COMPLAINT
AND NOW, come Plaintiffs, Francis and pegge Lapore, by and
through their attorneys, METTE, EVANS & WOODSIDE, and bring
this action before this Court, and in support thereof aver as
follows:
1. Plaintiffs, Francis and pegge Lapore, are husband and
wife and reside at 7 Laurel Drive, Enola, Cumberland County,
Pennsylvania 17025.
2. Defendant, Weber's Hardware, is located at 100 West
Main street, Mechanicsburg, Cumberland County, Pennsylvania
17055.
3. Plaintiffs are the owners of a 1989 Ford Probe.
4. On or about October 2, 1993, Plaintiffs purchased a
can of paint from Defendant and transported it to their home.
5. The following week, on October 9, 1993, Plaintiffs
opened the can of paint in preparation for use on their house
when they realized that it was not the color that they had
ordered.
6. After resecuring the lid to the can, Plaintiff, pegge
Lapore, placed the can of paint on the driver's side backseat
floor of her car and transported it back to Defendant.
7. When Plaintiff presented the paint to an employee of
Defendant, he pried open the can and determined that he could
not refund Plaintiffs' money because it was a special mixed
paint.
8. Defendant's employee then negligently and defectively
resecured the lid to the paint can and returned it to Mrs.
Lapore for transport back to Plaintiffs' home.
9. Plaintiff, pegge Lapore, placed the can of paint in an
upright position on the driver's side backseat floor and
commenced the drive home.
10. On her way home, Mrs. Lapore began to smell a paint
odor and realized that the can of paint had tipped over and
spilled because the lid did not remain fastened.

11. On her way home, Mrs. Lapore was not involved in an
accident, nor was she required to take any abrupt action that
caused the lid to come off the can of paint, Rather, the can
of paint tipped over while she was operating her vehicle in a
safe, foreseeable, and non-negligent manner.
12. The spilled paint caused considerable damages to the
interior of Plaintiffs' 1989 Ford Probe as well as personal
effects within the automobile.

l3. Paragraphs 1 through 12 are incorporated by reference
as if set forth herein at length.
14. Defendant had a duty to protect Plaintiffs from
injuries to their property by adequately securing the lid to
the can of paint purchased from Defendant.
15. Defendant, through its agent, failed to adequately
secure the lid to the can of paint.
16. The injuries and damages suffered by Plaintiffs were a
direct and proximate result of Defendant's employee's failure
to adequately secure the lid to the can of paint.

19. Paragraphs 1 through 18 are incorporated by reference
as if set forth herein at length.
20. Defendant impliedly warranted that the packaging was
safe for its intended purpose, that being protecting the
contents from spilling during the course of a foreseeable
manner of transportation.
2l. Defendant, through its employee or employees, breached
said warranty by failing to adequately secure the lid to the
can of paint.
WHEREFORE, Plaintiffs demand judgment in their favor and
against Defendant for repairs to the interior of their
automobile and for the loss of their other personal property in
an amount not in excess of $25,000.00.

And now, comes Defendant, Weber's Hardware, by and through
their attorneys, GOldberg, Katzman & Shipman, P.c., and files this
Answer to Plaintiffs' Complaint and, in support thereof state as
follows:
l. Defendant is without knowledge or information sufficient
to form a belief as to the truth of the averments of paragraph 1 of
Plaintiffs' Complaint and, therefore, said averments are denied and
strict proof thereof is demanded at trial.

to form a belief as to the truth of the averments of paragraph 2 of

6. Admitted in part and denied in part. It is admitted that
on or about October 7, 1993, Plaintiff, pegge Lapore, brought a
paint can into Weber's Hardware. Defendant lacks knowledge or
information sufficient to form a belief as to the truth of the
remaining averments of paragraph 6 of Plaintiffs' Complaint and,
therefore, said averments are denied and strict proof thereof is
demanded at trial.

8. Admitted in part and denied in part. It is admitted that
Defendant's employee resecured the lid to the paint can and

returned it to pegge Lapore. The remaining averments of paragraph
8 are conclusions of law to which no response is required. If a
response is deemed to be required, said averments are denied and

answer, Defendant denies that its employee negligently and
defectively resecured the lid to the paint can.
