referred to as Larry), and makes the follCMing aweal fmn the judgaoont
rendered by the District Justice Glenn R. Farner.
1. Larry resides at 3602 Kent Drive, Mechanicsburg, ClJnberland County,
Pennsylvania 17055.
2. The Defendant is EileP.n Braxton (hereinafter referred to as
Defendant) resides at 1509 Hilton Street, A~nt 101, Norfolk,
Virginia 23518. Defendant is represented by her attorney
JaMeS 1\, Johnson of Jolmson, Duffie, Stewart and Weidner, 301 Market
Street, Iaroyne, Pennsylvania 17043.
3. Larty was infol1red by Proff!ssional1\bstract, Incorporated, his
settlement agency, on December 21, 1993, that a judgement was held
against his resident property and refinancing of the ITDrtgage on the
property could not close on DecembP.r 23, 1993, unless the judgement was
clearod. Larty had no prior knowledge of tJle judgenent.
4. T..arry is elTq:Jloyod by tJle State Correcticmal Institution at CIlITp Hill
nnd \'/as scheduled to work overtirre fIU11 8 o'clnck JIM to 4 o'clOCk m on
December 22, 1994. Consequently, his overtOO had to be cancelled in
order to investigate and clear the subjp.ct judgC!OOnt. IDss of $182.24
in wageb resulted. 1\ mm and correct copy of a wage loss
stateroont is marked as Exhibit "1\".
5. 1\t the ClDrberllUld CO\mty Prothonotary Office, Larry found a
judgerent had been entered on DeccniJer 11, 1989, against the Defendant
by Sears, l\:>cbuck and Corrpany for $836.30, plus court costs of $62.50
(total $898.801. 1\ true and correct copy if! marked as Exhibit "B".
6. Defendant's residence was at 11 Werden Drive, Camp lIill,
Pennsylvania when Sears attenpted to collect mllP.Y o.-ied, and, at the
t:lrre a c:anplaint was filed with District Justice Fobert Manlovp. upon the
Defendantl she did not ar:pP.ar at tho Novarber 3, 1989, hearing. 1\ true
and correct ropy is marked as Exhibit "C".
7. Larry and Defendant separated as husband and wife on June 4, 1988,
and Defendant departerl the residency at 3602 Kent Drive, Mechanicsburg,
Pennsylvania also on thif! date, Larry was the Plaintiff in the divorce
action. Decree in Divorce was ordered January 9, 1989, however, an
order of court in equitable distribution of property was not rendered
until November 9, 1992 and later upheld by the Superior Court on
Septanber 17, 1993. 1\11 prqJerty marital and non-marita1, was addressed
by the Honorable Judge Hoffer. 1\ true and correct copy is J11iII'ked
Exhibit "D".
B, On Decanher 22, 1993, Larry, under duress, paid Sears, Foebuck and
CallJany $B9B.BO on behalf of Defendant. '1lIis payrrent now made it
possible for Larry to refinance his property on December 23, 1993. A
true and correct copy is J1lI\rk~ Exhibit "E".
9. In order for Larry to satisfy the entire judgerrent a cash advance on
his credit card was r~ired at an interest rate of 19,BOO%1 he coold
not afford to pay any mre than an extra $25.00 per mnth. Larry
charges Defendant 19.BOO% interest at $25.00 per mnth nn $B9B,BO for a
