McDermott, Esquire, respectfully represents. 1. This petition is filed pursuant to the "Protection from Abuse Act" P.L. 1090, No. 218, October 7, 1976, 35 P.S. Sections 10181 at seq. and 1978 Amendments thereto, Act No. 1978-81. 2 . The Petitioner is LaShawn R. Hall, who presently rei ides at 346 E. North Street, Carlisle, Pennsylvania 17013. 3. The Respondent is Brenton R. Windish, who presently resides at 1102 Pheasant Drive North, Carlisle, Pennsylvania 17013. 4. The parties are the natural parents of one minor child, Lance Scott Windish, born October 24, 1992. 5. Respondent has abused the petitioner in that. a) On or about June 4, 1994, Respondent attempted to strike Petitioner, placing her in fear of bodily harm, and b) Respondent threatened to kill Petitioner and her mother Nancy Hall. 7. Petitioner has fear for her safety. MEMORANDUM OPINION This case was set for hearing today. Both partiel appeared. The Petitioner was represented by Arthur McDermott, Esquire, private counsel. Mr. Windish appeared, and he was not represented by counsel. The primary factual basis for the allegation was a charge of physical menace. Basically I think from what Mr. Windish told me today, what he did would constitute physical menace although in this incident the Respondent never struck the Petitioner. since there has been an admission, there is no necessity for a hearing. I have told Mr. Windish I would be signing an order today that would put him in serious trouble if he abused the Petitioner in the future, and I t~ink he understands that.
