Whereas, on the 1st Day of ,Juno, 1994 an Agreement was entered
into between Smith, Elliot, Keollls ~ Co. hereinafter called,
Owner, and the above contracting firm, hereinafter called Contractor,
wherein and whereby said Contractor undertook and agreed to
build upon the property New Facility Ii. BuUd-out Space
said Owner, located 19 Brookw(xJC) Avenue, Carlislo, PA 17013.
NOW, therefore, this agreement witnesseth, that the said Contractor
for and in consideration of the sum of One Dollar ($1.00) to him in
hand paid by the said Owner, receipt whereof is hereby acknowledged,
for himself, and his sub-contractors, and all parties acting through
or under him, covenants and agrees that no mechanics liens or claims
shall be filed or maintained by him, them or any of them against
the said bUilding and the lot of ground appurtenant thereto, for
or on account of any work done or materials furnished by him, them,
or any of them under said contract, or otherwise, for, towards, in
and about the erection and construction of said building, and the
said Contractor, for himself and his sub-contractors, and others under
him, hereby expressly waives and relinquishes the right to have, file
or maintain any mechanics liens or claims against the said building
and agrees that this agreement waiving the right of lien shall be an
Independent covenant.
IN WITNESS WHEREOF, the Parties have hereunto set their hands and
seals t~~ day and year first above written.
