10, 1994, the date of the completion of Claimants work, (Claimant's Mechanics' Lien Claim Paragraph 8) Claimants Mechanics' Lien must be stricken. II CLAIMANT I S MECHANICS I LIEN MUST BE STRICKEN DUE TO CLAIMANT '5 ~:~L~:: TO SPECIFICALLY ALLEGE IN CLAIMANT'S MECHANICS LIEN CLAIM ES UPON WHICH CLAIMANT SERVED OWNER WITH PRELIMINARY NOTICE or HIS INTENTION TO FILE THE CLAIM. It is well established that strict compliance with the mechanics' lien law is necessary to effect a valid claim. Flick Const..Inc. vs, Dvke, 584 A.2d 1033, 401 Pa. Super. 168, (1991). "The right to a mechanic's lien is purely a creature of statute and it is only available if the conditions of the legislature are strictly followed." J.W. Dillard & Company, Inc. vs. Pocono Airlines, Inc. , et, al., 64 Luzerne Legal Register 225, 226 (1974), citino, Brann & Stewart Co. vs, Consolidat~~ Sun Rav. Inc., 433 Pa. 574,577(1969), U.S, Cert. Denied 396 U.S. 840 (1969). Where "the sustaining of preliminary objections will result in a denial of the claim or dismissal of suit, preliminary objections in a Mechanics Lien proceeding should be sustained only in cases which are free from doubt." Castle Pre-Cast Superior Walls of Delaware, Inc. v. Strauss Hammer, 610 A.2d 503,504 (1992), citino, Chambers v, Todd Steel picklino, Inc.. 323 Pa. super 119, 470 A.2d 159 (1983). Section 1503 of the "Mechanics' Lien Law of 1963" clearly sets forth the specific requirements which must be stated in a mechanics' lien claim. Section 1503 (4) specifically provides that the claim shall state, "if filed by a subcontractor, the name of the person with whom he contracted and the dates on which preliminary notice, if required, and of formal notice of intention to file a claim was given." (Emphasis added.) 49 Pa. C, S. A. Section 1503 (4), Claimant alleges in its Mechanics' lien claim that it furnished materials to Owners' residence pursuant to an oral contract with Hearthstone Remodeling, the general contractor employed by owners (Claimant's Mechanics' Lien Claim Paragraph 4, 5). Claimant's "Mechanics' Lien Claim" at paragraph 4 and 5, ThUS, Claimant is a subcontractor wi thin \:he meaning of 49 pa C, S. A. 4 section 1201 (5). As such, having established that the addition in question is an "alteration and repair" pursuant to 49 Pa. C.S.A. 1501 (a), Claimant's failure to specifically allege the date upon which preliminary notice was given to owner in Claimants Mechanics I Lien Claim renders said claim defective. It is specifically denied that Claimant's Mechanic's Lien Claim is barred since Claimant failed to give Owners preliminary written notice of its intention to file a Mechanic's Lien on or before January 10, 1994, the date of completion of Claimants work, as required by 51501 (a) of the Mechanic's Lien Lawl 49 P.S. 51501 (a). To the contrary, said provision is not applicable to the facts and circumstances of the present case. By way of further answer, in cases of construction and erection, it is unnecessary to file said "preliminary written notice" prior to the completion of the subcontractor's work. 7. Denied. OPINION AND ORDER OF COURT Here we are asked to decide whether the plaintiff'S mechanic's lien claim should be stricken for plaintiff'S failure to serve defendants with preliminary notice of intention to file the claim. DISCUSSION Defendants filed preliminary objections to plaintiff'S mechanic's lien claim in the form of a demurrer. The question presented by the demurrer is whether, on the facts averred, the law says with certainty that no recovery is possible. A demurrer should be sustained only in cases where the plaintiff has clearly failed to state a claim on which relief can be granted. Eckell v. wilson, 409 Pa. Super. 132, 597 A.2d 696 (1991). "All material facts set forth in ths complaint, as well as all inferences reasonably deducible therefrom, are admitted as true for purposes of review." l'ittsburqh National Bank v. perr, 431 Pa.Super. 580, 584, 637 A.2d 334, 336 (1994). In the instant case, defendants contracted with Hearthstons Remodeling for the addition of a twenty-four feet by thirty-four NO. 94-2512 - MLD feet triple car garage. Plaintiff delivered material to the construction site pursuant to an oral contract with Hearthstone Remodeling, final delivery occurring on January 10, 1994. Plaintiff then served defendants with notice of intention to file a mechanic's lien claim on April B, 1994. Defendants ask that the mechanic's lien claim be stricken for plaintiff's failure to serve preliminary notice of intention to file the claim on or before the date of the completion of the work on January 10, 1994. The type of notice that plaintiff needed to give defendants turns upon the court's categorization of a three car garage as either "erection and construction" or "alteration and repair." Plaintiff avers that the construction of a twenty-four feet by thirty-six feet garage constitutes "construction and erection." If true, plaintiff need only have given defendants two notices for perfection of the mechanic's lien claim to have occurredl I) formal notice of intention to file a claim, and 2) written notice of having filed the claim within one month of filing same. ~ 49 Pa. C.S.A. 51501 (b). If the garage constitutes "alteration or repair" as defendants contend, plaintiff should have also given preliminary notice of intention to file a claim for a mechanic's lien on or before January 10, 1994, the date of completion of plaintiff's work. See 49 Pa. C.S.A. 51501 (a). We find the issue to be clearly resolved by the definitions set forth in the Mechanics' Lien Law of 19631 2 NO. 94-2512 - MLD only arises when the issue concerns whether an addition to the existing structure itself is a substantial addition. Logically, there is no issue of categorization when a triple car garage has been constructed separately from the home. The defendants, then, have mistakenly relied upon Zaviglak v. Golumbesk~, 65 Luz. L. Reg. 87 (1984). In Zavislak, the court developed two tests to determine whether an addition to a dwelling house itself constituted a "substantial addition." In the present case, no such issue exists. Lastly, we note that defendant did not speak to the issue of whether the mechanic's lien claim was defective because it did not specifically state on its face to which category the garage belongs. See Morrison v. Henderson, 126 Pa. 216, 220 (1889); Wharton v. Real Estate Investment Comoanv, 180 Pa. 168, 176 (1897). Thus, we find that since the garage in question constitutes "erection and construction" as defined by the law, plaintiff gave proper notice to defendants.
