FISSEL, is an adult individual who resides at 1000 Market Street, Duncannon, Pennsylvania 17020. 2. Defendant, RICHARD E. HOFFMAN, is an adult individual who reside at 400 Lisburn Heights Drive, Lewisberry, Pennsylvania 17339. 3. On or about June 15, 1991, Plaintiff rented 2003 Market street, Camp Hill, Cumberland County, Pennsylvania from Defendant. Plaintiff paid a security deposit of $440.00 and monthly rental of $450.00. 4. Defendant failed to place the security deposit in an intereet bearing account or to account for an interest on the security deposit. 5. In December 1993, Plaintiff notified Defendant of her desire to terminate the lease. On January 31, 1994, Plaintiff moved from the premises. 6. On or about February 24, 1994, Defendant sent a letter to Plaintiff demanding the payment of three (3) months rental plus miscellaneous cleaning charges. SUSAN U. Plaintiff alleged that Mr. Hoffman had improperly retained 11 security deposit from a Residential Lease Agreement. In his Answer. tiled June 22. 1994. HOFFMAN, Defendant CIVIL ACTION - LAW STATEMI~NT OF FACTS This nction WllS initiatcd hy the Complnint of Susnn D. Fissel agninst the Defendnnt, Richnrd E, Hoffman on June 30, 1994. Plaintiff, as Lessee, entered into the Agreement with the HolTmllns on or about June 15, 1991. The Lease term commenced on June I, 199111nd was to continue for II period of one (I) year. The LellSe WllS self-renewing by its terms, and provided fur a monthly rental of $441.00. Pllragraph 24 of the Agreement (Exhihit I) provided thllt Lessee prepay $440,00 at the commencement of the Lease, $150.00 of which was to he used to prepllre the apartment for occupancy, and the remaining $290.00 was held ns security ngainst dnll1l1ges. In addition to these terms, Paragraph 3 provided thnt the Lessor would provide n list of Rules and Regulations that were expressly nlllde a part of the Agreement. . " Paragraph 37 of these Rules specifically governs termination of the Lease nnd provides that "if vacating before terlllinntion of Lease, Lessee must pay a 90 duy penalty to rescind Lease Agreement." Also addressing terminntion, Paragrnph FIFTH of the Agreement provides that either party may terlninate at the end of the Lease term with two (2) months notke. Plaintiff gave the Hoffmans a wrillen nolke evidenl'ing her desire to terminate the Lease on November 26, 1993 (see Exhibit 2). The notice specilied that she would vacate the premises hy February I, 1994, four months prior to the end of the Lease term. In accordance with her leller. Plaintiff vacated the property on January 31, 1994, On February 23, 1994, Mr. Hoffman forwarded a leller to Plaintiff indkating that he was retaining her security deposit. The leller provided an itemized list of expenses that Mr. If'lffman incurred as a result of the Plaintiffs occupancy and premature termination. The list included $196.00 for repairs and cleaning, and a $1,350.00 early termination penalty, as provided for under the terms of the Lease, The correspondence noted the total damages at $1,546,00, and requested that Plaintiff remit that amount, less the deposit held, or $1,106,00. (~Exhibit3) Plaintiff has refused to remit puymentns required under the terms of the Lease, and has instituted II suit for the return of the entire $440.00 deposit. Mr. Hoffman has accordingly counter-claimed to recover the 90-day early termination penalty. I. Mr. Hoffman is entitled to retain the $440.00 security deposit pursuant to the terms of the Lease Agreement. , . Each of the items specified in Mr, Hoffman's list of damages was the direct result of Plaintiffs violation of a specitically agre~d upon condition of the Lease. Im:luded in the list of damages were carpet cleaning, which Plaintiff agreed to perform in Paragraph 3 of the signed Lease Add~ndum, light bulb replacement. which was agreed to in Paragraphs 4 and 9 of tht: Addendum, Clt:aning thl: bathroom tub and rl:pairing holes in the bathroom door was also listed, and was chargl:d pursuant to a brl:ach of Paragraphs 2 and 10 of tht: Least: