TimothY L, Clawges. Esquire, on a petition for revocation of
probation. and the defendant having admitted that he was at the
residence of the victim and that he destroyed certain property.
being a window and a screen. to the amount of $90,00 in
restitution. we do find the petition for revocation to be
supported beyond a reasonable doubt.
Hoving so found. we revoke the prior probationary sentence
of .June 29. 1995, We now sentence the defendant to a term af
imprisonment in the Cumberland County Prison of three months,
He immediatelY place him on parole for the balance of the
service of this sentence on the condition that he abide by our
prior protective order in staYing awoy from any residence that
Christine Dull establishes, and that he further comply with the

the plaintiff refused his sexual advances, The defendant
forced his hands down the plaintiff's underwear and shoved his
fingers Inside of her vagina. When the plaintiff protested,
the defendant got a thick piece of rope. threw the plaintiff
on the bed, got on top of her, pushed his knees Into her
thighs pinning her down and tied her wrists together with the
rope. Despite the plaintiff's attempts to get the defendant
off of her, the defendant raped the plaintiff. When he was
f i ni shed, he un tied t he rope and proceeded to make h imse If
dinner. Later that evening, the defendant repeatedly called
the plaintiff vile names. and slapped the plaintiff in the
face. causing a swollen lip. The defendant then repeatedly
punched the plaintiff in her left thigh, leaving a bruise.
Criminal charges were filed against the defendant. The
plaintiff was treated at the Carlisle Hospital for her
injuri es.
b. On or about March. 1994, the defendant became angry and
pushed the plaintiff Into a closet door, causing the plaintiff
pain and soreness in her back,
c. On or about November, 1093, when the plaintiff was eight
months pregnant, the defendant became rough while they were
having sexual intercourse, causing the plaintiff to
hemorrhage. The plaintiff was treated at Carlisle Hospital.
5. The plaintiff believos and therefore avers that she will
be in immediate and prosllnt danger of abuse from the defendant and
The mother of the child Is Christine S, Dull, currently
residing at 215 Calvary Road, Carlisle, Pennsylvania.
She is single,
The father of the chi ld is Larry A. Hershey, current ly
residing at 353 N. Hanover Street, Carlisle, Pennsylvania.
The plaintiff currently resides wi th the following persons:

8. The plaintiff has not previously participated in any
litigation concerning custody. of the above mentioned child in this
or any other Court.
9. The plaintiff has no knowledge of any custody proceedings
concerning this child pending before a court in this or any other
jurisdiction.
10, The plaintiff does not know of any person not a party to
this action who has phYSical custody of the child or claims to have
custody or visi tat ion rights wi th respect to the chi ld.
11. The best interests and permanent welfare of the child
will be met If custody is temporarily granted to the plaintiff
pending a hearing in tl1i5 matlln for the follOWing reasons:
a. The plaintiff Is a fit parent who can best take care
of her chi lll.
b. The defendant has shown by his abuse of the plaintiff
that he Is not 8n approprtatH role model for the child.

12, The home from which the plaintiff is asking the Court to
exclude the defendant Is owned in the names of Carol and Gary Dull
and the defendant has never roslded there.

13. The defendant has a duty to support the mi nor chi ld.
14. The de fendan tis amp 1 oyed a t Wendy's and has annua 1
salary in excess of $0,500.00.
15. The plaintiff is employed at Kenny Rogers and her income
is insufficient to prOVide for her minimal needs and those of her
child until such time as a support order can be obtained by filing
at the Domestic Relations Office.
16. The plaintiff intends to petition for support within two
weeks of the issuance of a protective order.
E. LOSSES
17. The plaintiff has suffered losses as a result of the
abuse by the defendant. As a resul t of the incident on or about
June 12, 1994 the plaintiff was unable to attend work the next day
due to both emotional and physical pain. The plaintiff is asking
the court to award one duy's salary, totaling $21.25.
10. The plaintiff asks for reasonable attorney's fees to be
paid to Legal Sllrvlces, Inc. pursuant to the Protection from Abuse
Act.

19. The plaintiff does not have funds available to pay the
foos for filing and servico.
WHEREFORE. pursuant to the provisions of tho "Protection from
Abusa Act" of Octohar 7. 1970, 23 P.S, gOIDl at seq.. as amended,
tho plaintiff prays this Honorable Court to grant tho following

S. The defendant and the plaintiff agree to the entry of
an Order providing for the following custody schedule for their
child, Austin Rohert Hers~ey:
a. The mothel' and father wi II share legal custody.
h. The mother wi I I have primary physical custody.
c. The fathel' wi II have parlial physical custody of
the chi Id. every other weekend from Friday at 6:30 p.m.
until Sunday at 6:30 p.m.. commencing on August S. 1994
d. The mother and father wi II have custody on holidays
at mutually agreed upon times.
e. The fathel' wi II have the right to see the chi Id on
the chi Id's hirthday at a time to he agreed upon hy the
mother and father.

6, On August 16, 1994, the Court entered a Custody Order providing for Joint
legal custody and primary physical custody In the respondent, subject to periods of
pertlal custody and vlsitallon by the pelllloner.

longer abiding by the custody order and, In fact, will not allow petllloner to have any
partial custody or visitation with the child.

1. The prior order of this Court dated August 18, 1994 is vacated and
replaced with this Order.
2. The Father, Larry A. Ilershey, and the Mother, Christine Sue Dull,
shall have shared legal custody of Austin Robert Ilershey, born DeceJl'ber 12,
1993.
3. The Mother shall have primary ~lysical custody of the Child.
4. The Father shall have custody of the Child on a gradually
increasing basis in accordance with the following schedule:
A. Beginning sunday, ~Iay 2, 1999, the Father shall have custody
of the Child one afternoon per week at the maternal
grandmother's home from 1:00 p.m. until such time as the
parties agree. ~11e Father's periods of custody under this
provision shall be schE'duled for Saturday afternoons, unless
the Father works on Saturday, in which case the custody period
shall be scheduled on Sunday. The Father's periods of custody
under this provision shall continue throllgh the end of June
1999. As the Father and Child begin to establish a
relationship and the Child becomes comfortable in the Father I a
conpany, the Father may take the Child from the maternal
grandmother's residence for short outings as agreed upon by
the parties.
B. Beginning on the first weekend in .July 1999, the ~'ather shall
have partial physical custody of the Child every week on
saturday (or Sunday if the Father has to work on saturday)
from 10:00 a.m. until B:OO p.m. 'fhe Father shall transport
the Child to the maternal grandmother's residence at the end
of his period of custody under this provision if the Mother ia
working at that time.
C. Beginning in Augllst 1999, the Father shall have partial
custody of the Child on altemating weekends from Saturday at
10:00 a.rn, until Sunday at lllDO a.m. and also on one day each
