law, says that on ,June 16, 1994 at 2120 o'clock P.M., E.D.S.T., he served a
true copy of the wi thin Heissued Summons in Civi 1 Action Law, in the above
entitled action, upon the within named defendant, to witl Thomas Rhen, II,
by making known unto Thomas Hhen, Fathel- of Thomas Rhen, 11, at 131 Shatto
Drive, Carlisle, Cumberland County, Pennsylvania, its contents and at the same
time handing to him personally the said true and attested copy of the same.
R. Thomas Kline, Sheriff, who being duly sworn according to law,
says that he served the above Summons in Civi 1 Action Law in the following
mllnner! The Sher if f mail ed one of the w Hhi n named defendants, to wit I
Tonya R. Murray, a notice of the pendency of the action by certified mail, to
her last known address at 1040 E. Whipp Road, Centervill, 011 45459. This
letter was mailed under the date of June 15, 1994. Letter was recieved by
Tanya R. Murray on June 18, 1994 with return receipt card signed by Regina
Canei. Return receipt card is hereto attached.
R. Thomas Kline, Sheriff, who being duly sworn according to law,
says that he made diligent search and inquiry for the within named defendant,
to witl Delbert J. and Doris J. Keiter, but was unable to locate them in his
bailiwick. lie therefore deputized the SherJff of Schuylkill County, Pennsylvllni/S
to serve the within Reissued Sunnons in civil Action Law according to lllw.

~PLAIHT
AND NOW comes Plaintiffs, Robert A. Canei and Rsgina R. Canei,
by their attorneys, Purcell, Krug " lIaller, and files the following
Complaint and in support there of aver as follows I
1. Plaintiffs, Robert A. Canei and Regina R. Canei, are
adult, married individuals residing at 2165 Sherringham Road,
Columbus, Ohio 43220.
2. Defendant, Thomas Rhen, II, is an adult individual
residing at 131 Shatto Drive, Carlisle, Cumberland County,
Pennsylvania 17013.
3. Defendant, Tonya R. Murray, is an adult individual
residing at 1040 East Whipp Road, Centerville, Montgomery County,
Ohio 45459.
4. Defendant, Delbert Keiter, is an adult individual
residing at 226 Wisconsico Avenue, Tower City, Schuylkill County,
Pennsylvania 17980.
5. Defendant, Doris Keiter, is an adult individual residing
at 266 Wisconsico Avenue, Tower City, Sohuylkill County, Pennsylvania
17980.
6. On July 26, 1992, at approximately 1150 P.M., Plaintiff
Regina R. Canei was a passenger in a 1991 Ford Explorer driven by
Defendant Murray, traveling northbound on Interstate B1 in East
Hanover Township, Lebanon County, Pennsylvania (hereinafter "the
Murray vehicle").
7. The Murray vehicle proceeded on to the off ramp at Exit
29E from Interstate B1 behind the vehicle operated by Defendant Doris
Keiter and owned by Defendant Delbert W. Keiter, who was present in
the vehicle.
B. Immediately behind the Murray vehicle on the ramp was
Defendant Rhen, who was traveling in a 19B7 Chevrolet Nova.
9. Shortly after entering the ramp, the Keiter vehicle
suddenly and without reason, signal or other warning stopped in the
middle of the ramp.
10. Defendant Murray struck the rear of the Keiter vehicle.
11. After striking the Keiter vehicle, the Murray vehicle was
struck from behind by Defendant Rhen.
12. It is believed and therefore averred that Defendant Doris
Keiter was aware of vehicles following her but stopped in the middle
of the ramp because she and her husband, Defendant Delbert Keiter,
realized they had gotten off at the wrong exit.
13. After the impact with the Keiter vehicle, Regina R. Canei
placed her right hand on the dashboard to brace and protect herself.
14. As a result of the initial impact and being etruck from
behind by the Rhen vehicle, Regina R. Canei's right arm and shoulder
were jammed between the seat and the dashboard.

