MABTER'S REPORT
TItE MASTERr Today is Thursday, January 29, 1998.
Thi. i. a date we set for a hearing to continue the teetimony in
t:he above captioned case. We previously had a hearinq on the
tactor ot martial misconduct as that factor affected wite's
alimony claim on September 22, 1997. Tpday we were going to
take testimony on the other factors dealing with the economio
claims raised of equitable distribution and alimony, and also
consider wife's claim for counsel fees and costs.
The Master hilS had a discussion with Hr. Petter and
with Ms, coyne regarding the grounds for divorce, and both
parties are willing to sign affidavits of consent and waiverA of
notice of intention to request entry of divorce decree. Ms.
Coyne will prepare the documents and submit the affidavit and
waiver to Mr. Peffer for signature who will then return the
documents to Ms. Coyne for filing. Ms. Coyne will obtain her
client's siQnature on the documents and file those as well. 'I'he
divorce will then be able to prooeed under Section JJ01(0) of
ths Doms8tio Relations Code.
Present in the hearing room are the Plaintiff, Paul

W. Petfer, II, who is not represented by counsel, and the
Detendant, Haria c. Pefter, who is represented by Lisa Harie
coyne.
The parties were married on May 15, 1972, and
separated Hay 11, 1994. They are the natural parent:s of two
children and have an adopted child. The adopted child is the
minor child who is currently living with wife. That child is 14
years of age.
After considerable discussion with Mr. Peffer this
day, and in an effort to try to reach some conclusions about the
assets and credits and liabilities, we have come to an
understanding with respect to the amount of money that husband
would be obligated to pay wife as part of her distribution of
the martial assets.
We have also come to an understanding that
husband's pension with the United states Navy will be
distributed in accordance with a QDRO Which Ms. coyne will
prepare in accordance with the stipulation so that the payments
from the pension can be distributed between the parties in
accordance with that order.
The parties have discussed with the Master the
income which they currently have available. Mr. Peffer is
currently receiving a gross monthly payment of $1,040.00 from
his navy pension. lie is also reporting income from a part-time
job (he stated that he is working approximately 20 hours a week)

at J&W Hardware. Husband is beinQ paid for hi. part-time work
$133.25 gross per week, which would be equivalent: to $573.00 per
month gross. It is noted that when the pension is distributed
in accordance with the QDRO, half of the payment that Mr. Peffer
is receiving from the pension will be paid to his wife reducing
his income by that amount of money. consequently Mr. Peffer's
gross income will be around $1,100.00 per month.
Wife is currently employed at Holy spirit Hospital
in housekeeping and her monthly gross income is $1,100.00.
Added to that monthly amount will be wife's share of husband's
pension of $524.00, which will increase her gross monthly income
to $1,624.00.
Looking at the incomes presently, husband has gross
monthly income of $1,621.00, working only a 20 hour week. Wife
has a gross income of $1,100.00. When the equitable
dist:ribution order is in effect and the pension is distributed,
wife's income will be $1,624.00 gross monthly and husband's
income will be $1,100.00 gross monthly. Based on the
differences in income and considering the other factors which we
have discussed, and also taking into account the testimony on
martial misconduct, it is the master's finding and
recommendation that wife's alimony be denied.
Ms. coyne has provided a list of martial assets,
aside from the pension, which include the real estate at 413
pitt street, Enola, Pennsylvania; proceeds from a Prudential

whole life ineurance policy, which husband received of
$1,227.48/ a Holy spirit Hoepital retirement:, which husband
recsived of $2,011.35/ wife's Holy spirt Hospital penBion in the
amount of $762.95/ a 1987 Chevrolet Celebrity station waqon with
a value of $700.00/ tools valued at $1,800.00/ household
furnishings of $6,000.00/ and a PNC checking and savings account
valued at $500.00.
With raspect to the real estate, counsel has
advised that the house has been stipulated by the parties to
have a value of $70,000.00 but the liens against the house are
around $76,000.00 which means the house is not worth the amount
necessary to clear the liens. We have discuseed the fact that:
if the house were listed for Illle thel'e would be a deticisnoy
that would be required to be mllde up in order to complete
settlement with a prospective buyer and that neither of the
parties has any wherewithal to come up with the necessary cash
in order to clear the title on the house. Therefore, it seems
that the only reasonable way to proceed is for wife and the
minor child to remain in the premises.
We have determined that the interest of wife in the
assete that have been described above, based on II 55/45
distribution, in fllvor of wife, would be $6,600.00.
Turning to the pension, there is no di.pute that
from 1994 through the present, husband has been receiving the
monthly peneion benefit. 1~i8 benefit represents wife's share

