CIVIL ACTION - LAW DAVID E, MEASE and LAURIE A. MEASE, his wife Defendants No, CIVIL 1994 COMPLAINT 1, The Plaintiff Dauphin Deposit Bank and Trust Company, is a Pennsylvania Corporation licensed under the banking laws of the Commonwealth of Pennsylvania with an office located at 3607 Derry Street, Harrisburg, Dauphin County, Pennsylvania 2. The Defendants, David E. Mease and Laurie A. Mease, are individuals residing at 27 Coral Drive, Carlisle, 17013, Cumberland County, Pennsylvania. 3, On or about February 17, 1989the Defendants made an application for a loan to Plaintiff Dauphin Deposit for the purpose of financing the purchase of a 1989 Ford Ranger Truck, The loan was approved by Dauphin Deposit Bank and Trust Company, 4. Dauphin Deposit Bank accepted the application and requested that the Defendants execute a "Pennsylvania Motor Vehicle Installment Sales Contract" (Exhibit "A"). 5. Pursuant to Exhibits "A" the Defendants agreed to make payments in monthly installments of $331.98 to Dauphin Deposit for a term of sixty (60) months payable on the nineteenth (19th) day of each month. 6, The Defendants have defaulted under the terms and conditions of said agreement, Exhibit "A" herein, in that they have failed to make sufficient and consistent payments in accordance with the terms and that no payments have been received since Sepetember 24, 1991. 7, The amount due and owing because of the default of the Defendants under the terms and conditions of said agreement as of March 25,1994 is $3,747.80, plus interest, attorney's fees and costs of suit. 8. The Defendants voluntarily surrendered the car which was the collateral for the loan to Dauphin Deposit and was notified by Dauphin Deposit of the intended sale of the car to be held at Public Sale (Exhibit "B"). 9, The Defendants were given notice that the car was sold at a public sale by Dauphin Deposit on February 8, 1992, (Exhibit "C"). 9. Total proceeds generated by the public sale were $6,400,00, Costs of sale were $275.00, The net amount applied to the principal owed on the Defendant's account was $6,125.00, 10, Repeated demands of the Defendants has been made by Dauphin Deposit and Dauphin Deposit's counsel for the principal balance owed. (Exhibit "D"). 11, The Defendants have refused to pay the deficiency balance owed and is therefore liable for interest, attorney's fees and costs of suit. WHEREFORE, the Plaintiff Dauphin Deposit Bank and Trust Company demands judgement against the Defendants in the amount of $3,747,80 together with attorney's fees of twenty percent (20%), interest and costs of suit.
