says he made diligent search and inquiry for the within named defendants
to wit: James H. Prescott and Judith Ann Prescott, but was unable to
locate them in his bailiwick. He therefore deputized the Sheriff of
Allegheny County to serve the within Complaint in Mortgage Foreclosure
and Notice according to law.
ALLEGHENY COUNTY RETURN:I hereby certify and return that on June 22,
1994 at 3:00 o'clock P.M. at 500 Reamer Avenue, Carnegie, Manager/Clerk
of place of lodging in which defendants reside George Parks

AND NOW, comes Plaintiff York Federal Savings and Loan
Association, by and through its attorney, Rebecca S. McClure, and
complains of Defendants James H. Prescott and Judith Ann Prescott,
as follows,
Parties
1. The Plaintiff is the YORK FEDERAL SAVINGS AND LOAN
ASSOCIATION, a corporation organized and existing under the laws of
the United States of America, and it is registered to do busine88
in Pennsylvania, with offices for the purpose of doing busine88 at
101 South George Street, York, Pennsylvania.
2, One of the Defendants ie JAMES H. PRESCOTT, who i8 an
adult individual residing at 500 Reamer Avenue, Carnegie, Allegheny
County, Pennsylvania 15106 and he is a mortgagor and real owner of
the Mortgaged Premises located at 23 Bayberry Drive, Mechanicsburg,
Cumberland County, Pennsylvania 17055, haVing acquired title by
Deed dated August 10, 1999, and recorded on August 17, 1998, in the
Cumberland County, Pennsylvania, Recorder's Office in Record Book
N33, Page 142.
3. One of the Defendants is JUDITH ANN PRESCOTT, who is an
adult individual residing at 500 Reamer Avenue, Carnegie, Allegheny
County, Pennsylvania 15106 and she is a real owner of the Mortgaged
Premises located at 23 Bayberry Drive, Mechanicsburg, Cumberland
County, Pennsylvania 17055, haVing acquired title by Deed dated
August 10, 1988, and recorded on August 17, 1989, in the Cumberland
County, Pennsylvania, Recorder's Office in Record Book N33, Page
142.
Mortaage
4, On or about July 29, 1988, Defendant JAMES H. PRESCOTT
made, executed, and delivered to Plaintiff a mortgage upon premises
therein described, which Mortgage contains a description of the
premises subject to said Mortgage and was recorded on August 2,
1988, in the Cumberland County, Pennsylvania, Recorder's Office in
Mortoaoe Book 912, paoo 337. A truo and correct copy of said
Mortoaoe is attached hereto, made A part hereof, incorporated
herein by reference, and marked "EXIIIIHT A".

5. There have been no assignments of said Mortgage,

6. Said Mortgage 10 in defftul t because Defendant JAMES If.
PRESCOTT has failed to make the monthly payments of principal and
interest due and owing on his loan from February 1, 1992, through
the dAte of filing this Complaint as required by the terms of the
Mortgaoe. Any payments that may have been made during this period
were applied to the delinquency balance due and owing prior to
February 1, 1992.
7. Plaintiff hereby exerc10es its option to declare the
entire amount owing upon said Mortgage immediately due and payable
in Accordance with its terms and provisions.