After ruviewing the numbers which have been
provided for the earningl on the penlion from 1994 through the
prelent, and taking into account an interest factor at 5.5' on
the share that wife would be entitled to from that peneion from
the time of separation to the present, it has been calculated
that wife's share of the pension would be $28,541.00. The
di.tribution of the peneion from the separation to the present
ha. been made on a 55/45 baeis in favor of wife.
Doing the math we then reached the value of wife'.
share of martial a8sets for purposes of equitable distribution
of $35,141.00.
Against that value we need to take into account
debt which each of the partiel hili assumed and credit. which
hUlband may be entitled to with reepect to payment. that he ha.
mad. to wife a. .pousal support, which wers calculated on hil
recsiving the total pension benefit. We have attempted to
arrive at a credit without specifically doing a numerical
calculation in order to arrive at a number that is satiSfactory
to both parties !'epre.enting the ftmount of money which hUlband
would owe wife ftl a net amount for hiu payment to hur of the
martial intereut of wife in the martial estate. 1~e credit
which husband il being given is $3,141.00, making the net share

Q Mr. Peffer, you've heard my statement on the
record. Is it your desire to stipulate to the statement that I
have made on the record with respect to the findings in
equiteble distribution of the martial estate?
A I agree with all the facts.
Q And with the number that we have agreed to is the
final number of $32,000.007
A Yeah. Doesn't have to say 1 like it, right?
Q Right. But you understand how we've got to that
number and you're satisfied that that is an appropriate
re80lution of the math in arriving at that number?
A Hight.
o Mrs. Peffer, you've heard the statement on the
reoord, are you satisfied to stipUlate to the number. that we
have placed on the record?

A Yes.
THE MASTER I Ms. coyne, did you have any questions
that you wanted to ask your client?
MS. COYNEI Just for clarification for the record,
the $32,000.00 is stipulated to as the amount at issue here for
the equitable distribution claim; is that correct?
THE MASTERl That's right. The $32,000.00 is the
amount that wife is entitled to for her share of the marital
estate for the assets described and ths pension from date of
separation to the present. The pension from this date forward,
however, is going to be distributed in accordance with a QDRO eo
that the pension forward is not included in any numbers with
respect to the prior number of $32,000.00 as we have computed.
You all understand that?
MS. PEFFER: Yes.
MR. PEFFERI Yes.
TilE MASTER: Now that we have reached a conclusion
by way of stipulation as to the numbers we are dealing with, the
Master is going to make some recommendations with respect to
equitable distribution. It is noted that the Master has already
made a statement regarding the alimony claim of wife and has
recommended that that claim be denied.
with respect to equitable distribution, the Master
makes the following recommendationl

shall eign a special warrant:y deed transrerring all his right,
title, and interest to wire in the real eetate at 413 Pitt
St:reet, Enola, Pennsylvania. Wife shall be responsible for all
liens and taxee relating to that premises and shall indemnify
and hold husband harmless on account of any claims which may be
made by any creditors against husband on account of any debt
owed on the real estate.
Husband shall receive title to the 1987 Chevrolet
celebrity station wagon which is currently titled in joint
names. Within thirty (30) days of today's date, wife will
execute the necessary documents transferring title to husband in
the vehicle.
Husband shall receive all of his tools which are
currently in his possession.
Wife will receive all of the household tangible
personal property which is presently in her possession. with
respect to the household tangible personal property, Mr. Peffer
has requested the opportunity to have some pictures of the
family, and the parties are directed to try to cooperate in
providing Mr. Peffer access to photographs and the opportunity
to make copies of any photographs which he chooses.
Wife ehall retain her pension as her sole and
separate property at Holy Spirit Hospital.
HUsband is charged with having received his pension
from Holy Spirit Hospital and the proceeds from the PrUdential