lS. As a result of Defendants' negligently combined actions
in causing and exacerbating her injuries from this accident, Regina
R. canei has Buffered severe, serious and permanent physical
injuries, including but not limited to tears in her right biceps
tendon and right rotator cuff, neck pain, post-traumatic headaches,
and post-traumatic bursitis.
16. As a result of Plaintiff Regina R. Canei's injuries, she
has incurred and will in the future incur significant expense for
medical and other treatment and she will be obliged to continue to
expend monies and incur such expenditures for an indefinite time in
the future to treat her injuries, pain and mental and physical
restrictions.
17. As a further proximate result of Defendants' negligence,
Plaintiff Regina R. Canel has sustained loss of earnings, mental
anguish, and emotional distress, some or all of which may be
permanent or continue indefinitely into the future.
lB. In addition, Plaintiff Regina R. Canei has sustained and
will sustain in the future great pain and suffering.
19. As a further result of this accident and the injuries
suffered therefore, Plaintiff Regina R. Canei, has been prevented
from attending to her usual duties, occupations and past times.
20. The aforesaid injuries resulting from the accident will
permanently interfere with Plaintiff Regina R. Canei's enjoyment of
life's pleasures.

COURT I - NEOLIOENCE
RlOINA R. CARlI VI. DELBERT W. KEITER and DORIS KIITIR
21. Plaintiffs incorporate herein by reference the averments
of Paragraphs 1 through 20 as if more fully set forth at length.
22. At the tims of the accident, Defendant Delbert w. Keiter
was a passenger in the vehicle owned by him and operated by Doris J.
Keiter, and it is further believed and therefore averred that Doris
Keiter was acting as her husband's authorized agent within the scope
and authority of her agency at the time of this accident.
23. As the owner of the vehicle, Defendant Delbert W. Keiter
had control over Doris J. Keiter's operation of the vehicle.
24. It is further believed and therefore averred that
Defendant Delbert W. Keiter either told Defendant Doris J. Keiter to
stop because they were at the wrong exit or consented to her stopping
the vehicle in the middle of the ramp.
25. As such, Defendant Delbert W. Keiter is also liable for
the negligence of his driver, Doris J. Keiter.
26. Defendants Delbert W. Keiter and Doris J. Keiter were
negligent in that Doris J. Keiterl
a) Suddenly stopped her vehicle without legitimate
purpose in the middle of the roadway without signalling or
warning following drivers, in violation of 75 Pa. C.S.A.
533511
b) Failed to operate her vehicle safely, keeping in mind
the preBence and safety of other vehicles on the roadway 1

c) Failed to pull off the ramp onto the berm before
stopping, and
d) Failed to reasonably warn following drivers of her
intent to stop on the roadway prior to doing so.
WHEREFORE, Plaintiff Regina R. Canei respectfully requests
that this Honorable Court enter judgment against Defendants Doris
Keiter and Delbert W. Keiter for unliquidated damages exceeding the
jurisdictional amount requiring arbitration, plus the costs of this
action and interest from the date of jUdgment.
COUNT II - NEGLIGENCE
REGINA R. CAlfII v.. TOHYA R, MURRAY
27. Plaintiffs incorporate herein by reference the averments
of paragraphs 1 through 20 as if more fully set forth at length.
28. Defendant Murray was negligent in that she failedl
al To maintain a proper lookout for vehicles ahead,
b) To maintain proper control over her vehicle,
c) To stop her vehicle within the assured, clear
distance ahead.
d) To operate her vehicle safely, keeping in mind the
presence of other vehicles on the roadway,
e) To maintain her concentrated vision on what was ahead
of her, in the direction of her travel,
f) To operate her vehicle at a safe speed under the
circumstances,
g) To drivo attentively, and

