INSTRUCTIONS TO THE DEFENDANT
As you know. the plllintiff hils filed alcgalllction 1ll!lIinst you under the
Protection From Abuse Ad and has obtained II Tempol'lll'Y Protective Order. The
plaintiff Is prepared to have 11 hellring held In order to obtain a Final
Protective Order effective for one (1) yenr.
As an alternative, you may consent to the entry of the Final Protective
Order to be in effect for one year. If you arc willing to consent you should
call Legal Services, Inc., 243-9400 or 766-8475, and ask to speak to the staff
person handling the case about a Consent Agreement.
The Consent Agreement should be prepared hefore the time scheduled for the
hearing so the Court will know ahead of time that the case will not be contested.
In most cases, regardless of whether a settlement by Consent Agreement has been
reached, the parties must appeal' in court at the time scheduled for hearing. If
the case Is uncontested, the court appearance will be brief. The judge will make
sure the parties understand the Consent Agreement and Final Protective Order.
If you do not agree to the entry of the Flnnl Protective Order, a contested
hearing will take place at the scheduled time. When a Final Protective Order Is
entered. It will be sent or given to you. the plaintiff. and the appropriate
police departments. If you fall to IIbide by the terms of the Final Protective
Order you will be subject to immediate arrest, and a fine of up to $1,000.00

plaintiff and sat on her facu restrict ing her bl'ellthing. When
the plaintiff stl'ugglml to get the defcndant off of her, he
thrcatencd her saying, "Now you're dead, bitch. 1'm gonna
kill you now." The defendant then grabbed the plaint iff by
her neck, choked her with one hand. threatened her sayl'lg,

man ever looks at you ngnln," The defendant then slowly cut
the flesh under the plaintiff's left eye while holding her
down by her throat. As the defendant licked the plaintiff's
blood from the butcher knife, he threatened her saying, "I'm
gonna kill you." The plllint iff fled the npal'tment fear ing for
her life. She sought medicnl treatment at the Carlisle
Hospital for Injuries she sustained as a result of this
Incident.

c. Since approximately January 25, 1994, the defendant has
physically abused the pllllntlff and threatened her with
violence in ways including, but not limited to, pushing and
shoving her abnut, choking her, threatening to kill her or her

5. On June 1, 1994, the plaintiff left her residence at the Blue Star
Molel, 7500 Allentown noulevlIl'd, IIl1rrisbul'g, Dauphin County, Pennsylvania, in
order to avoid further abuse,

and present danger of abuse from the defendant and that she Is In need of
protection from such abuse,

any dll'cct or Indirect contact with the plaintiff inclUding, but not limited to,
telcphone and written communications.
