STIPULATION AGAINST MECHANICS' LIENS
WHEREAS, Yellow Breeches Family Practice, of 1358 Lutztown
Road, Boiling Springs, Cumberland County, Pennsylvania entered into
a contract with East Coast Contracting, Inc., of 64 Creek Road,
Dillsburg, York County, Pennsylvania, to provide materials and
perform labor necessary for making alterations and adding an
addition to the existing Yellow Breeches Family Practice Center
that is situated at 1358 Lutztown Road, Boiling Springs, Monroe
Township, Cumberland County, Pennsylvania, more specifically
described as follows, to wit:
Tract 1:
All That Certain tract of land situate in the Township of Monroe,
County of Cumberland and Commonwealth of Pennsylvania, more
particularly bounded and described according to a survey by Stephen
G. Fisher, R.S., dated April 19, 1979, as follows:
BEGINNING at a nail in the center of Legislative Route, L.R. 21029,
at corner of land now or formerly of Lee R. Sunday; thence by said
land now or formerly of Lee R. Sunday, North 27 degrees 11 minutes
30 seconds East 314.46 feet to a pipe; thence by land now or
formerly of Blain L. Wickard, South 50 degrees East 572.65 feet to
a nail in said LegiSlative Route, L.R. 21029; thence through said
Legislative Route, L.R. 21029, North 83 degrees 15 minutes West
409.73 feet to a point; thence continuing through said Legislative
Route 21029, by a curve to the right having a radius of 838.89
feet, a distance of 180.33 feet to a nail, the place of BEGINNING.
CONTAINING 2,119 acres and having thereon erected a one-story brick
building.
Tract 2:
ALL that certain tract of land situate in Monroe Township,
Cumberland County, Pennsylvania, more fully bounded and described
as follows:
BEGINNING at a parker kalon nail located in the centerline of
Lutztown Road, SR 2006, said property corner being the common
corner of lands now or formerly of Blain L. Wickard and Donald J.
Kovacs as shown on the Final Minor Subdivision Plan - Blain L,
WiCkard, recorded in Plan Book 67, Page 58, in the Recorder of
Deeds Office of the County of Cumberland, Commonwealth of
Pennsylvania; thence along lands now or formerly of Donald J.
Kovacs, North 50 degrees 00 minutes 00 seconds West, a distance of
572.65 feet to an iron pipe located on the property line of lands
now or formerly of Lee R. Sunday; thence along lands now or
formerly of Lee R. Sunday, North 27 degrees 11 minutes 30 seconds
East, a distance of 59,09 feet to an iron pin located on the
property line of the residual lands of Blain L. WiCkard, Lot No. 1
from which Parcel "A" was subdivided; thence along the residual

lands of Blain L. Wickard, Lot No.1, South 50 degrees 00 minutes
00 seconds East, a distance of 547.97 feet to an iron pin; thence
continuing along the same, South 06 degrees 45 minutes 00 seconds
West, a distance of 68.90 feet to the point of BEGINNING.
BEING the same tract of land which Blain L. Wickard and Dorothy R.
Wickard, his wife, by deed dated December 29, 1993 and about to be
recorded immediately prior hereto in the Office of the Recorder of
Deeds, in and for Cumberland county, Pennsylvania granted and
conveyed unto Yellow Breeches Family Practice Center, a
pennsylvania General Partnership.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties as part of the said contract and for the
consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or material man, nor any other
person furnishing labor or materials to the said contractor under
this contract shall file a lien, commonly called a mechanics' lien
for work done or materials furnished to the said building or any
part thereof.
This stipulation is made and intended to be filed with the
County prothonotary within ten days after date, in accordance with
the requirements of Act of Assembly of Pennsylvania, in such case
provided.
