Assalita, CU8t~dians and Guardians of Stephanie L. Brown and Robert L. Brown, by and through their attorneys, John J. Mooney, III, Esquire and Gates & Mooney, and files the within causes of action, to witl 1. The Plaintiffs, Edward J. Assalita and Sharon A. Assalita, husband and wife, are adult individuals residing at 15 Hamilton Drive, Abbottstown, Adams County, Pennsylvania, 17301. 2. The Plaintiffs are the custodians and guardians of the minor Plaintiffs, Stephanie L. Brown, born September 21, 19S1 and Robert L. Brown, born March 2S, 19S3, pursuant to Order of Court dated October 1S, 1993 at 93-S-211, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference. 3. Defendant is Dorothy Bisset, an adul t individual residing at 408 Bosler Avenue, Lemoyne, Pennsylvania, 17043. 4. From August 23, 19S5 through October 18, 1993, Defendant served in a fiduciary capacity to the aforesaid minor children in that she received child support payments on behalf of the I children as well as Social Security payments. I i II r 5. The children have resided with the Plaintiffs since '. , 11 II II I I , ~ ' I August of 1990. 6. During the aforesaid period, Defendant failed to expend funds necessary for the welfare of the children and instead opened bank accounts in her own name. COUNT I - UNJUST ENRICHMENT 7. Plaintiffs repeat and reallege Paragraphs l-6 hereof. S. Despite repeated demands by the Plaintiffs, Defendant has failed and refused to account for the funds she received on behalf of the children. 9. Defendant has further indicated that the monies have been put into bank accounts with her name as a listed owner. 10. Defendant has breached her fiduciary duty to the minor children by claiming the money as her own, thereby unjustly enriching herself as a result of her fiduciary relationship. 11. Plaintiffs believe and therefore aver that the Defendant has in excess of $20,000.00 which belongs to the minors. WHEREFORE, Plaintiff's respectfully request this Honorable Court order the following reliefl (a) Enjoin Defendant from transferring, encumbering or otherwise alienating any bank account or certificate of deposit which has either of the minor children's name or her name on itJ I (b) Order the Defendant to provide a complete and detailed I accounting of the funds received from August 23, 19S5 through " I October 1St 1993 as well as the expenses thereonJ i: (c) Order the Defendant to disclose the location, nature and amount of any funds derived from funds received on behalf of the children J (d) Enter judgment against the Defendant for an amount as shall be determined by the CourtJ (e) Order the Defendant to pay over all funds to the PlaintiffsJ and (f) Such other and further relief as the Court deems appropriate. COUNT II - CONVERSION 12. Plaintiffs repeat and reallege paragraphs 1-11 hereof. 13. The Defendant, by her actions in placing the fiduciary funds into her own name, has converted the same to her own use in violation of her fiduciary duties. 14. Said breach of duty constitutes a conversion. WHEREFORE, Plaintiff's respectfully request this Honorable Court order the following relief: (a) Enjoin Defendant from transferring, encumbering or otherwise alienating any bank account or certificate of deposit which has either of the minor children's name or her name on hitJ (b) Order the Defendant to provide a complete and detailed accounting of the funds received from August 23, 19S5 through October 1S, 1993 as well as the expenses thereonJ (c) Order the Defendant to disclose the location, nature and amount of any funds derived from funds received on behalf of the childrenJ " I I (d) Enter judgment against the Defendant for an amount as shall be determined by the CourtJ (e) Order the Defendant to pay over all funds to the PlaintiffsJ and (f) Such other and further relief as the Court deems appropriate. The Defendant's conduct in placing the monies into her own name constitutes a constructive trust for the benefit of the subject minors.
