Kenneth A. Rethmeier, Jr., by and through his attorneys, Mancke,
Wagner, Hershey & Tully, who respectfully represents
1. Your petitioner Kenneth A. Rethmeier, Jr. is an adult
individual, whose residence at the time of the events which led
to his suspension was 3613 Golfview Drive, Mechanicsburg,
Cumberland County, Pennsylvania.
2. Kenneth A. Rethmeier, Jr. was a licensed motor vahicle
operator in the Commonwealth of Pennsylvania, who received a
notification of 1ioense suspension, a copy of which is attached
hereto and made a part hereof as Exhibit "A".
3. The Department of Transportation made a determination
that the petitioner was a habitual offender.
4. Baid license suspension for a period of five years is
improper, unjust nnd illegal.
5. Baid license suspension is illegal, unjust and improper
for reasons which inolude, but are not limited tOI
A. the conviction referred to in Exhibit IIAII was not
a separate act as contemplated under section
1542(b) of the Hotor Vehicle Code;
B. habitual offender status is not applicable to the
facts of the case;
C. habitual offender status included two other
violations, which were not separate and distinct
acts.
WHEREFORE, your petitioner prays Your Honorable Court to
hold a hearing to determine the validity of the suspension
outlined in Exhibit IIAII.

As a result of your conviction on 05/04/1994 of violating
Section 3733 of the Vehicle Code, FLEEING POLICE OFFICER on
04/17/1994, you have been placed in habitual offender status
because this is your third major vielation within a five year
period. Veur driving privilege is being revoked for a period
of 5 YEAR(S) as mandated by Section 15(,20 of the Vehicle
Code.
In order to comply with this sanction Yeu are required
to return any current driver's license, learner's permit
and/or temporary driver's license (camera card) in your pos-
session no later than the effective date listed below.
Failure to comply with this notice shall result in this Bu-
reau referring this matter to the Pennsylvania State Police
for prosecution under Sectien 1571(a)(4) of the Vehicle Code.
If you cannot comply with the requirements stated above, you
must contact the 8ureau (See information below) for further
directions on how to receive credit towards yeur sanction.
When the department receives your license or acknow1-
e~gement, it will send you a receipt. If you do not receive
h,is receipt within 15 days contact the department imme-
diately. Otherwise, you may not be given credit toward serv-
ing this sanction.
