Dear Mr. Rozman and Mr. Alandar:
By order of Court of President Judge Harold E. Sheely
dated November 4, 1994, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on May 13, 1994, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the divorce complaint.
The complaint averred that the parties have been
separated in excess of two years; however, no affidavit under
section 3301(d) has been filed. Therefore, I assume that the
parties will agree to execute and file affidavits of consent so
that the divorce can be concluded under Section 3301(c) of the
Domestic Relations Code.
Absent any issues regarding grounds for divorce and the
raising of any economic claims, I am uncertain as to why I was
appointed in the proceedings. However, before returning the
file to the Court requesting that my appointment be vacated, I
will give counsel and Mr. Alandar a period of ten (10) days to
contact my office and file any appropriate pleadings they wish
to file raising economic issues.
The motion for appointment of Master indicates that
perhaps attorney Robert Radebach is going to be representing
