Plaintiff served Interrogatories in Aid of
pursuant to Pa.R.C.P. 3117, upon Defendant by first
November a, 1995. A copy of the interrogatories, together with a
cover letter are marked Exhibit "A", attached hereto, and incorporated
herein by reference.
3. Since D~fendant failed to answer the interrogatories within
thirty days, Plaintiff's counsel sent Defendant a letter on December
12, 1995 offering to grant an extension of time for Defendant to
answer the interrogatories. A copy of the letter is marked Exhibit
"B", attached hereto and incorporated herein by reference.
4. Defendant has failed to respond to the interrogatories or
to the letter of December 12.
WHEREFORE, Plaintiff requests that the Court enter an order
compelling Defendant to fully answer the interrogatories served upon

3. On February 19,1993, PlainUH and Ilefendant enterell
into an oral contract In which Plaintiff would purchase an
automobile, a 1986 Dodge Shelhy, for $2000.00. Sale WIIS mlldu on
the same day.
4. To finance the purchase of the automobile, Plaintiff
borrowed a total of $2969.35 from Uenef ieial Consumer Illlwount
Company. 'I'his figure Included money to cover the purchauu prieu,
a $100.00 service charge, and Insurance on thu loftn, whleh

~. At the time of the purchnso, Defendant represented to
the Plaintiff that the transmission was new, that the tires were
new, and that the whole top part 01 the engine, including the
head gaskets, were new. Plaintiff relied on these
representations when purchasing the automobile.
6. Althouqh Plaintiff paid Defendant $2000.00 for tho
automobile, Defendant wrote down the purchase price as $500.00 on
the tempOral"y registration form, MV - 41.l'1'. lie later altered this
figure to $1500.00. ^ copy of tho original temporary
registration is mRrked Exhibit "c", nttached hereto and
incorporated herein by reference. A copy of the altered
registration form is marked Exhibit nOn, attached hereto and
incorporated herein hy reference.
"I. 'l'he Dodge I.lhelby purchased by Plaintiff broke down
almost immediately followinq the purchase. Upon inspection of
her car by a mechanic, Plainti If discovered that the transmission
was not in fact new and that it had failed. After attempts at
repai r e)ll the enlJi ne were made, two of the Bhelhy' s tJ reD blew out,
and the head gaskets failed. In ftddition to these problems, the
Shelby'S clutch and throw-out bearings fRiled, the exhaust pipe
fell oft, 0 fuel filter required repair, nnd the manifold leaked.
Plaintiff's vehlelo hos been and remains inopurable.
8. Intereat on the IOlln Irom lIeneficlnl to Plaintiff has
accumulated uince February IY, 19YJ at a rate of 2~.80' per year.
