COMPLAINT
AND NOW comes the Plaintiff, MARY E. KEANE, by her attorneys, NICHOLAS
& FOREMAN, and in support of her Complaint avers as follows:
1. Plaintiff, MARY E. KEANE, is an adult individual residing at 44002 Kitts
Hill Terrace, Ashburn, Virginia 22011.
2. The Defendants, TRACY WILDMAN-JACKSON and BLAKE E. JACKSON
are adult individuals, sui iuris, residing at 4000 Golf View Drive, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
3. At all times relevant hereto Plaintiff was and remains the owner of the
premises at 4000 Golf View Drive, Mechanicsburg, Cumberland County, Pennsylvania
being a single family residential home, herein after referred to as the "premises"..
4. On or about March 14, 1994 the Plaintiff as landlord and Defendants as
Tenants entered into a written lease agreement for the premises, A true and correct
copy of the said Agreement, herein after referred to as the "Lease", is attached hereto,
labeled Exhibit "A" and made a part hereof,
5. The Lease is for a term of two (2) years commencing April 1, 1994 and
continuing through March 31, 1996 requiring a total rental payment of Twenty Six
Thousand Four Hundred and 00/100 ($26,400.00) Dollars plus an increase in monthly
12. On May 9, 1994 written notice as required under Paragraph 12 of the
Lease was given by Plaintiff to Defendants. A true and correct copy of the said written
notice is attached hereto, labeled Exhibit "B" and made a part hereof.

(12) months of the Lease.
6. Under the terms of the Lease, monthly installments of One Thousand One
Hundred and 001100 ($1,100.00) are due on or before the first day of each month
commencing April 1, 1994 and continuing each month thereafter during the term of the
Lease..
7. Under the terms of the Lease, if any installment of rent is not received by
the landlord within five (5) days of its due date, being the first day of the month, an
additional rental of Fifty and 00/100 ($50.00) Dollars is due as late fee.
8. Defendants failed to pay their initial monthly payment due on or before
April 1, 1994 and have continued to fail to pay the same.
9. Defendants have failed to pay their second installment rental due on or
before May 1, 1994 and have continued to fail to pay the same.
10. Late fees are now due on the two (2) rental installments which have
accrued under the Lease, in the sum of One Hundred and 00/100 ($100.00) Dollars.
11. Under Paragraph 12 of the Lease, in the event that Defendants fail to pay
any installment when due and the same has not paid within five (5) days after written
notice by Landlord of non-payment and intention to terminate this lease, Landlord may
terminate the lease.
13. In the event of breach Paragraph 14 of the Lease further allows Plaintiff to
require Defendants to reimburse her for bills, damages and re-renting costs as well as
reasonable attorneys' fees in the amount of Twenty (20%)percent of any sums owed to
Landlord by Tenant.
14. Despite Plaintiffs demand for payment, Defendants and each of them has
failed and continues to fall to make the payments required.
15. Plaintiff demands the installment rental payments for the months of April
1994 and May 1994 in the amount of Two Thousand Two Hundred and 001100
($2,200.00) Dollars together with late fees of One Hundred and 001100 ($100.00)
Dollars, attorneys fees the amount of Four Hundred Sixty and 001100 ($460.00) Dollars
and continuing rent for any period following May 1994 until occupancy and possession
of the premises is surrender to and accepted by Plaintiff.
Wherefore, Plaintiff respectfully requests this Honorable Court to issue an Order
in Ejectment against the Defendants, jointly and individually, requiring possession of the
said premises at 4000 Golf View Drive, Mechanicsburg, Cumberland County,
Pennsylvania be returned from Defendants to Plaintiff and that monetary judgment be
entered against the Defendants, jointly and individually, in the amount of Two
Thousand Seven Hundred Sixty and 00/100 ($2,760.00) together with continuing rental
the amount of One Thousand One Hundred and 00/100 ($1,100.00) Dollars per month
from May 31,1994 until possession Is given and for court costs.
