COMPLAINT
1. The Plaintiff, PNC Bank, National Association, hereinafter sometimes called "Mortgagee" is a national
banking business association with an office for the conduct of its business at 4242 Carlisle Pike. Camp Hill,
Pennsylvania 17011. The Plaintiff is successor by merger to CCNB Bank, N,A,
2, The Defendant, Clair R, Zimmerman, is an adult individual residing at 2008 Susquehanna Street,
Harrisburg, Dauphin County, Pennsylvania 17101,
3. At all times material to the Plaintiffs cause of action, the Mortgagor. Clair R, Zimmerman, has been
the owner of a tract of land and the buildings thereon hereinafter called "land" located at 808 Carol Circle, New
Cumberland Borough, Cumberland County, Pennsylvania 17070,
4. The land is described in Exhibit" A" attached hereto and made a part hereof by reference,
5. On May 22, 1989, in consideration of the loan of $27,000.00 made by the Mortgagee to the
Mortgagor. Clair R. Zimmerman and Lee Zimmerman, his wife, the said Mortgagor and his wife executed and
delivered to the Mortgagee a Note obligating them to pay the principal sum with interest at 12.5% per annum in bi-
weekly installments of $147,20 each. The aforesaid Mortgage is recorded in the Office of Recorder of Deeds of
Cumberland County, Pennsylvania in Cumberland County Mortgage Book 939, Page 1103. A true and correct copy
of said Mortgage is set forth in Exhibit "BOO attached hereto and made a part hereof by reference,

6. The said Lee Zimmerman died thereby vesling sole lille 10 the land In the Defendant, Clair
Zimmerman.
7. The Plainliff releases Lee Zimmerman, her personal represenlatlves and heirs as heirs, from liability
on the debt secured by the mortgage.
8. The Defendant Mortgagor is in default and he has failed to make the bi-weekly payments from and after
April 19, 1993.
9. The Defendant is the present real owner of the land,
10. The amount due the Plaintiff under the mortgage Is computed as follows:
Principal Balance $24.712,75
Late Charges $14.72
Bad Check Charges $44.00
Interest from April 19, 1993 through April 30, 1994
at 12,5% per annum $3,180,96
5% Attorney's Fees $1,394,68
TOTAL $29.347,11
II. The Plaintiff has complied with the provisions of Section 403 of Act No.6, 41 P.S. 403.
12. The P1aintiffhas complied with the provisions of Section 403-C of the Act of December 23, 1983, P,L,
385 No. 91, 35 P.S. Section 1680,403c,
13, The Defendant has failed to meet the time limitations specified by Section 403-C of the Act of
December 23, 1983, P.L. 385, No. 91, 35 P,S, Section 1680,403c,

ALL mAT CERTAIN tract of land situate in the Borough of New Cumberland, County of
Cumberland and Commonwealth of Pennsylvania, bounded and described in accordance with a survey
by Gerrlt J. Betz, R.S., dated April 15, 1971, as follows:
BEGINNING at a point on the South side of Carol Street, which point is 223.9 feet West of the
southwest comer of Brandt Avenue and Carol Street; thence along Lot No.4, South 37 degrees 19
minutes East 120 feet to lands now or late of W, G, McConnell; thence along the same and lands now
or late of E. L. Lovell, South 52 degrees 41 minutes West 60 feet to Lot No.6; thence along the same
North 37 degrees 19 minutes West 120 feet to Carol Street; thence along the same North 52 degrees
41 minutes East 60 feet to the Place of BEGINNING.

HAVING THEREON ERECTED a one story brick dwelling known as 808 Carol Street, New
Cumberland, Pennsylvania,
UNDER AND SUBJECT, nevertheless, to easements, restrictions and reservations, conditions and
rights-of-way of record.
BEING the same premises which Truman A. Crist. Jr, and Leila G, Crist. husband and wife, by their
deed dated May 22, 1989 and being recorded concurrently herewith in the Office of the Recorder of
Deeds of Cumberland County, Pennsylvania granted and conveyed unto Clair R. Zimmerman and Lee
Zimmerman, husband and wife, Mortgagors herein.
The said Lee Zimmerman predeceased Clair R, Zimmerman whereas title has become vested in the
said Clair R. Zimmerman by operation of law.
