Defendants CIVIL ACTION -- LAW COMPLAINT NOW COME plaintiffs Alternative Rehabilitation Communities, Inc. and Daniel P. Elby, by their undersigned attorneys, and complain against defendants Committee for Protection and Safety a/k/a COPS, Ralph E. Wax and Sl John Does as follows: PLAINTIFFS 1. Plaintiff Alternative Rehabilitation Communities, Inc. ("ARC") is a Pennsylvania nonprofit corporation with its principal place of business at 2743 North Front Street, Harrisburg, Dauphin County, Pennsylvania. 2. At all times relevant, ARC has engaged primarily in the business of providing rehabilitation services to juveniles who have been adjudicated delinquent by the courts of the Commonwealth of Pennsylvania ("Juvenile Rehabilitation Services"). 3. ARC provides Juvenile Rehabilitation Services under contract with county governments. . . 4. Plaintiff Daniel P. Elby is a natural person residing at 3535 Pebble Ridge Drive, York, York County, Pennsylvania. 5. At all times relevant, Daniel P. Elby has been the Executive Director and a full time employee of ARC. DEFENDANTS 6. Defendant Committee for Protection and Safety a/k/a COPS ("COPS") is an unincorporated association with its principal place of business at c/o Ralph E. Wax, 159 Mount Rock Road, Newville, Cumberland County, Pennsylvania. 7. At all times relevant, COPS has engaged primarily in activities in opposition to certain plans of ARC to establish three group care facilities to provide Juvenile Rehabilitation services on a property located at 261 Centerville Road, Newville, West Pennsboro Township, Cumberland County, Pennsylvania. 8. Defendant Ralph E. Wax is a natural person residing at 159 Mount Rock Road, Newville, Cumberland County, Pennsylvania. 9. At all times relevant, Ralph E. Wax has been a member and representative of COPS authorized to make statements on behalf of COPS. 10. Defendants John Doe 1 through John Doe 50 are natural persons of unknown identity and residence. 11. At all times relevant, John Doe 1 through John Doe 50 have been all of the members of COPS other than Ralph E. Wax. -2- 12. Defendant John Doe Sl is a natural person of unknown identity and residence. 13. John Doe Sl is the author of the Anonymous Letter hereinafter described. FALSE, DEFAMATORY STATEMENTS 14. On or about March 14, 1994, John Doe Sl wrote a letter (the "Anonymous Letter"). A true and correct copy of the Anonymous Letter is attached hereto and incorporated herein as Exhibit A. lS. John Doe Sl did not identify himself as the author of the Anonymous Letter. 16. The Anonymous Letter contains false, defamatory statements as follows: a. "The Board of ARC -- which he [Dan E1by] appointed -- ~ his daughter a college education paid by ARC . . . funds.1I b. "Members of E1by's Family are on ARC's payroll . . . in No work positions __II c. "[Dan E1by's] PERKS INCLUDE -- Car (Tax Free), Health Clubs (Tax Free) World wide travel and the list goes on." d. "He [Dan E1by] has a right to make a living but Not rip off a 6 figure salary, college for his kids." e. "Also, property is bought in his [Dan E1by's] name he charges the State for the cost of the property as part of their cost to send kids to him -- Then when the property is paid -3- off 1. He owns it -- not the state and 2. He continues to charge cost for the "paid off" property -- THE STATE BUYS IT TWICE and ~ owns it." 17. Before April 27, 1994, Ralph E. Wax, individually and as a member and authorized representative of COPS, wrote a letter (the "Letter to the Editor"). A true and correct copy of the Letter to the Editor is attached hereto and made a part hereof as Exhibit B. 18. The Letter to the Editor contains false, defamatory statements as follows: a. "There are strong allegations that Mr. Dan Elby, its [ARC's] executive director, is drawing a salary of more than $150,000 per year, driving an expensive foreign car, paying his daughters' college tuition, maintaining a health club membership and taking around-the-world trips -- all out of our tax dollars being paid to house these juveniles." b. "ARC is a nonprofit organization, therefore they pay no state or local taxes for the services they receive, such as police and fire protection." 19. Upon information and belief, certain of the false, defamatory statements about ARC and Daniel P. Elby in the Letter to the Editor were based upon statements contained in the Anonymous Letter. -4- PUBLICATION 20. On or about March 14, 1994, John Doe 51 published the Anonymous Letter by sending or giving copies thereof to, inter AliA, the following: a. Pennsylvania Representative Albert Masland; b. Richard Lewis, a reporter for The sentinel, a newspaper of general circulation with offices in, and circulation primarily in and around, Carlisle, Cumberland County, Pennsylvania; c. Pennsylvania Auditor General Barbara Hafer; d. Pennsylvania Attorney General Ernest D. Preate, Jr.; and e. Adam Bell, a reporter for The Patriot, a newspaper of general circulation with offices in, and circulation primarily in and around, Harrisburg, Dauphin County, Pennsylvania. 21. John Doe's publication of the Anonymous Letter as set forth in the foregoing paragraph was with the express intent that the recipients repeat and republish the contents of the Anonymous Letter to others. 