CONFESSION OF JUDGMENT COMPLAINT
PURSUANT TO Pa. a.c.p 2952
AND NOW, comes Plaintiff Fulton Bank by its attorneys,
Caldwell & Kearns, who makes the following Complaint and states in
support thereof as follows, to wit:
1, Plaintiff Fulton Bank is a duly incorporated banking
company existing under the laws of the Commonwealth of
Pennsylvania. Plaintiff's principal place of business is located
at One Penn Square, Lancaster, Lancaster County, Pennsylvania
17604, Plaintiff does regularly conduct business within Cumberland
County, Pennsylvania and various places of business located
therein.
2. Defendant, Roland G. C. Young, Jr. is an adult individual
whose last known address is 201 Allenda1e Way, Camp Hill,
Cumberland County, Pennsylvania. However, Plaintiff Fulton Bank
believes and, therefore, avers that Defendant may have moved to
North East Maryland, with a mailing "address at PO Box 303, North
Eaot, Maryland 21901,
3. On or about March 15, 1984, Fulton Bank did enter into a
certain Promissory Note/Line of Credit Agreement with Roland G. C.
Young, Jr" Inc., a Pennsylvania corporation, and delivered same to
Fulton Bank for the valuable consideration recited therein,
whereupon said Roland G. C. Young, Jr., Inc, promised to pay to the
order of Fulton Bank the sum of Fifty Thousand ($50,000.00) Dollars
or, if less, the aggregate unpaid principal amount of all advances
made by Fulton Bank to Roland G. C. Young, Jr., Inc, with interest
as provided therein of 2% above the prime rate in effect from time
to time. A true and correct copy of the said promiosory Note/Line
of Credit Agreement is attached hereto, marked Exhibit "A" and made
a part hereof by reference thereto.
4, In further consideration for Fulton Bank. Defendant
Roland G. C. Young, Jr., Inc. was required and. did execute and
deliver to Fulton Bank a personal Guaranty, in an unlimited amount,
for the said obligations of Roland G. C. Young. Jr., Inc. A true
and correct copy of said personal guaranty is attached hereto,
marked Exhibit "B" and made a part hereof by reference thereto.
5. Roland G. C. Young, Jr., Inc. did borrow various amounts
from time to time on said Promissory Note/Line of Credit Agreement.
6. Nei ther Roland G. C. Young, Jr., Inc., or Guarantor
Roland G, C. Young, Jr., have, however, made any monthly payments
on said obligation as required by the terms of the Promissory
Note/Line of Credit Agreement and Guaranty, despite demand, since
December 15. 1993 through the date of the filing of this Complaint,
7. The amount currently due on the obligation is as followsl
Principal - $9,892.36; Interest " $485.81 through June 16, 1994;
and Late Fees - $]0,00. Furthermore. interest will accrue after
said June 16, 1994, at the rate of $2.55 per day.
8. Attorneys' fees of $1,483,80 are demanded as provided in
the Promissory Note/Line of Credit and Guaranty Agreements.
9, By virtue of the terms of the loan instruments, Exhibits
"A" and "B" hereto, all of the obligations are now due and demand
of payment is made therefor.
10, The instrument has not been assigned.
11. Judgment has not been heretofore entered on this
instrument in this or in any other jurisdiction.
12, It is unknown if Defendants are member of the Armed
Forces of the United States or its allies,
WHEREFORE, Plaintiff demands judgment against Defendants in
the total amount of $11,891.97.
