3. plaintiff has been selling mattresses to Defendant
on an open account in accordance with an oral agreement
between plaintiff and Defendant that Defendant will pay for
the same on or about the date of the delivery of the
mattresses.
4. From November 23, 1993 to the date of this filing,
Defendant has failed to remit payment due and owing to
Plaintiff for the receipt of said mattresses.
5. To date, the current outstanding balance Which
Defendant owes to Plaintiff is in the amount of Seventy Nine
Thousand Two Hundred Forty Five and 70/100 Dollars
(79,245.70) . A true and correct copy of the accounts
receivable detail aging report is attached hereto and is
marked as plaintiff's Exhibit "A".
6. Despite repeated requests from plaintiff,
Defendant continues to refuse to pay for the mattresses it
has received.
7. Defendants have been unjustly enriched by virtue
of Defendant's willful refusal to pay for the merchandise it
has received.
