COMPLAINT COMES NOW, Plaintiff Edwin Bradley, by and through his attorneYB, Arthur T, McDermott and Associates, by Arthur T, McDermott, Esquire, and files this Complaint and states as follows I I, Plaintiff Edwin Bradley resides at 70 Hickorytown Road, Carlisle, Cumberland County, Pennsylvania. 2, Defendant JoAnna A. Ward resides at 440 Bonnymead Avenue, Harrisburg, Dauphin County, Pennsylvania, 3, The incident in question occurred at the intersection of South Hanover and Pomfret Streets in Carlisle, Cumberland County, PennBylvania, 4, On 27 February 1994, Plaintiff was driving his automobile southward on South Hanover Street while Defendant was travelling northward on South Hanover Street, 5, Before reaching the intersection of South Hanover and Pomfret Streets, Plaintiff flashed his left directional signal, indicating that he intended to make a left turn on Pomfret Street. 6. After a traffic police officer BignaUed to drivers travelling northward on South lIanover Street to Btop and after Bignalling Pldintiff to proceed through the interBection and onto Pomfret Street, Defendant failed to obey the traffic police and continued to drive her vehicle through the intersection, 7, Defendant claims she did not see the police officer's signal and that the signal lights were on flashing yellow, 8, As a result of Defendant'B failure to obey the traffic police officer' B direction to stop and in travelling into the intersection under the yellow light Bignal, Defendant failed to recognize and obey Plaintiff's right of way, cauBing Defendant's automobile collide into Plaintiff's vehicle, 9, In failing to obey the traffic officer'B direction to stop and in not recognizing Plaintiff's right of way, Defendant carelessly, reckleBBly, and negligently operated her automobile, 10, As a result of the colliBion, Plaintiff incurred damages in the amount of $2,451,67 plus judgment costs. 'n"~" i ^,,\, " 'ill c; '\ t J l " Y , 'I',~ \ ~ . vs, , IN THE COUR'I' OF COMMON PLEAS OF , CUMBERLAND COUNTY, PENNSYLVANIA , , CIVIL ACTION - LAW , NO, 3177 CIVIL 1994 , , EDWIN BRADLEY, Plaintiff, JOANNA A, WARD, Defendant, ANSWER TO DEFENDANT'S NEW MATTER COMES NOW, Plaintiff, Edwin nradley, by and through hie attor.neYB, Arthur T, McDermott and Associates, by Arthur T, McDermott, Esquire, and fileB this Answer to Defendant's New Matter and states as follows, 12, Parugraph 12 relates to incorporation to which no response iB necessary under the Pennsylvania RuleB of Civil Procedure, 13, Denied, The averments of Paragraph 13 are conclusions of law and/or fact to which no response is necesB8ry under the Pennsylvania Rules of Civil Procedure. 14, Denied, Plaintiff's injuries and damages were proximately caused by the careless and imprudent aots and omissione of Defendant, who entered the intersection of South Hanover and Pomfret StreotB at an unsafe speed and with an obstructed view, 15, Denied, It is denied that the traffic police officer failed to make himself visible to motoristB travelling northbound in the right-hand lane of South Hanover Street, given that the officer was positioned in the middle of the interBection at South lIanover and Pomfret Streets and that Defendant's view W8B obstructed by a truck in the left-hand travelling lane on the northbound side of South Hanover Street, Furthermore, despite the fa~t that Defendant had an obstructed view, Defendant ignored a cautionary flashing yellow traffic signal and darted around the truck and entered the intersection at an unsafe speed, 16, Admitted in part and denied in part, It is admitted that the traffic officer directed Plaintiff to make a left turn onto Pomfret Street, however, it is denied that Plaintiff entered Defendant's path of travel while Defendant had a right of way or while Defendant was clearly visible to Plaintiff, given that Defendant had darted around the truck and entered the interBection at an unsafe speed. 17, Denied, Despite having an obstructed view of the intersection, Defendant acted carelesBly and imprudently in entering at an unsafe speed an intersection with a cautionary flashing yellow signal, WHEREFORE, Plaintiff demands that judgment be entered in his favor againBt Defendant, together with costs and attorney's fees as are appropriate.
