STIPULATION AGAINST LIENS
THIS AGREEMENT made the ~ day of August, 2001, by and
between CUMBERLAND DESIGN AND BUILDINC COMPANY, INC., Builder, of
P.o. Box 248, Carlisle, Pennsylvania 17013, hereinafter referred
to as Contractor, ~tND DAVID E. WHITNEY and PATRICIA L. WHITNEY,
husband and wife, of 1773 Kendall Drive, Mechanicsburg,
Pennsylvania 17055, and GARDNER R. WHITNEY and WANDA L. WHITNEY,
husband and wife, of 509 8th Street, New Cumberland, Pennsylvanla
17070, hereinafter referred to as Owner, whereby the former
undertook and agreed to complete certain improvements on that
certain lot of ground situate at 5142 Trindle Road,
Mechanicsburg, Hampden Township, cumberland County, Pennsylvania,
being Lot No. 1, on the Subdivision Plan of Gilbert Miller Beer,
dated March 7, 1973, said plan being recorded June 27, 1978 in
the CUmberland County Recorder of Deeds Office in Plan Book 23,
Page 193. Being the ~ame premises which HAMPDEN INDUSTRIAL
DEVELOPMENT AUTHORITY, by Deed dated October 16, 1992 and
recorded October 30, 1992 in the cumberland Recorder of Deeds
Office in Deed Book ¥35, Page 794, granted and conveyed unto
Gardner R. Whitney and Wanda L. Whitney, husband and wife and
David E. Whitney and Patricia L. Whitney, husband and wife.
NOW THER~FOREr THIS A~REF~NT WITNESSETH~ That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves a~d their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained

by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings er any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
WITNESS OUr hands end seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.
