COMPLAINT
1. The Plaintiff is IIARRIS SAVINGS DANK, which formerly was
Harris Savings Association and formerly thereto The Harris Savings
Association, a corporation organized and existing under the laws
of the State of Pennsylvania and having its principal place of
business at Second and Pine Streets, Harrisburg, Pennsylvania,
17101.
2. The Defendants are KENNE1'1I C. PFI\FI" and DEBRA K. PFAFF',
two adult individuals, residing at 5210 Meadowbrook Drive,
Mechanicsburg, Pennsylvania, 170~5.
3. Defendants, on February, I, 198~, entered into a mortgage
loan indenture with Harris Savings I\ssociation, now HI\RHIS SAVINGS
DANK, in the principal amount of SIXTY-NINE TIIOUSAND TWO HUNDHED
DOLLARS and 00/100 ($69,200.001, the terms of which loan are more
specifically evidenced and set forth in the mortgage indenture
dated February I, 1985, and recorded February 4, 1985, in the
Cumberland County Hecorder's Office in Mortgage Book 770, Page 187,
a copy of which is attached hereto, marked J:xhi bi t "A", and made
a part hereof by reference, which lIIortgalJc contains and is a lien
upon the property situate at 5210 Meadowbrook Drive, Mechanicsburg,
Hampden Township, Cumberland County, Pennsylvania, '1705~, being
improved upon with a dwelling.
4. Said loan wan further evidenced and secured by a note
which accompanied said mortgage dated February I, 1985, a copy of
which is attached hereto, marked Exhibit "B", and made a part
hereof by reference.
5. Harris Savings I\ssoc iation, now Hard s Savings Dank, in
consideration of the said mortgage and accompanying note, advallced
to Kenneth C. Pfaff and Debra K. Pfaff, his wife the sum of Sixty-
Nine Thousand two Hundred Dollars and 00/100 ($69,200.00).
6. The premises subject to said mortgage is more
specifically set forth in Exhibit "1\", attached hereto and made a
part hereof by reference.
7. Kenneth C.Pfaff and Debra K. Pfaff are the sole owners
of the said premises contained in said mortgage.
8. Said mortgage and note have not been assigned in whole
or in part by the Plaintiff herein.
9. Kenneth C. Pfaff and Debra K. Pfaff are the record owners
in fee simple of said premises by virtue of a Deed dated February
I, 1985 and recorded in the Cumberland County Recorder's Office in
Deed Book 770, Page 187.
10. No judgment has previously been entered on said mortgage
or note in any jurisdiction, and said instruments are less than
twenty (20) years old.
11. 'l'he naid mortgage is in default because Defendantn herein
have failed to pay the monthly payment of $804.00 that was due and
owing for each of the months of November, December, 1993, and the
monthly payment of $859.00 that was due and owing for eacW of the
the months of January, pebruary, March and April, 1994.
12. The Plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated January 12, 1994, copies of which are marked Exhibits
"c" and "0", and attached hereto and made a part hereof by
reference.
13. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
January 12, 1994, copies of which are marked Exhibits "E" and "P",
and attached hereto and made a part hereof by reference.
14. The entire principal amount of SIXTY NINE THOUSAND TWO
HUNDRED DOLLARS and 00/100 ($69,200.00) has become due and payable,
together with interest at the rate of 6.75% per annum, reasonable
legal fees for collection of said sum in accordance with the terms
of said mortgage less such sums as have been paid on account of
principal of the said mortgage and costs.
15. The Plaintiff believes and therefore avers that
reasonable legal fees for collection is $2,452.00.
16. The Defendants are liable to the Plaintiff for interest
at the rate of 6.75% per annum, late charges, property taxes and
expenses as provided in and collectible under the mortgage
documents that will accrue until distribution by the Sheriff of
Cumberland County, Pennsylvania, to be computed at the time of
judgment in these proceedings in addition to the current loan
balance.
17. The Defcndants arc liablc to the Plaintiff for thc

B. Intcrest at 6.75% from 5/31/94
to 1/7/951 $ 1,944.80
C. Late Chargcsl $ 572.85

18. The Plaintiff believes and avers that neither of the
Defendants are mcmbers of the armed forces or are in the military
service of thc United States of Amcrica.
WHEREFORE, thc Plaintiff prays thc Court to entcr Judgment
against the Defendants, Kenncth C. Pfaff and Debra K. Pfaff, his
wife, in personam on the Notc in the amount of FIl'TY FOUR THOUSAND
SIXTEEN DOLLARS and 69/100 ($54,016.69), and in rem on the Mortgage
for foreclosure and sale of the mortgaged property, with damages
in the said amount in cach case, together with additional interest
thereon, costs and all other amounts advanced by Plaintiff.
