the mortgage on the marilal rcsldence, The Petltioncr had prcvlously moved from the marital
resldcnce prior to this henrlnll date, Attachcd as Exhibit "A" is a copy of said allreemcntlllade
throullh Ihe Domestic Relations Ollicc,

On or about September 14, 1995, counsel for the I)ctltloner received notice from counsel
for the Respondent that Ihe Respondenl had moved out of the marital residence, will no longer be
paylnllthe maritalmortgalle. and rcquested a follow-up hearinll al Domeslic Relations which ia
currently scheduled for OClober 17,1995,

On or aboul September 21, 1995, the Petitioner was notified by the 1Il0rtgage company
that the 1Il0rtgalle payment due on Septcmber 1, 19Q5 wa8 pasl due, and that if a paymenl was not
received by Oclober I, 1995, thai foreclosure proccedlnlls would be initiated,

On or about June 14, 1995, prior to the Respondent removing hhnself from the marital
residence, the parties agreed to and listed the residence for sale with Century 21 Associates,
Hooke, Coon & Diehl in an effort to resolve the economic Issues pending,

The Respondent made no Indlcution that he would be moving out of the residence at the
time the home was listed for sale; the Respondent had an adequate place In which to reside, and
chose to leave the residence with no notice to the Petitioner; the Respondent had previously
agreed to pay the marital mortgage on the marital residence; and the Respondent is continuing to
collect the rental payments from the tenants currently residing In the residence and is not
contributing this money toward the mortgage,

I.) Issue an Order directing the Respondent to continue paying the mortgage on the
marital residence; Dnd
2,) Order the Respondent to pay any balance owing on the marital mortgage; and
3.) Order the Respondent to nnd suitable tenants to occupy the space the Respondent
previously occupied and to apply all monies received us rent towurd the mortguge,

Inasmuch as the issue of grounds for divorce is going to
be resolved with a petition for bifurcation agreed to by the
parties, I am going to proceed with a directive to rile
pre-trial statements relating to the economic iS8ues.
The complaint in divorce filed on June 9, 1994, raises
the economic claim of equitable distribution. No other economic
claims have been raised in the action.
In accordance with P.R.C.P. 1920.33(b) I am directing
each counsel to file a pre-trial statement on or before Friday,
August 11, 1995. Upon receipt of the pre-trial statements I
will immediatelr schedule a pre-hearing conference with counsel
to discuss the ssues and, if necessary, schedule a hearing.

collector quality, and, therefore, has not

48. The real estate known and numbered as 117-119 Second
Street, Boiling springs, Pennsylvania, is lieted for sale with a
listing price of $117,000. Husband does not believe that it is
liksly that the property will sell at anywhere near the lieting
prioe. Husband believes that after payment of the customary
olosing costs, the two loans in the respective amounts of $56,000
and $40,000 and the other marital dehts, there will be little, if
any, net equity. Any net equity in the real estate is to be
divided 50\ to the parties hereto and 50\ to Husband's mother
undsr the terms of a written Partnership Agreement for the reason
that Husband's mother pledged her home as collateral for the loan
of $40,000 which formed the down payment for the property.
49. Hueband believes that Wife has an employee pension and
othsr employee benefit accounts. Those aocounts were not listed
in Wif.'s Inventory and Appraisement, and Husband haa no idea aa
to their values.

IV, HUSBAND'S EXPERT WITNESSES
Assuming that disposition of the real estate will be on the
basis of its sale and the division of any net proceeds according
to fractions to be dbtermined by the Master, there will be no
need for expert testimony concerning the value of the real
estate. Husband reservss the right to call witnesses concsrning
the present value of Wife'e employee pension and other benefit
accounts upon receipt of the necessary information to calculate
the values of such accounts.
V. NON.EXPERT WITNESSES
Husband wi 11 be testifying in his own behalf. He may also
call his mother to testifY in the event of any disputes
concerning oral agreements with respect to the acquisition of the
marital real estate.
Husband reserves the right to present the testimony of any
non-expsrt or expert witnees listed in the Pre-Trial statement of
the other party herein or in any other document filed in this
matter.
Husband reserves the right to present any impeaching or
contradicting evidence which may be necessitated by testimony of
the other party herein or witnesses of the other party herein.

