(() I D AMERICAN LEGION HOME ASSOCIATION OF SHIPPENSBURG, : Owner or Reputed Owner MECHANICS' LIEN CLAIM MECHANICS' LIEN CLAIM AND NOW comes the Claimant, B & B Masonry, Inc., by and through its attorneys. David p, Perkins, Esquire, and the law firm of Mark, Weigle and Perkins, who files this Mechanics' Lien Claim against American Legion Home Association ofShippcnsburg, Owner or Reputed Owner, and against the real estate hereinafter described and the curtilage appurtenant thereto for the payment of a debt due to B & B Masonry, Inc., as the contractor for repairs and improvements to the buildings erected thereon. The following is a statement of the claim ofB & B Masonry, Inc.: I. The claimant B & B Masonry, Inc., is a Pennsylvania Corporation with its principal place of business located at 49 West Orange Strcet, Borough of Shippensburg, Cumberland County, Pennsylvania 17257. 2, The name and address of the owner or reputed owner of the real property which is the subject of this claim at the time of furnishing labor, goods, and materials, is American Legion Home Association of Shipp ens burg, 15 West King Street, Borough of Shipp ens burg, Cumberland County, Pennsylvania 17257. 3. On May 10, 1994, the claimant completed work as a contractor in connection with improvements on the property owned by American Legion Home Association of Shipp ens burg at 15 West King Street, Borough of Shipp ens burg, Cumberland County, Pennsylvania 17257. 4. The work was done by the claimant pursuant to a contract dated September 10, 1993, between the claimant and the owner, a copy of which is attached to this claim as Exhibit "A". 5. Additional work was done by the claimant at the owner's request pursuant to a memorandum dated November 4, ]993, a copy of which is attached to this claim as Exhibit "B" and as more fully set forth on invoice dated February 14. ]994, a copy of which is attached to this claim as Exhibit "C". Pursuant to this contract between the claimant and the owner, the claimant furnished the following labor and materials: A. Removed existing siding and aluminum on facade; B. Cleaned brick and washed marble; C, Repaired facade on marble building; MARK, WEIGLE AND PERKINS - ATTORNEVS AT LAW - 126 EAST KING STREET _ SHIPPENSBURG, PA. '7257 D. Replaced brick molding on store front; E. Installed rubber roof on marble building facade; F, Installed rubber roof on brick building facade; G. Installed rubber roof on back porch-marble building; H, Re-pointed brick and seal; J. Replaced railing on back porch; J, Removed and replaced rotted structural frume work on rear porch and facade; K. Removed and installed new cross members; L. Installed new plywood; and M. Removed debris The above described labor, goods and materials were continuously furnished on and about the repair and improvement project on the real estate constituting the premises subject to the lien, known as IS West King Street, Borough of Shippensburg, Cumberland County, Pennsylvania, more fully described in a deed dated January 3,1944, and recorded in Cumberland County Deed Book "T", Volume 12, at Page 117, a copy of which is attached hereto and marked Exhibit "D". 6, Claimant began delivering goods and materials and began making repairs to the premises on or about November 4, 1993, and completed all work on May 10, 1994. The total price charged for all labor and materials pursuant to the contract totals Twenty Thousand One Hundred Seventy-One Dollars and Forty-Three Cents ($20,171.43). 7. On or about November 9, 1993, the sum of Six thousand Eight Hundred Fifty-Five Dollars and Fifty Cents ($6,855.50) was paid by Owner, 8, The amount or sum claimed to be due for the labor, goods and materials is Thirteen Thousand Three Hundred Fifteen Dollars and Ninety-Three Cents ($13,315.93) together with interest at the legal rate. 9. This lien is claimed against the fee simple interest of the Owner or Reputed Owner in the afore said premises. WHEREFORE, Claimant claims to have a lien upon the premises herein described in the amount of Thirteen Thousand Three Hundred Fifteen Dollars and Ninety-Three Cents ($13,315.93), plus interest at the legal rute, plus costs against Owner or Reputed Owner and the premises. Any work related to the removal of the metal,inspection and repair of the wood structure will be done on time and material basis at the hourly rate of $20.00Ihrlman. After the metal has been removed it will be the responsibility of a representative of the American tegion to determine what material should be replaced before covering the area with a rubber material.
