AND NOW, come the Plaintiffs, KENNE'1'Il S. 1I0Ll,INGER and ANNA
L. CUMMINGS, by their Attorneye, SNELBAKER & BRENNEMAN, P,C., and
aver the following cause of actionl
1. The plaintiffs are KENNE'I'H S. HOLLINGER and ANNA L.
CUMMINGS, adult individuals, who res ids at 250 Beetem Hollow
ROlld, Newville, PA 17241.
2. The Defendants are BARRY L. HERR and NA'I'ELIA A. HERR,
adult individuals, who reside at 231 Meals Drive, Carlisle, FA
17013,
3, On or about March B, 1991, Plaintiffs loaned to
Defendants the sum of $20,000.00 on the terms and with the
interest set forth in a certain written Personal Loan Contract
attached hereto marked "Exhibit A" and incorporated herein by
reference thereto.
4. By the terms of said Persona 1 I,oan contract, Defendants
promised and agreed to repay said loan in monthly installments on
the ath day of each calendar month commencing on April a, 1991.
5. Defendants made various payments on accmlnt of said loan
as Bet forth on the statement of account attached hereto marked
"Exhibit U" and incorporated herein by reference thereto.
PERSONAL LOAN CONTRACT
This loan contract between the partiee named below is legal and
binding. The firs t party being Kenneth B. 1I01linger known as
lender, and second party Anna,L. Cummings known as co-lender agree
to loan to third pllrty being Bllrry L. lIerr known lie borrower IInd
fourth party Natelia A. lIerr known as co-borrower, II certain
amount of money to be repaid with interest over a period of time

TBRHS :
ANNUAL PERCENTAGE RATE: 11.001
AMOUNT OF LOAN: $20,000.00
FINANCE CHARGE: $6090.40
TOTAL OF PAYMENTS: $26090.40
NUMBER OF PAYMENTS: 60
AMOUNT OF PAYMENTS: $434.84
Payments are due monthly beginning '?- ~II or I
Payments will be paid in full and on time. If for any reason
during the period of this contrllct either one of the lendsrs
should die, the payments will continue to be paid to the surviving
lender for the length of this contract. Bhould both lenders die
the balance of this contract will be paid in full to the estate
of last surviving lender.
The borrowers IIgree and promise to guarantee to repllY in full the
amount of this loan as to the terms lieted above. If for any
reason the borrower does not fullfill the terms of this contract
the co-borrower will have to assume responsibility of said contra~,
if for any reason either or both of the borrowers decide to
declare bankruptcy,seperate or divorce the payments will continue
!o be paid in full and on time by either or both according to the
terms of this contract.

PRAECIPE FOR ENTRY OF DEFAULT JUDGMENT
TO THE PROTHONOTARY:
Please enter jUdgment by default in favor of the Plaintiffs,
Kenneth S. Hollinger and Anna L. Cummings, and against
Defendants, Barry L. Herr and Natelia A. Herr, due to the
Defendants' failure to plead to the Complaint in this action
within the required time. The complaint, which was served upon
Defendant Natelia A. Herr and accepted by her for both Defendants
on June 20, 1994 contained a Notice to Defend within twenty (20)
days from the date of service thereof. Defendants' Answer or
other responsive pleading was due to be filed on or before July
11, 1994.
Attached hereto as Exhibit "A" is a copy of Plaintiffs'
Important Notice indicating Plaintiffs' intention to file a
Praecipe to Enter Default Judgement which I certify was mailed by
regular mail to Defendants Barry L. Herr and Natelia A. Herr at
the Defendants' last known address on August 15, 1994, which is
at least ten (10) days prior to the filing of this Praecipe.
