Whitcomb and Deborah Whitcomb Husband and Wife hereinafter called the Owner, WITNESSETH THAT: The Contractor by Instrument dated March 24, 1994 entered Into an Agreement with the Owner lor the erection and construction 01 a a dwe II ing ,situated on that certain parcel of land more particulary described in Exhibit "A" attached hereto and made a part hereof by reference. AND WHEREAS, the Contractor has covenanted and agreed therein to enter Into an additional agreement with the Owner stipulating that no lien or liens of any kind shall be filed against the above building or the appurtenances thereto. NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and In consideration of the awarding to him of the said contract as lor the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner, the receipt of which is hereby acknowledged, promises and agrees that no Mechanic's Lien or liens shall be filed against the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materialmen, mechanics, laborers or anyone for materials furnished, work done or services rendered of any kind whatsoever, for or about, or on account of the aforesaid building or on the credit thereof.