VI, EXHIBITS
Husband will be introducing reoords ot the management ot the
real estate partnership ot the parties to show that the property
has always operated at an actual loss.
Husband will also introduce evidence of his payments on
account of the joint Sears credit obligations from the date of
separation to the date of the hearing.
Husband rAserves the right to introduce any exhibits which
may become pertinent on the basis of disclosures of Wite with
respect to her employee pend on and other employee benefit
accounts.
VII. INCOME
Wife earns in excess of $20,000 plus benefits trom her
employment in a medical office. Husband's occupation is as a
part-time real estate agent on an independent contractor basis
and as a self-employed musician without benefits. Husband's
earnings fluctuate, but they average less than the earnings of
Wite. Wife has signed joint federal income tax returns which
confirm that her earnings exceed the earnings of Husband.
VIII, EXPENSES
Husband believes that neither party has any extraordinary
expenses which would justify the preparation and submission of
Income and Expense statements in this case. Husband would

stipulats that he has no extraordinary expenses which would have
any bearing on his claims for equitable distribution or alimony.
IX. PENSION
Husband has no pension or other tax-deferred accounts.
Husband has not yet received information concerning Wite's
employee retirement and other benetit accounts.
X. COUNSEL FEES
It ie Husband's position that neither party has a olaim for
counsel fees against the other.
XI. TANGIBLE PERSONAL PROPERTY
Although the present division of tangibls personal property
would give Wife the greater value, Husband is satistied to accept
the present division of tangibl~ personal property in kind as an
appropriate equitable division of all tangible personal property.
XII, PROPOSED RESOLUTION
Husband's dats of birth is December 23, 1946, and Wite's
date of birth is June 21, 1957. Therefore, Wife is significantly
younger than Husband and more advantageou81y employed than
Husband. But for the traditional assumptions of male
independence, Husband would have an excellent claim for more than
half the marital property.
The partiss lived in marital cohabitation for lsss than ten
years. There were no childrsn born of the marriags. The factors

of age, health, station, amount and sources of income, vocational
Skills, employability, estate and liabilities all favor Wife.
Neither of the parties made any contributions to the
education of the other.
Due to her significantly greater work life expectancy, Wife
has a significantly greater opportunity for future acquisitions
of capital assets and income.
since the separation of the parties, Husband has preserved
the major marital asset in the form of the real estate by
devoting all of his limited resources in excess of the proceeds
of sale of the chevrolet truck to the obligations with respeot to
that property, in preservation of the good oredit ratings of the
parties.
There are no non-marital aesete or post-separation
accumulations Which would be sufficient to constituts a
signifioant factor in equitable dietribution.
'l'he standard of living of the parties established during the
marriage was basic, middle class.
The economic circumstances of the parties at the present
time is such that Wife'S circumstances are preferable to those of
Husband.
We would simply propose that, upon sale of the real estate
and division of the net prooeeds with Husband's mother, all
marital debt be liquidated and any net proceeds be divided

equally between the parties. We would further suggest that there
is no basis for awards of ali~ony or counsel fees.
XIII. TIME NECESSARY
Assuming division of the proceeds of sale of the real estate
on the basis of liquidation and an agreed valuation of Wife's
employee pension and other employee benefit accounts, we would
see no reason why this case should not be resolved at pre-trial
conference.
XIV. STATUS OF SETTLEMENT NEGOTIATIONS
Settlement negotiations are stalled on the basis of Wife's
demand for a cash settlement in spite of her more favorable
financial circumstances.

