CIVIL ACTION - CUSTODY LINDA 1<. PUGll1 Pla ntiff ROBERT 1<. PUGH, Defendant COMPLAINT FOR CUSTODY AND NOW COMES the Plaintiff, LINDA K. PUGH, by and through her attorney, BATURIN & BATURIN, and respectfully sets forth the Plaintiff's Complaint as follows: 1. Plaintiff is Linda K. Pugh, an adult individual, sui juris, residing at 214 S. Enola Drive, Enola, Cumberland County, PA, 17025. 2. Defendant is Robert K. Pugh, an adult individual, sui juris, residing at 214 S. Enola Drive, Enola, Cumberland county, PA, 17025. 3. Plaintiff and Defendant are married, having been married on May 11, 1985, in Cumberland county, Pennsylvania, but will soon be separated, afterwhich, the Defendant will be residing at a different address than above. 4. The Plaintiff and Defendant are the natural parents of three children born during the marriage, Robert Kevin pugh, Jr. (presently 8 1/2 years of age, born 10/18/85), Justin Allen Pugh, (presently 5 1/2 years of age, born 9/3/88), and Jessica Marie Pugh, (presentl y 4 years of age, born 3/24/90). Said minor - 1 - children are the sUbject of this Custody Complaint. s. Said minor children, Robert Kevin Pugh, Jr., Justin Allen Pugh, and Jessica Marie Pugh, are presently in the custody of the Plaintiff, their natural mother. 6. Plaintiff seeks full legal and primary physical custody of the parties' minor children, Robert Kevin Pugh, Jr., Justin Allen Pugh, and Jessica Marie Pugh. 7. said minor chi ldren have resided at the following address since each of their birthsl 214 S. Enola Drive, Enola, Cumberland county, PA, 17025. 8. Plaintiff has not participated as a party or witness, or in any other capacity in other litigation concerning custody of said minor children. 10. Plaintiff has no information of a custody proceeding concerning the children pending in a Court of this Commonwealth. 11. The best interest and permanent welfare of said minor children will be served by granting the relief requested because I a. Plaintiff/natural mother is well able to adequately provide for the continuing health, educational needs and general welfare of said childrenr b, Plaintiff/natural mother ie well able to adequately provide for said children with a proper and wholesome environment, physioally, emotionally, peychologically and socially, within whioh to liver and, - 2 - c. Plaintiff/natural mother has been the primary caretaker of the children since their births, including, but not limited to, feeding, bathing, and driving thorn to activities I and, d. Defendant/natural father has no personal contact with the children other than to constantly yell at them and smack theml and, e. It is in the best interest of the children generally that primary legal and physical custody be granted to the children's natural mother, Linda K. Pugh, Plaintiff herein. 12. The Plaintiff knows of no other person or party to the within proceeding, who has physical custody of Robert Kevin Pugh, Jr., Justin Allen Pugh, and Jessica Marie Pugh, or who claims to have custody or visitation rights with respect to them, WHEREFORE, Plaintiff requests this Honorable Court to grant the relief requested, and any other relief deemed appropriate, and enter a Final Order granting legal and physical custody of said minor children, Robert Kevin Pugh, Jr., Justin Allen Pugh, snd Jessica Marie Pugh, to the Plaintiff, Linda K.