22. Upon information and belief, certain recipients of the Anonymous Letter republished its contents to others by sending or giving copies thereof to, inter aliA, the following: a. Mitchell L. Hoffman, Zoning Officer of West Pennsboro Township, Cumberland County, Pennsylvania; and b. Ralph E. Wax. -5- 23. Before April 27, 1994, Ralph E. Wax published the Letter to the Editor by sending or giving a copy thereof to the editor of the Valley Times-star, a newspaper of general circulation with offices in, and circulation primarily in and around, Newville, Cumberland County, Pennsylvania. 24. Ralph E. Wax's publication of the Letter to the Editor as set forth in the foregoing paragraph was with the express intent that the editor of the Valley Times-Star repeat and republish the contents of the Letter to the Editor by reprinting it in the pUblicly-distributed edition of the newspaper. 25. On April 27, 1994, the editors of the Valley Times-star republished the Letter to the Editor by reprinting it, it its entirety, in the publicly-distributed edition of the newspaper. APPLICATION TO PLAINTIFFS 26. The false, defamatory statements in the Anonymous Letter applied to ARC and Daniel P. Elby. 27. The false, defamatory statements in the Letter to the Editor applied to ARC and Daniel P. Elby. UNDERSTANDING OF THE RECIPIENTS 28. The recipients of the Anonymous Letter understood the defamatory meaning of the false, defamatory statements contained therein. -6- 29. The recipients of the Anonymous Letter understood that the false, defamatory statements contained therein were intended to be applied to ARC and Daniel P. Elby. 30. The recipients of the Letter to the Editor understood the defamatory meaning of the false, defamatory statements contained therein. 31. The recipients of the Letter to the Editor understood that the false, defamatory statements contained therein were intended to be applied to ARC and Daniel P. Elby. ACTUAL MALICE 32. John Doe 51 made the false, defamatory statements in the Anonymous Letter knowing they were false. 33. In the alternative, John Doe 51 made the false, defamatory statements in the Anonymous Letter with reckless disregard for whether they were true or false. Such reckless disregard included, inter alia, the following: a. failing to verify the accuracy of said statements by reference to publicly available information about ARC and Daniel P. Elby including, without limitation, (1) information on file with the Pennsylvania Departments of State and Public Welfare, and (2) information contained on ARC's IRS Form 990, Return of Organization Exempt from Income Tax, which is available for public inspection at ARC's offices pursuant to 26 U.S.C. S 6104(e); and b. failing to ask ARC or Daniel P. Elby whether said statements were true or false. -7- . ' 34. Ralph E. Wax made the false, defamatory statements in the Letter to the Editor knowing they were false. Such knowledge included, inter ~, the following: a. Ralph E. Wax knew that the statements in paragraph 18.a, above, were false because he had obtained copies of reports of audits of ARC performed by the Pennsylvania Department of Public Welfare and Pennsylvania Auditor General, which audits contained information contrary to said statements; and b. Ralph E. Wax knew that the statement in paragraph 18.b, above, was false because he had attended public meetings on March 7 and April 4, 1994, at which representatives of ARC had stated that ARC makes payments in lieu of taxes to many municipalities in which it operates facilities and that ARC was prepared to make such payments to West Pennsboro Township. 35. In the alternative, Ralph E. Wax made the false, defamatory statements in the Letter to the Editor with reckless disregard for whether they were true or false. Such reckless disregard included, inter alia, the following: a. failing to verify the accuracy of said statements by reference to publicly available information about ARC and Daniel P. Elby including, without limitation, (1) information on file with the Pennsylvania Departments of State and Public Welfare, and (2) information contained on ARC's IRS Form 990, Return of Organization Exempt from Income Tax, which is -8- . ' available for public inspection at ARC's offices pursuant to 26 U.S.C. S 6104(e); b. failing to ask ARC or Daniel P. Elby whether said statements were true or false even though Ralph E. Wax attended public meetings on March 7 and April 4, 1994, at which representatives of ARC, including Daniel P. Elby (March 7, 1994, meeting only), were present to answer questions; and c. for certain of the statements, relying entirely upon statements contained in the Anonymous Letter without making any attempt to verify the accuracy of such statements. LIBEL ACTIONABLE EEB ~ 36. John Doe 51 made and published the false, defamatory statements in the Anonymous Letter in written or printed words, with deliberation, premeditation and persistence. 37. The Anonymous Letter imputes to ARC illegal and dishonest conduct incompatible with its business, and imputes to Daniel P. Elby illegal and dishonest conduct incompatible with his profession and office. 38. Therefore, John Doe 51's actions aforesaid constitute libel actionable per ~, without proof of special damages. 39. Ralph E. Wax made and published the false, defamatory statements in the Letter to the Editor in written or printed words, with deliberation, premeditation and persistence. 40. The Letter to the Editor imputes to ARC illegal -9- and dishonest conduct incompatible with its business, and imputes to Daniel P. Elby illegal and dishonest conduct incompatible with his profession and office. 