COMPLAINT
The Plaintiff, Duron, Inc., by its attorneys, KNUPP & KODAK, P.C., brings this
action of Assumpsit against the Defendant to recover the sum of SEVEN THOUSAND
SIX HUNDRED NINETY-ONE DOLlARS AND FIFTY-EIGHT CENTS ($7691,58), along
with interest thereon from November 18, 1993, upon a cause of action of which the
following is a statement:
1, The Plaintiff, Duron, Inc" is a corporation organized and existing under the
laws of the State of Maryland, having its principal office and place of business at 10406
Tucker Street, Beltsville, Maryland 20705,
2, The Defendant, Jeff Conley, is an adult individual who Is trading and doing
business as Professional Coatings and has an office and place of business at 301 BRoss
Avenue, New Cumberland, Cumberland County, Pennsylvania 17070,

3, The Defendant, Terrence Harries, is an adult individual who is trading and
doing business as Professional Coatings and has an office and place of business at 301 8
Ross Avenue, New Curnberland, Cumberland County, Pennsylvania 17070,
4. Defendants executed an Account Application and returned same to Plaintiff,
a true and correct copy of which is attached hereto as Exhibit "A" and rnade a part
hereof,
5, Defendants then executed an Account Application for a name change and
returned same to Plaintiff, a true and correct copy of which is attached hereto as Exhibit
"8" and rnade a part hereof.
6, On the dates, in the amounts, and for the prices set forth in a true and
correct copy of the Plaintiff's Statement of Account attached hereto, made a part hereof
and marked Exhibit "C", Plaintiff, at the special instance and oral request of the
Defendants, sold and delivered goods, wares and merchandise of the kind and
description set forth on said Exhibit to the total amount of FIVE THOUSAND SIX
HUNDRED SEVENTY-EIGHT DOLU>.RS AND EIGHTY-THREE CENTS ($5678,83),

7, The prices charged for said goods, wares and merchandise were just and
reasonable, were the legal and market prices therefor and were the prices which the
Defendants orally promised and agreed to pay Plaintiff therefor,
8, The balance due and owing by Defendants to Plaintiff Is the sum of FIVE
THOUSAND SIX HUNDRED SEVENTY-EIGHT DOLLARS AND EIGHTY-THREE CENTS
($5678,83), as appears by the Statement of Account.
9, Due to Defendants' default In payment of said obligation and in accordance
with the terms and conditions of the Account Application, Defendants are additionally
liable for payment of reasonable attorneys' fees in the total arnount of ONE THOUSAND
EIGHT HUNDRED NINETY-TWO DOLLARS AND SEVENTY-FIVE CENTS ($1892.75),
10, Due to Defendants' default in payment of said amount due and owing as
aforesaid, Plaintiff was forced to seek remedy in the lower Courts thereby incurring
additional costs which Defendants are also liable for, in the total arnount of ONE
HUNDRED TWENTY DOLLARS ($120,00),
11, Plaintiff has frequently demanded payment from Defendants of said amount
due and owing as aforesaid, but Defendants have refused and neglected and still refuse
and neglect to pay said amount or any part thereof.

WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of