whole lite polioy. These two assets previouslY reoeived by
husband have been t:aken into account in the computation ot the
distribution ot assets.
lIusband has also received the PNC checking and
savings account I the receipt by husband of these assets have
also been considered in the distribution computation.
Husband's pension with the United Btates Navy ehall
be distributed in accordance with a QDRO which will provide that
50' of the gross monthly benefit shall be paid to wife with
husband retaining the other 50' gross monthly amount. It is the
Master's understanding that with respect to this pension there
are no survivor benefit provisions available. Each party shall
be responsible for paying any tax liability with respect to
receipt of those pension funds that each party is entitled to
receive.
lIusband has been paying the debt to Member's 1st
which at separation was around $9,700.00. lie currently owes
around $1,000.00 and has been paying that obligation since the
date of separation and will continue to pay that Obligation
until it is paid in full. lIusband will indemnify and hold wife
harmless on account of any claims which may be made by Member's
1st on acoount of that obligation.
Wife is a8suming the responsibility for payment of
the MasterCard and ,lC Penney charge aocount as her sole
obligation and she will indomnify and hold husband harmless on

account of any claim. which may be made by either of those two
creditore against husband on account of the debt. The account
numbere for the HaBte~Card is 5424 1802 3747 2185. The account
number for JC Penney charge is 170 755771 4. The amount of debt
which wife is assuming totals around $6,000.00.
We have had considerable discussion today as to how
husband can fulfill his obligation for payment to wife of her
equitable distribution interest in the martial estate. Hr.
Peffer has gone to Member's 1st today to attempt to borrow money
to liquidate part of the obligation at least but has reported
that he is unable to borrow any funds because of the other
liabilities that exist, which are the mortgage and the debt to
Member's 1st, and his joint obligation on the MasterCard.
The Master has explained that all he can do
presently is make a recommendation that husband fulfill his
obligation by making payment to wife and if husband cannot make
that payment, he is aware that he will have to seek perhaps
other legal remedies to protect his interest or other means of
trying to fulfill the obligation by making arrangements for
credit or installment paymente to wife.
The Master's recommendation Is that husband pay to
wife the sum of $32,000.00 within thirty (30) days of today's
dats. Or in the alternative, husband attempt to negotiate with
attorney coyne an alternative means for fulfilling this
obligation by using an installment method of payment or by

combinin9 a oash payment of a certain amount toward the
obli9ation with the balance to be paid in installments. The
Master wants to give both parties an opportunity to try t:o
resolve this issue without forcing husband into bankruptcy and
without requiring wife and the minor child to have to give up
the premises where they are currently residing which is the only
housing available to them at the present time. In the event
that the $32,000.00 payment that is due wife is not mado and is
reduced to a final order and ultimately a judgment against
husband, interest will accrue on that amount at the rate of 6\
per annum unless otherwise agreed to by the parties.
Because of the income situation of the parties and
the debts and the requirement of husband to make arrangements to
fulfill the payment on equitable distribution, the Master does
not consider it reasonable that he should impose upon husband
the paymont of any counsel fees for wife. It is the Master's
clear understanding that wife has probably had to incur counsel
fees in excess of $5,000.00 in pursuing this case and the Master
is not unmindful of the fact that that will place an additional
burden on wife. However, based on the economics in this case,
the Master does not feel that he should impoee a further
obligation on husband to aesume a responsibility for wife's
counsel fses. 'fherefore, wife's clllim for counssl fees is
denied. Ms. coyne has asked and is permitted to attach as
exhibite documentation in support of her claim for counsel fees.

the Haster's recommendations here.
I would ask the Master to reconsider the issue here
of counsel fees in light of this additional work. Since Mr.
Pefter is not represented by counsel that's automatically
turning to me and my client to continue to move this case along,
and given the amount that's been incurred by Mrs. Petfer, I
would just aek the Master to reconsider and also to consider the
only cost involved in the docket, you will see, for Mrs. Peffer
is $60.00, I believe on the counterclaim, on that.
The QDRO's that are prspared from our office __
actually not prepared by our office -- but by Pension Appraisers
which a fee is charged for that to be prepared. It seems __
you're burdaning her.
THE MASTERI 1 understand and I did say counsel
fees, I didn't say anything about costa, and having heard what
you've said, I am going to further direct that the costs of
preparation of the deed, costs in preparing the QDRO, the filing
fse for the counterclaim, and the affidavite be borne equally by
the parties. Husband will have thirty (3D) days to pay to
attorney Coyne his share of the costs when attorney Coyne
submits a statement to Mr. Peffer fo!" his share of the costs.

