I
4. Defendant Richard A. Schoffstall ("Schoffstall") is
an adult individual now or formerly residing at 114 Ann Street,
Middletown, Dauphin County, Pennsylvania.
5. On or about February 13, 1989, Schoffstall, as
Mortgagor, executed a Mortgage in favor of Commerce, as
Mortgagee, securing the indebtedness of Jan Michalac and John
Michalac, to Commerce evidenced by their Note and Security
Agreement executed February 13, 1989 in the original principal
amount of $10,810.78, plus interest thereon at the rate provided
in the Note and Security Agreement, payable with other charges as
provided therein (hereinafter "the Note"). A true and correct
copy of the Note is attached hereto as Exhibit "A" and made a
part hereof.
6. The said Mortgage was recorded on February 23, 1989
in the Office of the Recorder of Deeds in and for the County of
Cumberland in Mortgage Book 930, at Page 931 (hereinafter "the
Mortgage"). A true and correct copy of the Mortgage is attached
hereto as Exhibit "B" and made a part hereof.
7. The property subject to the Mortgage is described
with particularity therein. The street address is 222 North 2nd
Street, Wormleysburg, Cumberland County, Pennsylvania (the

"Property"). Schoffstall is the present real owner of the
Property.
B. Jan Michalac and John Michalac are joined aB
defendants in thiB action to foreclose any interest they, or
either of them, may have in the Property.
9. Commerce has not assigned the Note or the Mortgage,
either in whole or in part.
10. No judgment has been entered on the Note or the
Mortgage in any jurisdiction. The Note and the Mortgage are leBs
than 20 years old.
11. On January 30, 1990, John Michalac filed hiB Petition
under Chapter 7 of the Bankruptcy Code in the U.S. bankruptcy
Court for the Middle District of Pennsylvania to No. 90-00l3B.
His indebtedness to Commerce was discharged on July 16, 1990.
The mortgage lien was not avoided or stripped and survived the
bankruptcy.
12. On April 20, 1990, Jan Michalac filed a Petition
under Chapter 7 of the Bankruptcy Code in the U.8. Bankruptcy
Court for the Middle District of Pennsylvania to No. 90-00625.
Jan Michalac reaffirmed her debt to Commerce as evidenced by

Order of the u.s. Bankruptcy Court dated January 2, 1991 (the
"Order"). A true and correct copy of said Order is attached
hereto as Exhibit "C" and made a part hereof.
13. The Note and Mortgage are in default because
Defendants have failed to make monthly payments on the Note that
are due and owing for the months of May-December 1993 and
January-May, 1994. Such defaults are continuing.
14. The entire indebtedness represented by the Note and
secured by the Mortgage is now due and payable in full by
Defendants to Commerce. Such indebtedness includes principal,
interest at the rate provided in the Note, late fees, taxes,
municipal assessments or charges, an attorney's commission and
costs of suit.
15. The interest, late fees, taxes, municipal charges and
assessments and other costs and expenses as provided in the Bond
and Mortgage will continue to accrue until distribution by the
Sheriff of Cumberland County, and are to be computed when
judgment is entered in this proceeding.
16. Total indebtednesa to Commerce which is secured by
the Mortgage is $6,852.12, through 5/25/94 as follows.

to law, aays that on June 14, 1994 at 2125 o'clock P.M., E.D.S.T., he served
a true copy of the within Complaint in Mortgage Forecloaure and Notice, in
the above entitled action, upon the within named defendant, to Witl Jan C.
Michalac a/k/a Jan Bell, by making known unto Kelly Shineult, Adult Daughter
of Jan C. Michalac a/k/a Jan Bell, at 222 North 2nd street, Wormleyaburg,
Cumberland County, Pennsylvania, its contents and at the same time handing
to her personally the aaid true and attested copy of the same.
Daniel Peiper, Deputy Sheriff, who being duly sworn according to
law, says that on June 20, 1994 at 8135 o'clock P.M., E.D.S.T., he served a
true copy of the within Complaint in Mortgage I'orecloaure and Notice, in the
above entitled action. upon the within named defendant, to witl John R.
Michalac, Sr., by making known unto John R. Michalac, at 55 Rolo Court,
Mechanicsburg, Cumberland County, Pennaylvania, its contents and at the same
time handing to him personally the said true and attested copy of the same.
R. Thomas Kline, Sheriff, who being duly sworn according to law,
says that he made diligent search and inquiry for the within named
defendant, to witl Richard A. Schoffstall, but waa unable to locate him in
his bailiwick. lie therefore deputized the Sheriff of Dauphin County,
Pennayvlania, to serve the within Complaint in Mortgage Foreclosure and
Notice according to law.
DAUPIHN COUNTY RETURNl AND NOWI June 20, 1994 at 9:35 A.M.,
served the within Complaint in Mortage Foreclosure upon Richard A.
Schoffstall by personally handing to Richard A. Schoffstall a true attested
copy of the original Complaint in Mortgage Foreclosure and making known to
him the contents thereof at 114 Ann St., 3rd Floor, Middletown, Dauphin
