SUPERSEDEAS AND FOR POSSESSION OF REAL ESTATH
GN Associates, by its counsel, Fred H. Hait, Esquire, files
this Petition to Li fe Supersedeas and direct possession of
certain real estate/ stating as follows:
1. Plaintiff / GN Associates ("Landlord") / a partnership
which maintains a place of business at 2316 Derry Road,
Lancaster, Pennsylvania 17601.
2. Defendant, Ethel Booker ("Tenant"), is an adult
individual whose last known address is 223 Plaza Drive, Boiling
springs, cumberland County, Pennsylvania 17007.
3. Tenant leases a residence at 223 Plaza Drive, Boiling
springs/ Cumberland county, Pennsylvania from Landlord pursuant
to a written Lease Agreement first executed on February 24/ 1986
for a term running from March 1/ 1986 to February 28, 1987/ and
orally renewed with rent adjustments since that time.
4. On May 27/ 1994/ District Justice Susan K. Day of
magisterial district number 09-3-03 entered jUdgment against
Tenant and granted possession of the above described property to
Landlord.
5. On June 24/ 1994/ Tenant filed a Notice of Appeal to the
jUdgment of possession entered by District Justice Day.
6. On June 24, 1994, Tenant deposited into an escrow
account a total of $322.00 for payment of rent for June and July
of 1994. (Certified copy of docket attached as Exhibit "A").
7. Tenant's June 24, 1994 appeal, along with the rent
esorow deposit, operate as a supersedeas to the judgment of
possession entered by District Justice Day according to
Pa.R.C.P.D.J. 100BB, 42 Pa.C.S.A., and Cumberland County Rule
357(1)(2).
B. Tenant has not filed any bond with the Cumberland county
Prothonotary.
9. Tenant has not paid any rental payment or other amount
to the Prothonotary's escrow account since June 24, 1994.
10. Tenant's rent for the month of August was due on August
1, 1994 and absolutely no later than August 5, 1994.
(Plaintiff'u complaint Exhibit "A", Paragraphs 3, 5).
11. Tenant's rent for the month of August remains due and
unsatisfied, monthly rental payments being in the amount of One
Hundred sixty-one Dollars ($161.00).
12. Because of Tenant's failure to pay the August rent or
to file a bond, Tenant is no longer entitled to a supersedeas
from enforcing judgment for possession of the property at 223
Plaza Drive, Boiling springs, Pennsylvania.
13. Cumberland County Rules of Procedural Number 357 (3)
(Implementing Pa.R.C.P.J.P. 1000(B)) states I
After having obtained a supersedeas under
Paragraphs (1) and (2) of this RUle, if the
appellant subsequsntly fails to pay rent into
the Court when due, the appellee may have the
supersedeas terminated on application to the
Court.

I, Fred H. Hait, do hereby certify that the averments of the
plaintiff's Petition to Lift supersedeas and For possession of
Real Estate, are true and correct to the best of my knowledge,

AFFIDAVIT
1. I, Ethel Booker, am the defendant in the above-captioned
action, which is an appeal from a judgment rendered by District
Justice Susan K. Dayan May 27, 1994, awarding Plaintiff
possession of the apartment in which I reside and alleged back
rent.
2. The rent for my apartment, located at 223 Plaza Drive,
Boiling Springs, Cumberland County, Pennsylvania, is $161.00 per
month, and becomes due on or before the 6th day of each month.
3. My next rent payment will be due on or before the 6th
day of JUly, 1994.
4. I verify that the statements made in this Affidavit are
true and correct. I understand that false statements herein are
made subject to the penalties of 18 Pa. C.S. 4904, relating to
unsworn falsification to authorities.

1. Plaintiff is GN Associates, a partnership which
maintains a place of business at 2316 Dairy Road, Lancaster, PA
17601.
2. Defendant Ethel Booker is an adult individual whose last
known address is 223 Plaza Drive, Boiling springs, Cumberland
County, Pennsylvania.
3. Defendant leases a residence at 223 Plaza Drive, Boiling
springs, Pennsylvania from Plaintiff pursuant to a written lease
agreement first executed February 24, 1986 for a term running
from March I, 1986 to February 28, 1987, and orally renewed
annually with rent adjustments since that time.
A true and
correct copy of the lease is marked Exhibit "A", attached hereto,
and hereby incorporated by reference.
4. The present term of the lease extends from March 1, 1994
to February 28, 1995, at a monthly rental of $101.00
5. Defendant has failed and refused to pay the monthly rent
for March, April, May, June, and July 1994, thereby committing a
material breach of the lease.
6. On March 8, 1994, Plaintiff hand delivered to Defendant
written notice of termination of the lease effective April 7,
1994 due to Defendant's failure to pay rent due March I, 1994 for