41. Therefore, Ralph E. Wax's actions aforesaid constitute libel actionable ~ ~, without proof of special damages. SPECIAL DAMAGES 42. John Doe 51's actions aforesaid are the legal and proximate cause of special damages suffered by ARC and Daniel P. Elby. 43. Ralph E. Wax's actions aforesaid are the legal and proximate cause of special damages suffered by ARC and Daniel P. Elby. ABSENCE OF PRIVILEGE 44. John Doe 51 made and published the false, defamatory statements in the Anonymous Letter without privilege, or in abuse of a conditionally privileged occasion. 45. Ralph E. Wax made and published the false, defamatory statements in the Letter to the Editor without privilege, or in abuse of a conditionally privileged occasion. COUNT I (ARC VS. JOHN DOE 51) 46. ARC incorporates paragraphs 1 through 45, above, herein by reference. WHEREFORE, ARC prays that this honorable court enter judgment in its favor and against John Doe 51 in an amount to be -10- determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. COUNT II (DANIEL P. ELBY VB. JOHN DOE 51) 47. Daniel P. Elby incorporates paragraphs 1 through 45, above, herein by reference. WHEREFORE, Daniel P. Elby prays that this honorable court enter judgment in his favor and against John Doe 51 in an amount to be determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. COUNT III (ARC VB. RALPH E. WAX) 48. ARC incorporates paragraphs 1 through 45, above, herein by reference. WHEREFORE, ARC prays that this honorable court enter judgment in its favor and against Ralph E. Wax in an amount to be determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. COUNT IV (DANIEL P. ELBY VB. RALPH E. WAX) 49. Daniel P. Elby incorporates paragraphs 1 through 45, above, herein by reference. -11- WHEREFORE, Daniel P. Elby prays that this honorable court enter judgment in his favor and against Ralph E. Wax in an amount to be determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. COUNT V (ARC VS. COPS) SO. ARC incorporates paragraphs 1 through 45, above, herein by reference. 51. In making and publishing the false, defamatory statements in the Letter to the Editor, Ralph E. Wax was acting as a member and representative of COPS authorized to make statements on behalf of COPS. WHEREFORE, ARC prays that this honorable court enter judgment in its favor and against COPS in an amount to be determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. COUNT VI (DANIEL P. ELBY VS. COPS) 52. Daniel P. Elby incorporates paragraphs 1 through 45, above, herein by reference. 53. In making and publishing the false, defamatory statements in the Letter to the Editor, Ralph E. Wax was acting as a member and representative of COPS authorized to make statements on behalf of COPS. -12- WHEREFORE, Daniel P. In making and publishing the false, defamatory statements in the Letter to the Editor, Ralph E. Wax was acting as a member and representative of COPS, an unincorporated association, and as the agent of its members, John Doe 1 through John Doe 50, within the scope of his authority to make statements on behalf of COPS and its members. 56. John Doe 1 through John Doe 50 authorized, ratified or assented to Ralph E. Wax's actions aforesaid. WHEREFORE, ARC prays that this honorable court enter judgment in its favor and against John Doe 1 through John Doe 50, jointly and severally, in an amount to be determined at trial but believed to exceed $25,000, plus the taxable costs of the matter and such other relief as may be just and proper in the circumstances. -13- COUNT VIII (DANIEL P. Wax was acting as a member and representative of COPS, an unincorporated association, and as the agent of its members, John Doe 1 through John Doe 50, within the scope of his authority to make statements on behalf of COPS and its members. 59. John Doe 1 through John Doe 50 authorized, ratified or assented to Ralph E. Wax's actions aforesaid. WHEREFORE, Daniel P. The Sheriff served the complaint on defendants Committee for Protection and Safety a/k/a COPS and Ralph E. Wax on June 7, 1994. This was effective service on defendants John Does 1 through 50, members of COPS, pursuant to Pa.R.C.P. 423. 4. Defendant John Doe 51 has not been served with the complaint because his or her identity and address are unknown. 5. The first day plaintiffs may schedule depositions without leave of court pursuant to Pa.R.C.P. 4007.2(b) is July 7, 1994. 6. Plaintiffs seek leave of this Court to schedule depositions prior to July 7, 1994, for the purpose of identifying the John Doe defendants. ~ . IDENTIFICATION OF JOHN DOES 1 THROUGH 50 7. Defendants COPS, Ralph E. Wax and John Does 1 through 50 are responsible for a letter to the editor containing false, defamatory statements about the plaintiffs. 8. Ralph E. Wax is a member and authorized representative of COPS. 9. John Does 1 through 50 are the other, unidentified members of COPS. 10. Plaintiffs seek leave of this Court to depose Ralph E. Wax prior to July 7, 1994, for the purpose of identifying John Does 1 through 50. The form of the notice of deposition which plaintiffs propose to serve on Ralph E. Wax is attached to and incorporated in this motion as Exhibit A. IDENTIFICATION OF JOHN DOE 51 11. Defendant John Doe 51 is the unidentified author of an anonymous letter containing false, defamatory statements about the plaintiffs. 12. The anonymous letter clearly implies that Thomas Orr and Charles Rollason provided information upon which the anonymous letter was based. 13. Plaintiffs seek leave of this Court to depose Thomas Orr and Charles Rollason prior to July 7, 1994, for the purpose of identifying John Doe 51.
