6. On May 6, 1994, Plaintiff received correspondence from
Defendant refusing to return the April, 1994 rent and refusing to
return the security deposit of One Hundred Fifty Dollars ($150.00).
A copy of said notice is attached hereto as Exhibit "A" and is
incorporated herein by reference.
7. plaintiff is entitled to return of the April, 1994 rent
since Plaintiff did not occupy the premises in April, 1994.
8. Tenant is entitled to return of two (2) times the
security deposit, i.e. a total of Three Hundred Dollars ($300.00)
in accordance with 68 P.S. S205.512(B), since the landlord did not
give notice within thirty (30) days of alleged damages for which
the landlord claims the tenant was liable and did not return the
security deposit within thirty (30) days. In addition, tenant is
entitled to interest from November, 1993 to the present on Fifty
Dollars ($50.00) of the security deposit (the amount in excess of
One Hundred Dollars ($100.00) minus one percent (l%) per annum as
administrative expenses) pursuant to 68 P.S. 250.5ll(B).
9. Plaintiff initiated an action before District Justice
Ronald E. Klair to Docket Number CV-0000090-94 and was awarded
judgment on May 5, 1994, in the amount of Five Hundred Eighty-Five
Dollars ($585.00) which included Sixty Dollars ($60.00) as

Plaintiff's costs. plaintiff is entitled to recovery of those
costs in this proceeding.
10. Despite demand for same, Defendant has refused to pay the
amount due and owing.
WHEREFORE, plaintiff requests that this Honorable Court render
judgment in favor of plaintiff against Defendant in the amount Six
Hundred Seventy-five Dollars ($675.00) plus costs, plus interest on
the Fifty Dollars ($50.00) of the security deposit from November of
1993 and interest at a legal rate on the remainder of the sums due
and owing from March 31, 1994.

I, DANIEL S. MILLER, hereby verify that the statements made in
the foregoing document are true and correct, and further, I
understand that false statements therein are made subject to the
penalties of 18 Pa.C.S.A. S4904 relating to unsworn falsification
to authorities.
