THIS AGREEMENT made the \r~ day of June, 1994, by and between SIGMAN'S
MOBILE HOME SALES, hereinafter referred to as Contractor, and DEBORAH A. SHANNON and
KEVIN C. SHANNON, wife and husband, hereinafter referred to as Owner, whereby the former
undertakes and agrees to erect and construct a single family dwelling on:
ALL that certain tract of land with the improvements thereon erected, situate in
Dickinson Township, in the County of Cumberland, Commonwealth of Pennsylvania, bounded and
described, as follows:
BEGINNING at a point, said point being a railroad spike located in the centerline of
Encks Mill Road, T -462 at the common property corner of lands of Leroy E. Thumma and Dale C.
Baer; thence continuing along lands of Dale C. Baer, South 87 degrees, 55 minutes, 00 seconds
West, a distance of 291.67 feet to an iron pin; thence along lands of Leroy Eo Thumma, North 00
degrees 55 minutes 10 seconds West, a distance of 294009 feet to an iron pin; thence continuing
along the same, North 87 degrees, 55 minutes 00 seconds East, a distance of 291067 feet to a
parker kalon nail located in the centerline of Encks Mill Road, T -462; thence continuing in the
centerline of Encks Mill Road, T-462, South 00 degrees 55 minutes, 10 seconds East, a distance
of 294.09 feet to the point of BEGINNING.
CONTAINING a total of area of 1.969 acres.
SUBJECT to the dedication of 0.169 acres of right of way for Encks Mill Road, T -4620
BEING the same property which Deborah A. Shannon and Kevin C. Shannon, wife and
husband, by their Deed dated June 2, 1994 and recorded in the Office of the Recorder of Deeds
In and for Cumberland County, simultaneously herewith, granted and conveyed unto Deborah A.
Shannon and Kevin C. Shannon, wife and husbando
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of One ($1.00) Dollar to him in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and
agree that no mechanic's liens or claims thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file and maintain any mechanic's liens or claims against the said buildings or any
of them, and sgree that this instrument, waiving the right of lien, shall be an independent covenant.