Aft:er disoussion with oounsel and Mr. Petter, it is
underst:ood that the stipulation, the taots as set torth above,
and the recommendat:ion of the Master with respect: to equitable
dietribution is accepted by the parties and will not be excepted
to. /lowever, it is also understood that with respect to the
Master's findings on alimony and counsel fees (not costs)*,
there remains the right of either of the parties to file
exceptions with respect to those economic issues that have been
raised.
Consequently, this report will be filed and sent to
the parties with a notice directing that the parties have ten
(10) days to file exceptions. Specifically, however, as noted,
the only exceptions that can be filed will be with respect to
the Master's recommendation with respect to alimony and counsel
fees.
As noted, Ms. Coyne is going to attach to the
report two documents in support of her claim for counsel feos.
One of those is a fee agreement ehe has with her client and the
another is an interim statement for counsel fees.

Present is the Plaintiff, Paul W. p.ff.r, 11, who
11 currently unrepreunted hy counsel. Mr. I'etter Ie acting on
hi. own b.half. Also present is Lisa Mario coyne, attorn.y for
the Oefendant, Maria c. Petfor.
A divorce complaint was tiled on June 16, 1994,
rai.ing ground. for divorce of Irretrievable breakdown of the
marriage. Counsel tor wlte is uncertain as to whether or not
her client will agree to sign an affidavit of consent. However,
Mr. Peffer has tiled an affidavit under Section 3301(d) of the
Domestic Relatione Code averring that tho parties separated on
May 11, 1994. 1~eretore, since there Is no issue with respect
to the date of separation, in the event that both partie. wi 11
not agree to sign affidavits of consent, the divorce can proceed
under seotion ))Ol(d) of the Domestio Relations Code. It i8
not.d that Mr. Petter tiled an affidavit on May 7, 1997,
averring that the parties separated on May 11, 199). An amended
affidavit wa. filed on May 13, 1997, averring the date of
separation as of May 11, 1994.
Wife filed an answer and counterclaim on September
20, 1996, rai8ing the economic issues of equitable distribution,
alimony, alimony pendente lile, and counsel fees and expenee..
With respect to wife's claim for alimony, counsel for wife has
indicated that there ie an IsslIe with respect to msrilal
misconduct and how that ractor affects wife's alimony claim.
The issue involves an allegation that husband waD soeing a
female friend d~riny a poriod of time prior to the separation.
Mr. !'effer, on the contrary, avero the relstlonehip with the
female friend occurred pontseparatlon. We are going to have a
lIeparat III hear Ing to take toot I mony on the factor of mar its I
mi&conduut. Counsel slllt Mr. l'eHor are directed to provide each
other a Ilet at witnesses, who will Le pronont at that hearing,
at least a month prior to the hearing.
Mr. Pefter Ie currently paying spousal support in
the amount of $41i7.00 per month and child support In the amount
of $306.00 per month. The child support is for one minor child
who r..ides with wife. There are two ot:her children of the
marriage, both of whom are adults, The one child, however, is
going to be entering college in the falll however, under
Pennsylvania law we cannot consider ths expensss of that child
for college.
Wife ie currently receiving a medical insurance
benefit through hel- employmont which is providing benefits also
for husband. Upon the ontry of a divorce decree, husband will
no longer be covered under any health ineunnce plan. Husband
is requested to provide information as to how he intends to pay
for health insurance or whether or not health insurance will be
provided as a result of employment.
Husband is 45 years ot age and res idee at 5 Anthony
Drive, Marysville, Pennsylvania, with a female friend and a
minor child of ths female friend. Husband is currently
unemployed, although he previouslY had a long period of service
with ths United states Navy from which he retired, and a short
period ot employment with Roadway Express as a dockworker. Mr.
Peffsr explained that the dockworker job did not work out
because he was not able to meet the productivity requir~ments of
the position. Mr. Peffer also reportsd that he had a hsart
attack approximately a month ago and is currently under the care
of a cardiologiet. The Master has indicated a concern about the
statue of husband'S medical insurance coverage and this is
certainly a consideration that we will need to take into account
with respect to husband'S current health situation. Husband
indicated that he is looking for employment and is able to do
light work but is not permitted to lift more than 45 pounds.
Husband is also receiving unemployment compeneation in the
amount of $169.00 per week which may terminate at the end of
August 1997. Mr. Petfer is going to verity information
regarding the termination date of that benetit. The Master has
explained to attorney coyne his concern about the future
earnings of Mr. Peffer, eepecially taking into consideration his
health problem. The employment and income of Mr. Peffer
obviously has a lot of bearing on what hoppens with the pending
alimony claim of wife.
Wife is 44 years of age and resides at 413 pitt
strest, Enola, Pennsylvania, with the threo children of the
marriage. Wife is a housekeeper at the Holy spirit Hospital
where she earns net per month approximately $1,194.00. Wife is
