GOLDEN, Defendant TEMPORARY PROTECTIVE ORDER AND NOW, this ~day of June, 1994, upon presentation and consideration of the within Petition, and upon finding that the plaintiff, LORI A. GOLDEN, and her minor children, now residing at 114 South Bedford Street, Carlisle, Cumberland County, Pennsylvania, are in immediate and present danger of abuse from the defendant, ALAN L. GOLDEN, the following Temporary Order is entered. The defendant, ALAN L. GOLDEN, now residing at 16 Betty Nelson Trailer Court, Lot 11, Carlisle, Cumberland county, Pennsylvania, is hereby enjoined from physically abusing the plaintiff, LORI A. GOLDEN, or her children, or placing them in fear of abuse and is excluded from the residence located at 114 South Bedford Street, Carlisle, Cumberland county, Pennsylvania, a residence which is jointly leased by the parties, and from which the defendant moved on May 28, 1994. The defendant is hereby notified that if he resides in the plaintiff's domicile contrary to this Order, he may be in indirect criminal contempt which is punishable by a fine not to exceed $1,000.00 and/or by a sentence of up to six months in jail and any other appropriate punishment. Resumption of co-residence on the part of the plaintiff and defendant shall not nullify the provisions of the Court Order directing the defendant to refrain from abusing the plaintiff. Tomporary custody of ALICIA GOLDEN and REBECCA GOLDEN, is hereby awarded to the plaintiff, LORI A. GOLDEN. The defendant is ordered to refrain from having any contact with the plaintiff including, but not limited to, restraining the defendant from entering the plaintiff's place of employment, from harassing or stalking the plaintiff, and from harassing the plaintiff's relatives. This Order shall remain in effect until a final order is entered in this case. A hearing shall be held on this matter on the / 7 c.<- day of June, 1994, at / I, /) . m. in Courtroom No. I ,cumberland County courthouse, Carlisle, Pennsylvania. The plaintiff may proceed in forma pauperis pending a further order after the hearing. The Cumberland County Sheriff's office shall attempt to make service at the plaintiff's request, but service may be accomplished under any applicable rule of civil Procedure. The Carlisle Police Department will be provided with a copy of this Order by attorneys for plaintiff. This Order shall be enforced by any law enforcement agency where a violation occurs by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not LORI A. GOLDEN, Defendant PETITION FOR PROTECTIVE ORDER AND CUSTODY RELIEF UNDER THE PROTECTION FROM ABUSE ACT 23 P.S. SECTION 6101 A. ABUSE 1. The plaintiff is an adult individual whose permanent address is 114 South Bedford Street, Carlisle, Cumberland county, Pennsylvania, 17013. The plaintiff brings this action for herself and on behalf of her minor children. 2. The defendant is an adult individual residing at 16 Betty Nelson Trailer court, Lot 11, Cumberland county, Pennsylvania, 17013. 3. The defendant is the plaintiff's husband. 4. Since 1992, the defendant has attempted to cause and has intentionally, knowil~ly, or recklessly caused bodily injury to the plaintiff and her children, and by physical menace has placed the plaintiff and her children in fear of imminent serious bodily injury. This has included but is not limited to the following specific instances of abuse: a. On or about May 22, 1994, while the plaintiff, who is three months preganant, and defendant were arguing, the defendant grabbed the plaintiff by her shirt, scratched her, pulled her toward himself, told her to shut up, and threw her forcefully to the floor. The plaintiff got up and attempted to leave the residence, but each time he blocked her exit with his body. b. On or about March 15, 1994, the defendant grabbed the plaintiff by the shirt with both hands, threw her onto the bed, and lay across her, restraining her from getting up. When the plaintiff attempted to get away, the defendant grabbed her by the throat and threw her back down onto the bed. The defendant then held the plaintiff on the bed applying pressure to her throat and threatened to kill her. c. On or about February 1, 1994, while the plaintiff was sitting in a chair, the defendant leaned down over her, restraining her from getting, and threatened her saying, "Keep bugging me and YOU'll know what it's like to be abused; If I ever do punch you hard, you will be in the hospital or dead." d. In the last two years, the defendant has abused the plaintiff in ways inClUding, but not limited to, the following: Shoving, throwing, restraining, choking, punching, and slapping the plaintiff. e. Approximately two years ago, while the plaintiff was pregnant, the defendant slapped her in the eye with such force, she could not see for a period of time. f. The defendant has abused the children in ways inClUding, but not limited to, slapping the 4 year old with enough force to cause a bloody and lacerated lip several times and hitting the children in the back, causing welts. Approximately two years ago, while the child was 2 years old, the defendant threw an aluminum bat at the child, hitting him in the crotch, and when the plaintiff intervened to protect the child, the defendant kicked the plaintiff in the back, causing her to hit the wall and hit her head on the door. Approximately three weeks ago, the defendant forcefully poured a bottle of Jack Daniels whiskey into the 4 year old child's mouth, causing him to choke. The defendant also puts alcohol in the children's juice cups, causing the plaintiff to fear for their safety. 5. The plaintiff believes and therefore avers that she and her children will be in immediate and present danger of abuse from the defendant should she remain in the home without the defendant's exclusion, and that she and her children are in need of protection from such abuse. 