COMPLAINT
1. Plaintiff is Jill Mallard. an adult individual now living
at 8 Bryant Road. Bourne. Massachusetts 02532.
2. Defendant is Jenny S. Withers, an adult individual residing
at 350 Cooper Church Road. Leesville. Louisianna 71446.
3. On or about May 19, 1992. Plaintiff Mallard was driving a
vehicle westward on Carlisle Road approaching the intersection with
Cedar Cliff Drive in Lower Allen Township, Cumberland County, PA.
4. As she approached the traffic signal at the intersection of
Carlisle Road and Cedar Cliff Drive (which was red) Plaintiff Mallard
slowed her vehicle to a stop.
5. Approaching Mallard from the east in her vehicle. Defendant
Withers did not slow down and, in fact, collided into the rear of the
Mallard vehicle.
6. The collision between the front of the Withers vehicle and
the rear of the Mallard vehicle caused considerable injury to Mrs.
Mallard. including back injuries which limit her mobility and have
caused chronic pain since the incident.
7. Defendant Withers was cited for and is guilty of careless
driving. 75 Pa.C.S. ~3714 for her failure to control her vehicle
adequately so as to stop before colliding with the Mallard vehicle.
8. The accident and resultant injuries at issue were caused by
the negligence. carelessness and other failures of Defendant Withers.
WHEREFORE. Plaintiff Mallard respectfulY requests judgment be
granted in her favor against Defendant Withers in an amount in excess
of $20.000.
