AND HOM this 1\ day of May, 1994, having reviewed the
within PETITION OF THE CUMBERLAND COUNTY BOARD OF ELECTIONS TO
OPEN BALLOT TRANSPORT CARRIER, it is ordered and directed that
the County Board of Elections open the ballot transport carrier
for West Fairview Borough.
It is further ordered that this Order shall be executed as
soon as possible by the Director of Elections and a
representative of each political party under the same
circumstances and procedures as the transport carrier was opened,
the votes counted, and

TO OPIN BALLOT TRANSPORT CURIIR
AND NOM comes the Cumberland County Board of Elections, by
and through its Assistant Solicitor, Stephen D. Tiley, Esquire,
and respectfully represents the following:

On May 10, 1994, the Primary Election was held in the County
of Cumberland.

As prescribed in 25 PS 3031.13(g), the Judge of Election of
West Fairview Borough prepared a report of the number of voters
who voted as indicated by the "Voting Check List" along with a
report of the number of spoiled and unused ballots. Said
original report was delivered in accordance with Section
3031.13(g) to the Board of Elections at the close of the polls.
Said report reflected that 67 registered Democrats voted.

The Judge of Elections and Minority Inspector of West
Fairview Borough in accordance with Section 3031.13(g) delivered
the sealed transport carrier containing all voted ballots to the
designated central tabulation center, 37 W. nigh Street,
Carlisle, PA 17013.

During the computation of votes in accordance with Section
3031.14(b) (1) cast in West Fairview Borough at the central
tabulation center, only one Democratic vote was recorded.

A comparison of the report of the number of voters provided
for West Fairview Borough with the number of Democratic votes
recorded revealed a discrepancy of 66 Democratic votes.

The law requires the Board of Elections to reflect an
accurate computation of votes cast. Therefore, the Board of
Elections feels a recheck of the transport carrier delivered to
the central tabulation center should be reopened in an attempt to
reconcile the discrepancy.
WBlRlrORl, the Cumberland County Board of Elections
respectfully requests the Court to authorize the opening of the
transport carrier containing the ballots from West Fairview
Borough for the purpose of obtaining an accurate computation of
the votes cast. Said Order shall also require the Board of
Elections to resecure the transport carrier as required by law.
