This is a follow up of our conversation on JU1r 11 1993 regarding
the above referenced domestic situation. You nd cated that your
client was not willing to pay $50/000 as a lump sum settlement to
Mrs. Seik. 1I0wever you did offer $30,000 plus the possibility of
alimony and that Mra. Selk would have excluaive possession of the
residence until your client made the settlement payment. During
that time he would pay the mortgage payments on that house.
I have reviewed your offer with my client and it is hereby
rejected. lIowever, for the sole purposeR of trying to negotiate a
settlement in this matter/ and BS our last and final offer, we are
willing to accept $45/000 as a lump sum payment with no alimony.
Mrs. Seik would take immediate pOBsession of the home and remain
there until payment is made.
AD you are well aware/ in the event that this would go to a
Master's hearing, Mrs. Seik would be entitled to equitable
distribution and most llkelr alimony. This is a seven year
marriage during which Mr. Se k did not allow Mrs, Seik to work.
lIis income is far greater than hers.
Please advise your client that we feel he has breached the
agreement we reached at the settlement conference wherein we waived
our rJghts to spou~al support for exclusive posaesaion of toe
marital home. If this offer ia not accepted within ten days, we
will repetition for apousal Rupport, councll feeB and expenses.

Dear Chuck:
I had an opportunity to meet with Mr, Selk recently and we discussed the upcoming CUltod,y
conciliation on Thursday, May 12, 1994, In one !alIt attempt to settle t1Ji1 DUltter without the need to
concl1lnte, Mr, Selk IuuJ authorized me to propose the following:
1. AIl a supplement to the temporary Ordl'r currently in force 81\d in reference specll1ca11y
to the summer, Mr, Selk proposes that the parties would slwe time during the summer with Mrs. Selk
having primary custody during the day light hours and he would have the children Bl\er work, AIl Mrs,
Selk will have every day with the children while Mr, Selk works, thie arrangement makes sense u he will
then make arrangements to pick up the children from her Bl\er work and return them to her epln in the
morning before going to work, ThIs will provide maximum ellioyment and opportunities for parenting with
all partie, 81\d will not remove the children from Mrs, Selk for longer than a one or two week period when
Mr, Selk has vacation,
2. In the alternative, Mr, Selk would request primary physical custody for eight weeks in the
summer giving Mrs, Selk two evenings per week and every other weekend which Ie the current schedule.
3, AIl It Ie my understanding that Mrs, Selk IuuJ Indeed consented to our previous marital
property proposal, I would recommend that this matter be IlnaIlzed Immediately 8Ild not be used u some
blackmail or olther bargaining chip In the custody mattcr, We will not allow It to become surh, However,
in order to finalize that matter, Mr, Selk Is willing to pay for 8Il additional one year Insurance premium
on the car insurance which Ie due to expire In May of 1994, If you deliver to my office the elgned Marital
Settlement Agreement 88 well 88 a signed Consent for the divorce, Mr, Selk will contemporaneously pay
a full year oflnsur8llce 8Ild provide payment Information to Mrs, Selk, Otherwise, she will be on her own
to provide insurance on the vehicle beginning next month,
I believe the nbove proposals would not only resolve this entire matter without further expense
to our clients, but also would allow us to 8Illlcnbly settle this mntter once nlld for all. Your profe88lonal

Having reviewed this matter with my client, I am responding to
your April 14/ 1994 correspondence as followsl
1, Unacceptable, Again, Mrs, Seik believes that
it is in the children's best interest for them to
primarily reside with her, She is agreeable to two non-
consecutive weeks of vacation during the summer,
2, Unacceptable. See paragraph 1,
3, Please advise your client that Mrs. Seik, upon
my advice, has reconsidered your client's property
proposal, The property issues will have to be litigated
before a Master,
I see no reason why that litigation cannot take
place in Cumberland County since both parties agree to
venue. If you disagree, please advise, Otherwise, I
will take the necessary steps to bring this case to the
Master's attention,