a Philippine national and has been naturalized and is a citizen
of ths united states. Her attorney reports that her annual
gross income for 1996 was a little over $15,000.00. wite has
not raisod any health i8sues.
The real estate that the parties own jointly at 413
Pitt street, Enola, Pennsylvania, has not b. b.en apprais.d.
After diecuseion with Mr. Peffer and Mrs. Petter's counsel, we
havs stipulated that the property hae a value tor purpolu8 of
the equitable distribution computation of $70,00U,00. It Is
noted that the mortgage owed on the property as of October 16,
1996, was $76,1l71.15. 'l'hel'Oforo, the property hll8 a negative
value considering the stipulated valuo and the amount due on the
mortgage. Wife hae been making the mortgage payments since date
of separation. Mr. Poffor noted that until tho support order
was entered, he was making contributions toward the mortgage and
paying bills relating to the house as well as marital debt.
subsequently, after the support order was entered, he was under
the obligation to pay the monthly maintenance for wife and child
and, therefore, terminated any payments or contributions on
account of the mortgage or household eHpenses.
Hueband is a recipient of a pension with the Unitsd
states Navy as a result of his retirement. He receives
$1,027.00 per month before taKes and $952.00 per month after
taKes. He has been receiving his pension since the date of
separation, May 11, 1994. Counsel and Mr. Peffer are going to
do a computation to try to determine the value of wife's
interest in that pension from the date of separation to the date
of hearing which would represent her share of the pension as an
equitable distribution asset. Also to be considered is any
credit that Mr. Peffer should be entitled to as a result of
making maintenance support payments from the date of separation
or thereafter, and any taK coneequences arising out of the
receipt of the pension payments versus the support maintenancs
payment. Counsel and Mr. Psffor have agreed that from the date
of the hearing forward, after the computation has been
accomplished regarding the period of time from May 11, 1994,
that the pension can be distributed under a QDRO using a
coverture formula and a 50\ distribution. Mr. Peffer has
indicated that there is no survivor benefit provided with the
pension and he advised that when he entered into the retirement,
which was before the separation, that his wife signed
appropriate documents indicating her understanding that there
would be no survivor benefit provided. With respect to that
issue, Mr. Peffer has indicated that he is going to provide
documentation showing that, in fact, the survivor benefit was
waived and not elected at the time of retirement.
Huaband has in his possession a 19117 Chevrolet
Celebrity station wagon which is a marital asset. lie has valued
the vehicle at $300.00. Il1e wife'e attorney indicated that she
is going to take a look at the blue book value and hopefully we
will be able to stipulate as to the value of that vehicle.
Hr. p.rr.r indioat.d that he has various tools in
hi. po.....ion and ha. valu.d those tool. at $1,800.00. Ms.
coyn. ha. indioat.d that .he will stipulate that that value ia
accept:lb1a for the tools to ule in the equitable distribution
computation.
After discullllion with regftrd to tho value of
household tanyible personal property, including a camcord.r,
counael and Mr. Peffer hftve ayreed to stipulate that the value
of houe.hold t"nyible perlonal property, including tho
camcorder, in wife's possession is $5,000.00.
Subsequent to separation Hr. Veffer cashed in a
PrUdential life insurance policy which we believe was a whole
life policy. 118 received ft check and he ill going to let
attorney coyns know the amount of money that he received as a
reeult of cashing in that policy.
Both parties were participants, and wife continues
to be a participant, in II 1I0ly apirit 1I0spital pension plan.
Mr. Pet fer is yoing to check with human resources at the
hospital to see if there was any value in his pension at the
time that he terminated employment and, likewise, Mrs. Peffer is
goin9 to inquire as to any value in the plan that she is a
participant in at the Holy Spirit 1I0spital.
Mr. Peffer is "Iso going to provide to attorney
coyne monthly or annual ponsion benefit statements from the
United states Navy retirement to ftssist Ms. coyne in doing the
computation which we had previOUSly discuued needs to be done
to value any interest of wife in the benetit (rom the date of
separation.
The maritftl debts, aside from the mortgage, include
a consolidation of debt Mr. Peffer has been paying. Mr. Peffel
is going to provide information regftrding what he has paid on
ftccount of marital debt since the date of separation to the
present so that he cftn receive any credit to which he may be
entitled as a result of assuming the full payment on marital
debt since the date of separation. Likewise, wi fe claims that
ahe hll8 been making payments on mftrital deht to J.C. Penney and
on a Mastercard. Wifo is going to provide verification as to
what payments she has made on marital debt since separation so
that any credit to which ohe mi\V he entitled can he appllecl ae
well.
A heariny io scheduled (or Monday, septemher 22,
1997, at 9100 a.m. to take testimony on the factor of marital
misconduct as that factor affects wife's alimony claim. At that

