at the Kmart store at 5600 Carlisle Pike, Hampden Township,
cumberland county, Pennsylvania, in accordance with the terms
and conditions as set forth in the Opening Contract dated
January 17, 1994, a true copy of which is attached hereto and
made a part hereof, marked Exhibit "A".

Subsequently, DeZendant asked to extend the rental term
from three days to one month and the parties agreed on an
extension of the rental contract in accordance with the terms
and conditions as set forth in the Revised Rental Contraot
dated February 11, 1994, a true copy of which is attaohed
hereto and made a part hereof, marked Exhibit "B".
6.
At the time of entering into the Revised Rental Contraot
as described in Paragraph 5, above, Defendant paid to Plaintiff
the sum of $1,300.00 on account of the rental charges.
7.
When Plaintiff retrieved the backhoe at the end of the
rental term, Plaintiff discovered that the backhoe had been
damagod while in the Defendant's possession, care and oontrol,
in that the transmission did not operate and the wheels of the
backhoe would not turn.

Plaintiff immediately had the baokhoe inspeoted and it was
determined thatl a window and windshield wiper had been

for the disclosed, Intended purpose, The Plelntlff wes ewere of the use end
the requirements. Defendant needed the backhoe for snow removal. as
admitted by Plaintiff. At all times. the Defendant provided the proper care
and any conduct on the pert of the Defendant, did not cause any damage to
the backhoe for which the Defendant Is responsible.

Denied. Defendant has no obligations to pay any outstanding
amounts for repslrs to the Plaintiff, Strict proof is demanded at Trial.

Denied, The Defendant has no obligation to pay for the repairs
on the equipment and the Plaintiff has refused to accept the tendered
balance for the rental period. The Plaintiff Is not entitled to any reasonable
attorneys fees or costs.
WHEREFORE. the Defendant requests that the Plaintiff's
demand for Judgment be denied,
