is a copy of the docket entries from the case of Form Services.
Inc. v. Albert L. Walker. individually and tradina as Walker
General Contractors and Carol J. Walker. 10dividually find tradin9
ae Walker Gen,ral contractors, before the philadelphia Court of
Common Pleao, November Term, 1992, No. 3801. Exhibit "A"contains
a certified judgment in the amount of $22,230.49 against
Defendant Albert L. Walker.
2. penied. The allegations of Paragraph contain legal
conclusions to which no response is required.
3. Admitted in part, denied in part. It io admitted that
the Arbitrators found in favor of Defendant Carol J. Walker and
againot Plaintiff ~'orm Services, Inc. The Arbitrators also found
in favor of Plaintiff I"orln HelvlcllS, Inc. <Inri tI\Jillnllt Defendant
Albert L. Walker.
4. Denied. Paragraph 4 contains legal conclusions to
which no response ill required.
5 . Denied. Contrary to Defendants' statement that
execution "shall be stayed" under Rules 3121 (b) (1) and (2) , the
Rule 3121(b) of the Penneylvania Rules of Civil Procedure
specifically provides that execution "lIl'l.Y be stayed as to all or
any part cr the property of the Defendant upon its own Motion

WHEREFORE, Plaintiff Form Services, Inc., respectfully
requests that this Court deny Defendants' Motion, provide that
Execution may go forward against the property of Albert L.
Walker, and that Execution shall be stayed as to any property of
Carol Walker.

S. Rule 3121(b) of the Pennsylvania Rules of civil
Procedure provides I
Execution may be stayed by the court as to all
part of the orooertv of the defendant upon its
motion or application of any party in interest

6. If in fact the Praecipe for Execution was improper
because it included Carol Walker's name in the caption, whioh is
denied, under Rule 3121(b) this court should only stay execution
against the property of Carol Walker, not the property of Albert
Walker against whom judgment was entered in Philadelphia County
and transferred to Cumberland County.