6. The plaintiff desires that the defendant be restrained from entering her place of employment, having any contact with her, harassing or stalking the plaintiff, and from harassing the plaintiff's relatives. B. TEMPORARY CUSTODY 7. The plaintiff seeks temporary custody of the following children: ~ Present Residence Agg ALICIA M. GOLDEN 114 S. Bedford Street Carlisle, PA 18 mos. in this or any other Court. 9. The plaintiff has no knowledge of any custody proceedings concerning these children pending before a court in this or any other jurisdiction. 10. The plaintiff does not know of any person not a party to this action who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 11. Tho best interests and permanent welfare of the children will be met if custody is temporarily granted to the plaintiff pending a hearing in this matter for the following reasons: a. The plaintiff is a fit parent who can best take care of her children. b. The defendant has shown by his abuse of the petitioner that he is not an appropriate role model for the children. c. The defendant's behavior toward the children has adversely affected them. d. The plaintiff has been the primary caretaker of the children. C. EXCLUSIVE POSSESSION 12. The home from which the plaintiff is asking the Court to exclude the defendant is rented in the names of LORI and ALAN GOLDEN, and from which the defendant has moved on Hay 28, 1994. 13. The plaintiff currently has no place to stay with her three children except the marital home, and the defendant has family and friends in the area with whom he can stay. D. SUPPORT. SECTION 14. The defendant has a duty to support the plaintiff and their minor children. 15. The defendant is employed as a roofer and the plaintiff is unaware of his salary. 16. The plaintiff currently has no income. 17. The plaintiff intends to petition for support within two weeKs of the issuance of a protective order. E. ATTORNEY FEES 18. The plaintiff aSKs for attorney fees to be paid to Legal Services, Inc. pursuant to the Protection from Abuse Act. F. STATUS TO PROCEED IN FORMA PAUPERIS 19. The plaintiff does not have funds available to pay the fees for filing and service. WHEREFORE, pursuant to the provisions of the "protection from Abuse Act" of October 7, 1976, 23 P.S. Section 6101 n iM., as amended, the plaintiff prays this Honorable court to grant the following relief: A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:" 1. Requiring the defendant to refrain from abusing the plaintiff and her minor children or placing them in fear of abuse. 2. Requiring the defendant to refrain from haviny any contact with the plaintiff, including, but not limited to, restraining the defendant from entering the plaintiff's place of employment, from harassing or stalking the plaintiff, and from harassing the plaintiff's relatives. 3. Granting temporary custody of the minor children to the plaintiff. 4. Granting possession of the apartment located at 114 s. Bedford street, Carilsle, to the plaintiff to the exclusion of the defendant pending a final order in this matter. 5. Ordering the defendant to stay away from any residence the plaintiff may in the future establish for herself . B. Schedule a hearing in accordance with the provisions of the "Protection from Abuse Act," and, after such hearing, enter an order to be in effect for a period of one year: 1. Requiring the defendant to refrain from abusing the plaintiff or her minor children or placing them in fear of abuse. 2. Requiring the defendant to refrain from having any contact with the plaintiff, including, but not limited to, restraining the defendant from enteri,ng the plaintiff's place of employment, from harassing or stalking the plaintiff, and from harassing the plaintiff's relatives. 3. Granting possession of the apartment located at 114 S. Bedford street, Carlisle, to the plaintiff to the exclusion of the defendant. 4. ordering the defendant to stay away from any residence the plaintiff may in the future establish for herself. 5. Granting support to the plaintiff in the amount of ~40.00 per week payable by mail. 6. Ordering the defendant to pay attorney fees to Legal Services, Inc, pursuant to the Protection From Abuse Act. The plaintiff further asks that this Petition be filed and served without payment of costs, pending a further order at the hearing, and that a copy of this Petition and Order be delivered to the Carlisle Police Department as the police Department with jurisdiction to enforce this Order. The plaintiff prays for such other relief as may be jupt and proper. COUNT II CUSTODY UNDER PENNSYLVANIA CUSTODY LAW 20. The allegations of Count I above are incorporated herein as if fully set forth. 21. The best interests and permanent welfare of the children will be served by confirming custody in the plaintiff as set forth in Paragraph 11 of the Petition. WHEREFORE, pursuant to 23 P.S. GOLDEN, Defendant I IN THE COURT OF COMMON PLEAS OF I CUMBERLAND COUNTY, PENNSYLVANIA I I I I I I I I I PROTECTION FROM ABUSE AND CUSTODY I NO. 94-3101 CIVIL TERM IN REI INDIRECT CRIMINAL CONTEMPT ORDER OF COURT AND NOW, this 5th day of July, 1994, after hearing the Court finds by clear and convincing evidence that the Defendant did on the morning of July 4th, 1994, around 12130 a.m. take his brother to his wife's residence, which he was prohibited from entering, knowing that his brother was going to go into the house at that time in the morning and attempt to allegedly get furniture out of the house. The Court finds that this course of conduct would be harassment as prohibited under the protection from abuse order that I entered on June 9th, 1994. The Defendant has been in jail since the morning of July 4th, 1994.