Addendum. Finally, the list includl:d a three month's rent penalty for early termination of the Ll:ase, as authorized by Paragraph 27 of tht: Lease Rules and Regulations. . .' In the instant case, Mr. Hoffman completdy complied with the statutory requirements regarding withholding of security deposits. Additionally, each item that the deposit was withheld for was specifically enumerated in the Lease Agreement and the Addendums thereto. Sub-section (a) of the Statute specilically authorizes withholding for "damages to the Leasehold," as well as "the breach of any other condition in the Lease," In this scenario; Plaintiff specifically breached the Lease provisions regarding cleaning the premises as well as the section on premature termination of the Lease Agreement. Courts have routinely held, that when a landlord properly documents repairs made and provides a list of such to the tenant, then the portion of the deposit attributable to such repairs may be lawfully n:tained. ~ ~ Taylor v. Fitzhenry, 48 D&C.3d 619 (\ 987), The case at hand, however, presents an even stronger argument for the retention of fees. because in this instance, as mentiolll:d above, the fees were withheld for specific violations of enumerated covenants that Plaintiff agreed to perform. Because Plaintiffs action of not complying with the Lease conditions directly resulted in Defendant incurring costs to repair and clean the premises, Defendant was entitled, upon satisfying the requirements of 25 P,S. ~ 250.512, to retain the Plaintiffs security deposit. WHEREFORE, Defendunt Richard E. Hoffmun respectfully requests this Honorable Court to deny Plaintiffs request for the return of the $440.00 security deposit. . " . II. Defendant Richard E. Hoffman is entitled to recover a sum equal to 90 days rent as a penalty for early termination of the Lease Agreement. Mr. Hoffman is entitled to recover 90 days rent pursuant to Paragraph 27 of the Rules and Regulations Addendum. Paragraph 27 of the Addendum was made part of the Lease by the language of Paragraph THIRD, and provides that "(i)f vacating before termination of Lease, Lessee must pay 90 day penalty to rescind the Lease." In the case at hand, Plaintiff terminated the Lease on December 31, 1993, four months before the natural termination of the Lease Agreement. A Lease Agreement is in the nature of a contract, and when its provisions are clear and free from doubt. they must be strictly construed. Cleartield Volunteer Fire Dept. v. B,P. Oil Co" Inc., 602 A.2d 877, 412 Pa,Super. 29 (1992), In a case where the Lease is clear as to the intent of the parties, the Court must construe the Lease to reflect as closely to the parties' intent as the law permits. See e.~" In re Estate of ~, 561 A.2d 1268, 385 Pa.Super. 627 (1989), In the case at hand, Mr. Hoffman's as well as the Plaintiffs intent is clearly displayed in the language of Paragraph 26. Plaintiff specilically agreed to be bound by this provision, and no evidence to the contrary has yet to be suggested. The ninety (90) day penalty is, in effect, a reduced rentnl acceleration clause, Mr. Hoffman could have included a clause that would have mnde Plaintiff liable for the full balance of the remainder of the Lease term, See Pierce v. Horfstot, 236 A.2d 828, 211 Pa.Super. 380 (\967) (stating that "rental acceleration clauses are valid"), Instead, he chose to include merely a three (3) month penalty provision. Plaintiff could have objected to this clause, . . or chosen to rent elsewhere, however. it is meritless at this point to suggest that even though Mr. Hoffman could have acceleratcd a full term's rent. he is not entitled to recover a portion thereof by virtue of Paragraph 26 of the Agreement. Becausc the Lease is clear and unambiguous in its tcrms, the Lease must be strictly construed as being evident of the parties' intent. Therefore, inquiry must merely focus on "what is due the landlord under the terms of the Lease," ilL. at 830. Here quite clearly. the landlord is due ninety (90) days rent based on Plaintiffs early termination of the Lease.
