The Plaintiff, James Twigg, is the owner of Stough's Mobile Home Park. an entity doing business in the Commonwealth of Pennsylvania having an office or principal place of business at 64-A De1roit Avenue, Mechanicsburg, Cumberland County. Pennsylvania 17055. 2. The Defendant, Erik C. Smith, Is an adult individual currently residing at 24 Rosedale Drive, Hershey, Dauphin County. Pennsylvania 17033. 3. On or about May 4, 1992, Plaintiff leased the premises at 93 Princess Boulevard, Mechanicsburg, Cumberland County, Pennsylvania, to the Defendant under a mobil home site lease agreement, a true and correct copy of which is attached hereto, incorporated herein by referenee and marked as Exhibit. A.. 4. Jerry Simpson is the manager ofStough's Mobile Home Park and an authorized agent for the Plaintiff. 5. Said lease agreement has not been assigned by the Plaintiff. The lease agreement requires the Defendantlo pay unto Plaintiff a monthly rental of$215.oo, whieh was inereased to $235.00 effective January I, 1994, payable In advance on the first day of each month. 000114-00030/Msy 27, 1994/JLH/MHI35S92 6. The Stough '5 Mobile Home Park rules and regulations provided to the Defendant by the Plaintiff and made part of the lease agreement by Paragraph 20, provides that any rents not received by the fifth day of each month will receive a late charge of $25.00 per month. A true and correet copy of the applicable sections of the park rules and regulations are attaehed hereto. incorporated herein by reference and marked as Exhibit "8. " 7. As a result of the Defendant's failure to make the monthly rental payments, there Is due and owing to the Plaintiff from the Defendant the sum of $2,325.00 for baek rent and late fees under the terms of the lease agreement. A true and correct copy of the breakdown of the rent delinqueney is attaehed hereto, Incorporated herein by reference. and marked as Exhibit .C. . 8. Despite repeated demands, the Defendant has failed to pay in full the baek rent owing or to pay any part thereof as required under the terms of the lease agreement. 9. Under the terms of lease agreement, specifically paragraph 17, the Defendant is obligated to pay to the Plaintiff the expenses of collection, ineluding attorney's fees of 15% of the amount duly owing. 10. There is justly due and owing to the Plaintiff from the Defendant on account of the aforesaid breaeh of the lease agreement, the sum of $2,673.75. caleulated as follows: Unpaid Rent Late Fees Attorney's Collection Fee TOTAL $2,075.00 250.00 348.75 $2,673.75 11. If proceedings shall be ccmrenced by Landlord to recover possession under the 1Icts of 1\Ssenbly, either at the end of the tann or sooner terminations of this Lease, or for nonpaynent of rent, or any other reason, tenant specifically waives the right to fifteen or thirty days' notice required by the J\ct of 1\Ssembly of 1Ipril 28, 19B3, P,L 202, and agrees that five days' notice shall be sufficient in either or any such case. ./~ ,/ 20, '1l1e Lease, and the aforesaid rules and regulations, constitute the entire agreerrent between the parties and sarre is not subject to any oral mXIification.