THE MASTER I Today is Wednesday, November B, 1995,
the date soheduled for a Master's pre-hearing oonference on the
pre-trial statements which have been filed by counsel.
After
discussion with counsel, the Master has been advised that an
agreement has been reached with respect to the economic olaim of
equitable distribution.
A divorce complaint was filed on June 9, 1994. The
complaint raised grounds for divorce of indignities and although
the oaption indicated that irretrievable breakdown was to be
raised, the complaint inadVertently did not include a count or
olaim for divorce under section 3301(c) of the Divorce Code.
Therefore, Mr. McKnight has indicated that he will file
expeditiously an amended complaint raising irretrievable
breakdown of the marriage so that a divorce can be conoluded by
the filing of the mutual affidavits of consent. Those
affidavits of consent signed by each party were previously filed
on August 1B, 1995, so all we need to do is get the pleadings
amended to be consistent with the filed affidavits so that the
divorce can proceed under section 3301(c).
As indicated previously, the divorce complaint did
raise the economic issue of equitable distribution. Although
the motion for appointment of Master indicated there are other
economic claims at issue, it appears that the only claim raised
is equitable distribution and counsel are satisfied that that is
the only economic issue which needs to be resolved and that no
further economic claims are intended to be raised.
Marianna Calaman is represented by Marcus A.
McKnight, III, and G. Arthur Calaman is represented by Johnna J.
Deily. Ms. Deily is appearing in the action today on behalf of
Mr. Calaman although previously Attorney Wayne F. Shade was
counsel of record for Mr. Calaman. Mr. Shade's office has
apparently prepared the appropriate documents to allow him to
withdraw and Ms. Deily is appearing on behalf of the Defendant.
Ms. Deily has provided the Master with a praecipe entering her
appearance on behalf of Mr. Calaman which was filed on November
6, 1995, which will be made part of the file.
The parties in this action were married on July 31,
1984, and separated May 22, 1994. There are 110 children born of
the marriage.
In the hearing room today are the attorneys
representing the parties and Mr. Calaman. Mrs. Calaman is not
present but will be available Inter on today to review the
agreement that we are going to place on the record. Therefore,
inasmuch as both parties are not present, the agreement that
will be stated on the record will not be considered the
agreement of the parties until the agreement has been reviewed
by counsel and the parties later on today and signed by both
parties and counsel.
After the agreement has been reviewed and signed,
the Master will prepare an order vacating his appointment.
Counsel can then, after the amended complaint has been filed,
file a praecipe transmitting the record based on the agreement
and the grounds for divorce of irretrievable breakdown of the
marriage utilizing the consents which have been previously filed
by counsel. Mr. McKnight.
MR. McKNIGHT I
1. As expressly understood by the parties, there will be
no support or alimony payments due by either party to the
other, and all such claims will be extinquished
by the entry of a divorce decree; each party will be
responsible for their own legal fees but each will pay
one half of the cost of the transcript of this agreement.
2. Pursuant to the terms of the agreement, equitable
distribution will be resolved as followsl
a) Wife will convey her interest in the marital
residence to husband by a deed within thirty (30)
days of the date of this agreement.
b) Husband will pay to the wife the sum of
$2,000.00 within thirty (30) days of the date of
this agreement.
c) It is expressly understood that if either party
fails to do these actions that they will be subject
to contempt proceedings if these items are not
taken care of within thirty (30) days.
d) Wife will retain all her right, title, and Interest
e)
to her peneion and other employee benefite at her
place of employment and husband waives any right,
title, or interest in wife'e pension or her
employee benefits.
The parties agree that they have divided up all of
their personal property and that each is satisfied
with the property in their own possession and they
waive any claim to any property in the possession
of the other as well as any personal property
disposed of by the other party. From this date
forward, it is expressly understood that husband
will be solely responsible for all expenses
associated with the marital residence.
Husband agrees to be solely responsible for hi.
automobile loan on his Cadillac automobile as well
as for the Sears charge account that is in the
names of both of the parties. In addition, husband
agrees to hold harmless and indemnify wife from any
costs, legal fees, or expenses associated with the
first mortgage which is currently in default on the
marital residence and he agrees to be solely
responsible for repayment of any loan due to his
mother. Husband also agrees to sign over the title
to the automobile currently owned by the wife Which
is a 1984 Plymouth Voyager.
3. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each
party hereby waives and relinquishes any and all rights
he or she may now have or hereafter acquire under the
present or future laws of any jurisdiction to share in
the property or the estate of the other as a result of
the marital relationship including without limitation,
statutory allowance, widow's allowance, right of
intestacy, right to take against the will of the other,
and right to act as administrator or executor in the
other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
whioh may be necessary or advisable to carry into effect
this mutual waiver and relinquishment of all such
interests, rights, and claims.

TilE MASTERl Mr. Calaman, you've heard the
agreement stated on the record. Do you understand it?
HR. CALAHAN I Everything except eome of what the

THE HASTERI All right. The last part has to do
with the release of each of you in the estate of the other In
the event that there is a death prior to the entry of a divorce
decree.
HR. CALAHAN I Okay. I see.
TilE HASTER: Otherwise, you understand all of the
terme of the agreement?
HR. CALAHAN I Yes.
TilE HASTER I And you are satisfied with the
agreement?
HR. cALAHAN I Yes.
THE HAflTER: And you understand that since your
wife was not present here today that we need to have her review
and accept the terms of the agreement before the agreement Is
viable?
HR. CALAHAN I Absolutely.
I acknowledge that I have read the above
stipulation and agreement, that I understand ths terms of
settlement as set forth herein, and that by signing below I