h) To operate her vehicle within the posted ramp speed.
WHEREFORE, Plaintiff Regina R. Canei respectfully requests
that this Honorable Court enter judgment against Defendant Murray for
unliquidated damages exceeding the jurisdictional amount requiring
arbitration, plus the costs of this action and interest from the date
of judgment.
COUNT III - NEGLIGBNCE
REGINA R. CANEI va. THOMAS RHIN. II
29. Plaintiffs incorporate herein by reference the averments
of paragraphs I through 20 as if more fully set forth at length.
30. Defendant Rhen was negligent in that he failed I
al To maintain a Froper lookout for vehicles ahead;
b) To maintain proper control over his vehiole;
c) To etop his vehiole within the assured, olear
distance ahead;
d) To operate his vehiole safely, keeping in mind the
presence of other vehicles on the roadway;
e) To maintain his concentrated vision on what was ahead
of him, in the direction of his travel;
f) To operate his vehiole at a safe speed under the
circumstances;
g) To drive attentively; and
h) To operate his vehicle within the posted ramp speed.
WHEREFORE, Plaintiff Regina R. Canei respectfully requests
that this Honorable Court enter judgment againet Defendant Rhen for

unliquidated damages exceeding the jurisdictional amount requiring
arbitration, plus the costs of this action and interest from the date
of judgment.
COUNT II - LOSS or CONSORTIUM
ROBIRT A. CAMEl VS. THOMAS RHIN, II, TONIA R. NURKAI,
DILBIRT W. KIITIR and DORIS KIITIR
31. Plaintiffs incorporate herein by reference the averments
of Paragraphs 1 through 30 as if more fully set forth at length.
32. As a result of Defendants' negligent actions, Plaintiff
Robert A. Canei lost the society and companionship of his wife,
Regina R. CaneL
WHEREFORE, Plaintiff Robert A. canei respectfully requests
that this Honorable Court enter judgment against all Defendants,
joint and severally, in an amount exceeding the jurisdictional amount
requiring arbitration, plus the costs of this action and interest
from the date of judgment.

AND NOW, comes the Defendant, Tonya Murray, by and through her allomeys,
MARTSON, DEARDORPP, WILUAMS & OTIO, and hereby petitions the Court as follows:
I. TIle above captioned action was started by a Praecipe for a Writ of Summons on
June 10, 1994. A Writ of Summons was issued on said date.
2, No effort was made to have the Writ of Summons served on any of the
Defendants.
3. No Affidavits of Service were ever filed wilh regard to thc Praecipe for Writ of
Summons or thc Writ of Summons.
4. On July 21, 1994, Plaintiffs filed a Praecipe to Reissuc said Writ of Summons.
5. It appears that said Writ of Summons was reissued on July 21, 1994.
6. TIte docket does not Jndlcale that the rcissued Writ of Summons was ever served
on any of thc Defendants.

34, If the Plaintiffs did Bustain the damages, injuries and
losseB which are alleged in the Plaintiffs' Complaint, Plaintiffs'
damages, injuries or losses were caused solely by the negligence or
wrongful conduct of Defendants Thomas Rhen, II, and Tonya Murray.
35, In the event that the Defendants, Delbert W. Keiter and
Doris J, Keiter, are found to be liable to the Plaintiffs, which
liability is denied, for the injuries alleged to have been
sustained, then in that event, Defendants, Delbert W, Keiter and
Doris J, Keiter, assert that they are entitled to judgment against
Defendants, Thomas Rhen, II, and Tanya Murray, for contribution and
indemnity.
WHEREFORE, Defendants, Delbert W. Keiter and Doris J. Keiter,
request that the Plaintiffs' Complaint be dismissed,
Alternatively, Defendants request that judgment be entered solely

protect his right of contribution and/or indemnity, if it is
determined that Defendant Rhen and Defendant Keiter are jointly or
severally liable to Plaintiffs, the existence of any liability on
the part of Defendant Rhen being expressly denied.

(b) Defendant Rhen joins Defendant Delbert W. Keiter to
proteot his right of oontribution and/or indemnity, if it is
determined that Defendant Rhen and Defendant Delbert W. Keiter are

WHEREFORE, Defendant Rhen requests that Plaintiffs' complaint
