Subsequently, DeZendant asked to extend the rental term from three days to one month and the parties agreed on an extension of the rental contract in accordance with the terms and conditions as set forth in the Revised Rental Contraot dated February 11, 1994, a true copy of which is attaohed hereto and made a part hereof, marked Exhibit "B". 6. At the time of entering into the Revised Rental Contraot as described in Paragraph 5, above, Defendant paid to Plaintiff the sum of $1,300.00 on account of the rental charges. 7. When Plaintiff retrieved the backhoe at the end of the rental term, Plaintiff discovered that the backhoe had been damagod while in the Defendant's possession, care and oontrol, in that the transmission did not operate and the wheels of the backhoe would not turn. B.
