It Is speclllcally denied by the Defendants that the basemenl lacked adequate drainage for a sump pump system. By way of further response, the basement had a sump pump system which was shown to Plaintiffs prior to the time they agreed to buy the real estate from Defendants. 8, Denied, It Is specifically denied by Defendants that the basement contained a "water problem". By way of further response, Defendants advised Plaintiffs about certain conditions which caused moisture In the basement but that these conditions were fully understood by Plaintiffs prior to the time they entered Into the Agreement to purchase the property from Defendants, and that no party ever characterized these problems as a "water problem", It Is further denied that Defendants concealed any Information from Plaintiffs, Including any Information relative to a "water problem" In the basement on that any effort was made to conceal any part of the basement by painting the lower portion of the basement walls. By way of further response, Defendants advised Plaintiffs prior to the time that Plaintiffs entered Into the Agreement that certain clnderblocks In the basement had been painted by Defendants specifically for the purpose of keeping out moisture. 9, Denied. It Is specifically denied that the Defendants ever misrepresented any condition of the property to Plaintiffs. By way of further response, Defendants properly advised Plaintiffs that during the 1972 Agnes storm there had been water problems In the bassment, and, that during the March, 1993 blizzard that there had been moisture In the basement which had been alleviated by the sump pump. They also advised Plaintiffs that 3 or 4 other times there had been minor water In the basement, all of which was taken care of by the sump pump. Defendants further advised Plaintiffs of telltale signs of Impending moisture problems so that Plaintiffs could properly be prepared. It Is specifically denied that at any time Defendants ever misrepresented any of these conditions to Plaintiffs. 10. It Is specifically denied that Defendants ever made a misrepresentation of any kind to Plaintiffs. It Is further denied that the basement of the property ever had to be pumped out almost ever spring during the time period that the property was owned by Defendants. 11. Admllled and denied. It Is admllled that the Defendants repaired the basement walls by painting same, and properly advised Plaintiffs of the reason for doing so, It Is specifically denied that Defendants had any water problem which needed to be repaired, but the painting was done In lieu of any alleged repairs, and that Defendants failed to Install a proper draining or sump system, By way further response, there was a drainage and sump system, 12. Admitted and denied. Defendants admit that Exhibit B Is the listing agreement. Defendants specifically deny that they ever misrepresented any condition of the property on either that listing agreement or at any time to Plaintiffs or any other persons, 13. Neither admitted nor denied. Defendants have no Independent knowledge with regard to what representations were relied upon Plaintiffs, and therefore strict proof Is demanded either prior to or at time of trial. 14. Denied, It Is specifically denied that Defendants ever made any misrepresentations or concealments concemlng any alleged defects to either Plaintiffs or any other persons. As a result, Defendants specifically deny that Plaintiffs have suffered any damages as a result therefore.