the month of March. A true and correot copy of the Notioe i.
marked Exhibit "D", attaohed hereto, and hereby incorporated by
reference.
7. Defendant, despite not having paid rent, continues to
oocupy Plaintiff's promises.
WHEREFORE, Plaintiff requests the Court to enter jUdgment
ejeoting Defendant from 223 Plaza Drive, Doiling
springs,
Pennsylvania, and to award costs of suit and such additional
relief as the Court deems appropriate.
COUNT TWO
8. The averments of Paragraphs 1 through 5, and 7, of this
complaint are hereby reaverred and incorporated by reference as
if textually set forth at length.
WHEREFORE, Plaintiff requests judgment against Defendant for
accrued rent and late oharges from March 1, 1994, costs of suit,
and uuch additional relief as the Court deems appropriate. The
amount currently due does not exceed $25,000.00.

COMES NOW the defendant, Ethel Booker, by counsel, Philip C.
Briganti, Esquire, Legal Services, Ino., and as her Answer to
Plaintiff's Complaint, states as followSI
1. Admitted.
2. Admitted.
3. Admitted.
4. Admitted in part and denied in part. Defendant admits
that her rent is $161.00 per month. However, she denies that the
present term of the lease extends from Maroh 1, 1994 to February
2B, 1995. Rather, since the expiration of the initial term of
her lease on February 2B, 19B7, the lease has continued for
successive one-month terms. See Plaintiff's Exhibit "A",
Paragraph 2.
5. Admitted in part and denied in part. Defendant admits
that she failed to pay the rent for March, April and May, 1994,
due to medical emergencies in her household Which strained her
finanoial resources.
However, she denies that she refused to
pay rent for these months, and avers that she is trying to obtain
the money necessary to become current on her rent. Defendant
also denies that she has failed or refused to pay rent for June
and July 1994, and avers that shs has made the rent payments for
these months into escrow with the Prothonotary, pursuant to Rule
357 of the Cumberland county Rules of Procedure.

8. Defendant repeats and incorporates by reference her
averments contained in Paragraphs 1 through 5, and 7, herein.
NEW MATTER
I. Demurrer - Improper Notice
9. Plaintiff's eviction notice dated March 8, 1994,
indicates that Plaintiff proposes to terminate the parties' Lease
Agreement for "material non-compliance and/or non-payment of
rent." Bee Plaintiff's Exhibit "B".
10. Pursuant to Paragraph 23(c) of the Lease Agreement and
24 C.F.R. S880.607(c), notices of termination of the lease for
material non-compliance, which includes nonpayment of rent, "must
be given in accordance with any time frames set forth in Btate
and local law." Bee Plaintiff's Exhibit "A".
11. In nonpayment of rent cases, Pennsylvania law, as set
forth under 68 P.S. S250.501, requires that an eviction notice
shall specify that the tenant shall remove within thirty days
from the date of service thereof, when the notice is given after
September 1st and before April 1st.
12. This statute has been judicially interpreted to require
a thirty-day notice prior to the expiration of the rental term.
See Mercer countv Aariculture societv v. Barnhardt, 459 A.2d 811,
313 Pa. Super. 206 (1983).
13. Therefore, because the parties had a month-to-month
lease, with each successive lease term beginning on the first day
of each month and ending on the last day of the month,
Plaintiff's eviction notice dated March 8, 1994, would not have
been effective to terminate the lease until after April 30, 1994.
14. Plaintiff commenced district justice eviction
proceedings on April 29, 1994, before the required period of
notice had been given, and therefore before the lease was
properly terminated. A copy of Plaintiff's district justice
Landlord and Tenant Complaint is attached hereto, incorporated by
reference and marked as Defendant's Exhibit "A".
15. Because Plaintiff prematurely filed the district justice
eviction action from which the appeal in this case was taken,
Count I of Plaintiff's Complaint requesting a jUdgment ejecting
Defendant from the rental premises fails to state a claim for
which relief can be granted.
II. Lack of Subiect Matter Jurisdiction
16. Defendant repeats and incorporates by reference her
averments contained in Paragraphs 9 through 15.
17. Because of the premature filing of the district justice
action, neither the district justice nor this Court could
properly assume jurisdiction over the subject matter of count I
of Plaintiff's Complaint.
III. Excessive Late Fees
lB. Late fees assessed under Paragraph 5 of the Lease
Agresment, $1.00 per day after the fifth day of the month the
rent is due until the end of that month, are excessive and
unconscionable. See Plaintiff's Exhibit "A".
19. Said late fee provision is unenforceable as a penalty
olause, in that the late fees it imposes grossly exceed
Plaintiff's actual or anticipated losses from late payment of
rent.
WHEREFORE, Defendant respectfully request that judgment be
entered in her favor, and for such other and further relief as
this Court may deem reasonable and just.

