CIVIL ACTION NO. 94- 1'1 '" - EQUITY E'.-...J: Qi.I.iH TERM PNC BANK KENTUCKY, INC., d/b/a PNC MORTGAGE COMPANY, Defendant COMPLAINT AND NOW, come the plaintiffs, Donald Lee Bohn, Jr. and Tina M. Dohn, husband and wife, by their attorneys, Fowler, Addams, Shughart & Rundle, and make the following complaint I 1. Plaintiffs are Donald Lee Bohn, Jr. and Tina M. Bohn, adult individuals residing at and owning the property at 225 West springville Road, Boiling springs, Cumberland County, Penneylvania. 2. Defendant ie PNC Bank Kentucky, Ino" d/b/a PNC Mortgage Company, a Kentucky oorporation with its principal place of business at 539 South Fourth Avenue, Louisville, Kentuoky. 3. Plaintiffs exeouted and delivered their mortgage and note to Parent Federal savings Bank, of Lancaster, Pennsylvania, on August 16, 1991, as a requirement for obtaining a $76,850.00 oonstruotion loan, said mortgage being recorded the same date in the Office of the Recorder of Deeds in and for Cumberland county, Pennsylvania, in Mortgage Book 1025, Page 563. 4. CCNB Bank, N.A" of Camp Hill, Pennsylvania, acquired said mortgage as successor by merger from said Parent Federal Savings Bank. 5. Defendant acquired said mortgage from said CCNB Bank, N.A., by assignment dated May 1, 1993 and recorded January 6, 1994, in the Office of the Recorder of Deeds, aforesaid, in Miso. Book 463, Page 199. 6. Defendant has been the holder of said mortgage at all times relevant to the claims hereinafter set forth. 7. At defendant's direction and by letter dated and faxed January 13, 1994, plaintiffs requested from defendant a payoff statement for said mortgage in connection with their refinancing thereof, a copy of which letter is attached hereto as Exhibit "A" and made a part hersof. B. Pursuant to such request and on the same date, defendant faxed to plaintiffs' attorney a payoff statement valid through January 26, 1994, a copy of which is attached hereto as Exhibit "8" and made a part hereof. 9. In accordance with such payoff statement and by check drawn January 25, 1994 and delivered by UPS, plaintiffs paid defendant the sum of $75,652.93, the amount requested by defendant to pay said mortgage loan in full, including the satisfaction fee therefor, copies of which check and UPS next day air receipt are attached hereto as Exhibit "C" and made a part hereof. 10. written Notice was sent to defendant by certified mail on April 11, 1994, requesting defendant to enter satisfaction of said mortgage on the records of the Cumberland County Recorder of Deeds Office within forty-five (45) days pursuant to Act of July 31, 196B, P.L. 866, No. 259, Sl, 21 P.S, S682, copies of which Notice and return receipt card are attached hereto as Exhibits "0" and "E", respectively, and made a part hereof. 11. Defendant has nevertheless failed to satisfy said mortgage of record. 12. Plaintiffs are planning to construct an addition to their said property and on June 17, 1994, applied for a new construction mortgage for that purpose. COUNT I 13. The averments contained in Paragraphs 1 through 12 are incorporated herein by referenoe. 14. More than forty-five (45) days have elapsed einoe the date when plaintiffs paid said mortgage loan in full, ino1uding the satisfaction fee therefor, pursuant to defendant's payoff statement. 16. More than forty-five (45) days have elapsed since the date when plaintiffs gave defendant written notice and requested defendant to enter satisfaction of said mortgage on the records of the Cumberland county Recorder of Deeds Office. WHEREFORE, plaintiffs request Your Honorable Court tOI (a) Or.der and direct defendant to enter satisfaction of laid mortgage on the records of the Cumberland county Recorder of Deede Officel and (b) Grant such other and further relief as may be just and proper. COUNT II 16. The averments contained in Paragraphs 1 through 15 are incorporated herein by reference. 17. Defendant's failure to satisfy said mortgage is, inter AliA, unlawfully encumbering of record their said property and interfering with their ability to consummate said new construction mortgage for which they have applied. 18. Plaintiffs are an aggrieved party by reason of such failure entitling them to recover from defendant a sum not exceeding said mortgage-money, to witl $76,850.00. WHEREFORE, plaintiffs request your Honorable Court to enter jUdgment in favor of plaintiffs and against defendant for unliquidated damages exceeding the jurisdictional amount requiring arbitration referral by local rule, plue interest and co.t. of suit.
