Esquire, on a petition for revocation of probation. and the defendant having admitted that he was at the residence of the victim and that he destroyed certain property. being a window and a screen. to the amount of $90,00 in restitution. we do find the petition for revocation to be supported beyond a reasonable doubt. [squire "\.I Assistant Pulll Ie Defenol!l CCP Probation Office :mtf the plaintiff refused his sexual advances, The defendant forced his hands down the plaintiff's underwear and shoved his fingers Inside of her vagina. When the plaintiff protested, the defendant got a thick piece of rope. threw the plaintiff on the bed, got on top of her, pushed his knees Into her thighs pinning her down and tied her wrists together with the rope. Despite the plaintiff's attempts to get the defendant off of her, the defendant raped the plaintiff. When he was f i ni shed, he un tied t he rope and proceeded to make h imse If dinner. Later that evening, the defendant repeatedly called the plaintiff vile names. and slapped the plaintiff in the face. causing a swollen lip. The defendant then repeatedly punched the plaintiff in her left thigh, leaving a bruise. Criminal charges were filed against the defendant. The plaintiff was treated at the Carlisle Hospital for her injuri es. b. On or about March. 1994, the defendant became angry and pushed the plaintiff Into a closet door, causing the plaintiff pain and soreness in her back, c. On or about November, 1093, when the plaintiff was eight months pregnant, the defendant became rough while they were having sexual intercourse, causing the plaintiff to hemorrhage. The plaintiff was treated at Carlisle Hospital. 5. The plaintiff believos and therefore avers that she will be in immediate and prosllnt danger of abuse from the defendant and The mother of the child Is Christine S, Dull, currently residing at 215 Calvary Road, Carlisle, Pennsylvania. She is single, The father of the chi ld is Larry A. Hershey, current ly residing at 353 N. Hanover Street, Carlisle, Pennsylvania. The plaintiff currently resides wi th the following persons: Name RelationShip Carol Dull Mother Gary Dull Father Jeff Dull Drother 8. The plaintiff has not previously participated in any litigation concerning custody. of the above mentioned child in this or any other Court. 9. The plaintiff has no knowledge of any custody proceedings concerning this child pending before a court in this or any other jurisdiction. 10, The plaintiff does not know of any person not a party to this action who has phYSical custody of the child or claims to have custody or visi tat ion rights wi th respect to the chi ld. 11. The best interests and permanent welfare of the child will be met If custody is temporarily granted to the plaintiff pending a hearing in tl1i5 matlln for the follOWing reasons: a. The plaintiff Is a fit parent who can best take care of her chi lll. b. The defendant has shown by his abuse of the plaintiff that he Is not 8n approprtatH role model for the child. The defendant has a duty to support the mi nor chi ld. 14. The de fendan tis amp 1 oyed a t Wendy's and has annua 1 salary in excess of $0,500.00. 15. The plaintiff is employed at Kenny Rogers and her income is insufficient to prOVide for her minimal needs and those of her child until such time as a support order can be obtained by filing at the Domestic Relations Office. 16. The plaintiff intends to petition for support within two weeks of the issuance of a protective order. E. LOSSES 17. The plaintiff has suffered losses as a result of the abuse by the defendant. As a resul t of the incident on or about June 12, 1994 the plaintiff was unable to attend work the next day due to both emotional and physical pain. The plaintiff is asking the court to award one duy's salary, totaling $21.25. 10. The plaintiff asks for reasonable attorney's fees to be paid to Legal Sllrvlces, Inc. pursuant to the Protection from Abuse Act. F, STATUS TO PROCEED IN FORMA PAUPERIS 19.