SUMMARY JUDGMENT
ON Associates by its counsel, Fred II. Hait, Esquire, files
this Motion For summary Judgment, stating as followsl
1. This is a landlord/tenant matter wherein jUdgment was
entered in favor of Plaintiff, (the Landlord), by District
Justice Susan K. Dayan May 27, 1994.
2. Defendant, on June 24, 1994, filed a Notice of Appeal to
the judgment of possession entered by District Justice Day.
3. On July 12, 1994, Plaintiff filed a Complaint in
response to Defendant's Praecipe to enter rule to file complaint.
4. Defendant filed its Answer with New Matter on July 25,
1994, a true and correct copy is attached as Exhibit "A".
5. In her Answer, Defendant admitted that she failed to pay
the rent for March, April, and May of 1994. (Defendant's Answer
Paragraph 5) .
6. Insomuch as Defendant has admitted that she has not paid
rent for the months of Maroh, April, and May of 1994, Defsndant
has admitted that she is in material breaoh of the lease terms.
(Plaintiff'S complaint Exhibit "A", Paragraph 23).
7. Defendant has deposited into an escrow account rents
currently due for the months of June and July of 1994. (A true
and correct copy of the docket indicating the same is attached as
Exhibit "B").
8. To date, Defendant has not deposited into the escrow
account any amount of money attributable to rent due for August,
1994. (See Defendant's Answer, Paragraph 5; Exhibit "B").
9. Insomuch as Defendant has not paid into the escrow
account any money attributable to rent for the month of August,
1994, Defendant continues to be in material breach of the lease
terms.
10. The lease has been orally renewed with rent adjustments
since February 28, 1987. There have been no adjustments to the
terms regarding the rent due date.
11. There exists no genuine issue of material fact and
Plaintiff is entitled as a matter of law to summary judgment.
WHEREFORE, Plaintiff, GN Associates, requests this Court to
enter judgment in its favor on Counts I and II of its complaint,
awarding:
a) Immediate possession of the premises at 223 Plaza
Drive, Boiling springs, Cumberland County, Pennsylvania 17007 to
Plaintiff and an Order for Defendant to remove herself and all
of her possessions from the premises at 223 Plaza Drive, Boiling
Springs, Cumberland County, Pennsylvania 17007;
b) Accrued rent and late charges from March 1, 1994
until the date Defendant vacates the property;
c) Costs of suit; and
d) Any such additional relief as the court deems
appropriate.

2. Plaintiff's Motion For Summary JUdgment is dismissed.
3. JUdgment is entered against Defendant awarding Plaintiff
possession of 223 Plaza Drive, Boiling springs, Pennsylvania,
effective November 1, 1994.
4. JUdgment is entered in favor of Plaintiff and against
Defendant in the amount of $161.00 for rent due for March, 1994,
with interest from March 1, 1994.
5. Judgment is entered in favor of Plaintiff and against
Defendant in the amount of $161.00 for rent due for April, 1994,
with interest from April 1, 1994.
6. JUdgment is entered in favor of Plaintiff and against
Defendant in the amount of $161.00 for rent due for May, 1994,
with interest from May 1, 1994.
7. JUdgment is entered in favor of Plaintiff and against
Defendant in the amount of $161.00 for rent due for August, 1994,
with interest from August 1, 1994.

1. GN Associates, Plaintiff, will withdraw its Petition To
Lift Supersedeas and its Motion For Summary JUdgment previoUSly
filed in this matter.

In consideration for Plaintiff's withdrawing
Petition and Motion, Defendant agrees thatl
a) The Court shall enter jUdgment awarding Plaintiff
possession of 223 Plaza Drive, Boiling Springs, PennSYlvania,
effective November 1, 19941
b) The Court shall enter judgment for the Plaintiff
for a total amount of $805.00 for rent due Plaintiff for 223
Plaza Drive, Boiling Springs, Pennsylvania for the months of
March, April, May, August, and September 1994, the monthly rental
being $161.00. The jUdgment shall inclUde interest at the legal
rate from the dates each month's rent was duel
c) The Court shall direct the immsdiate release to
Plaintiff of the sum of $322.00 presently held in escrow by the
Prothonotary representing rent due Plaintiff for 223 Plaza Drive.