New Local Rules
Attached please find two new local rules which were publlahed In the July 20, 1996
Pennsylvania Bulletin and which will be In effect on August 19, 1996.
New rule 205-1. Hybrid Representation. The court has Implemented this rule In order to
avoid a party who Is represented by an attorney from filing a motion with the court without
counsel's knowledge. If the court Is able to Identify that circumstance as occurring, the
court will not act on the motion, but forward the motion to the party's counsel of record for
such purpose as counsel may deem appropriate on behalf of his or her cllen!.
Non-Jury Trials - Rule 215-1. This Is an effort by the court to remove civil non-jury cases
from the call of the civil trial list. If litigants to a case know that It will be a non-jury trial,
they simply may file a praecipe with the Prothonotary, who will forward same to the Court
Admlnlstralor's Office,
The Court Administrator will assign the case to a judge Immediately. This Is somewhat
similar to our procedure In equity cases, The hope Is that non-jury trials might be
scheduled more quickly and efficiently In this manner, Instead of having to wall for the call
of the civil trial list.

creates and recognizes the existence of an Alternate Payee's right to receive a portion
of the Participant's benefits payable under the Plan. It Is Intended to constitute a
Domestic Relations Order ("DRO") under the Uniformed Services Former Spouses'
Protection Act (USFSPA) of 1982, P.L. 97.252.
6. Pursuant to State Domestic Relations Law: This Order Is entered
pursuant to the authority granted In the applicable domestic relations laws of
Pennsylvania.
7. Amount of Alternate Payee's Benefit: This Order assigns to
Alternate Payee an amount equal to Fifty percent (50%) of the Participant's disposable
retired pay.
8. Benefit Commencement Date: The benefit established for the
Alternate Payee under the Plan Is to be paid directly to her commencing as soon as
administratively feasible following the date this Order Is approved as a Domestic
Relations Order or on the date the Participant commences his benefits, If later.
Payments shall be paid monthly to the Alternate Payee for the remainder of
Participants lifetime or until the death of the Alternate Payee.
9. Cost of Living Adjustments: The Alternate Payee shall receive a pro.
rata share of any cost.of.livlng adjustments or other economic Improvements made to
the Participant's benefits on or after the date of his retirement.
10. Survivor Benefit Plen (SBP): The Alternate Payee shall not be
awarded a Survivor Benefit Plan Annuity under the Military Retirement System.
11. Savings Clause: This Order is not intended, and shall not be
construed in such a manner as to require the Plan:
(a) to provide any type or form of benefit option not otherwise
provided under the terms of the Plan;
(b) to require the Plan to provide Increased benefits determined onthe
basis of actuarial value; or
(c) to require the payment of any benefits to the Altemate Payee that
are required to be paid to another alternate payee under another
order that was previously deemed to be a DRO.
(d) to make any payment or take any action which Is inconsistent with
any federal or state law, rule, regulation or applicable judicial
decision.
