"contraotor") intending to bu legally bound, and in oonsideration

by NY. CONSTRUC'l'IOH, IHO" Il Pennllylvania corporation ("owner"),
.aid Owner beiOy equitable owner of the Real Eetate, the reoord
owner of whioh 8 UPLAND ACRBli CORP" a PennsYlvania corporation,
the reoeipt whereof i. hereby acknowledged, tor itllelt and any
suboontractors, materialmen, laborers or anyone else aotinq
throuCjlh or under it, oovenanto and a~ree. that no mechanics or
materialmen's lion8 or olaim. shall b. tiled or maintained by it,
them or any of them, against the real estate desoribed in
Sohedule "A", attaohed hereto and made a part hereof, or aqainllt
any buildinCjls or other improve~ent. thereon (jointly and
Beverally, the "Real Estate"), for or on aooount of any work to
be done or materials furnished under the principal contract
between Owner and contraotor, dated April 29, 1994, or under any
supplemental contract, verbal or written, or oontract for extra
work or material. relatinCjl to and work to be done or material
furnished under .aid prinoipal oontraot. The underaigned, tor
itself, it. suboontraotor., materialmen, laborers ana anyone else
acting or olaimin; through or under it, hereby waive. and
relinqUish'. all riQht to till a meohanics' lien, olaim or notioe
of intention to tile any lien or olaim against the Real Eatate.
