COMPLAINT
AND HON, this 25th day of May, 1994, comes the Plaintiff by
its attorney, N. Christopher Menges, and files the following
Complaint:
1. The Plaintiff is, Continental Grain Company, Wayne Farms
Division, a Delaware Corporation, whose principal address is
3700 Crestwood Parkway, Suite 1000, Duluth, GA 30136.
2. The Defendant is, Free Range Farms, Inc., a Pennsylvania
Corporation, whose principal address is 70 Konhaus Road,
Mechanicsburg, PA 17055.
3. Beginning on or about October 20, 1993 and ending on or
about October 21, 1993, the Defendant, did order and receive goods
and merchandise from the Plaintiff, which totalled the sum of
$15,040.95.

4. The Defendant accepted the goods and merchandise of the
Plaintiff as being acceptable and in the ordinary course of
business with an express or implied promise to pay therefor.
5. The Plaintiff maintained books of account, keeping an
accurate running account of all debits and credits for the
provided to the Defendant.
6. The Defendant owes the Plaintiff the amount of $15,040.95
plus interest for past due balance on said account as shown by
statement of account, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference.
7. Demand for payment on this account has been made on
January 13, 1994. In spite of this demand, the Defendant has
refused to pay said balance of $15,040.95 plus interest at the
legal rate of 6 percent per annum.
lfHBREFORE, Plaintiff demands judgment against the Defendant in
the sum of $15,040.95 plus interest from January 13, 1994 at the
legal rate of 6 percent per annum and costs of suit. Pursuant to
Pennsylvania Rule of civil Procedure 1021(c) in counties having

Now comes PNC Bank, National Association, successor by merger
to First Bank & Trust Co. of Mechanicsburg, Garnishee (collectively
hereinafter referred to as "PNC") by its attorneys, Nauman, smith,
Shissler and Hall, and makes answer to the interrogatories of
Plaintiff to garnishee as follows:
1. At the time you were served or at any subsequent time did
you owe the Defendant any money or were you liable to Defendant on
any negotiable or other written instrument, or did the Defendant
claim that you owed him/her any money or were liable to him/her for
any reason?

At the time of service and thereafter PNC
maintained checking account no. 5070007526 in the
name of Free Range Farms, Inc. with a credit
balance of $138.12. PNC was not otherwise indebted
to the defendant.

possession, custody or control of yourself and one or more persons
any property of any nature owned solely or in part by the
Defendant?
